Mustadrak al-Hakim — Hadith 6082

It is narrated from Urwah that Sayyiduna Mu'awiyah (may Allah be pleased with him), after the death of his brother Anbasah bin Abi Sufyan, appointed Sayyiduna Uqbah bin Amir al-Juhani (may Allah be pleased with him) as governor of Egypt in the year 44 AH, and in that year Sayyiduna Mu'awiyah (may Allah be pleased with him) led the Hajj. Ma'ruf bin Yazid al-Makki says: Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) was sitting in the Sacred Mosque and we were in front of him, when Sayyiduna Mu'awiyah (may Allah be pleased with him) came and sat by him. Ibn Abbas (may Allah be pleased with them both) turned away from him, so Mu'awiyah (may Allah be pleased with him) said: "What is the matter, that I see you turning away? Do you not know that I am more entitled to this matter (the caliphate) than your cousin (Sayyiduna Ali, may Allah be pleased with him)?" Ibn Abbas (may Allah be pleased with them both) asked: "Why? Is it because he (Ali) was a Muslim while you were a disbeliever?" Mu'awiyah (may Allah be pleased with him) said: "No, rather because I am the cousin of Uthman." He said: "Then his cousin is better than your cousin." Mu'awiyah (may Allah be pleased with him) said: "Uthman was killed wrongfully." Ibn Umar (may Allah be pleased with them both) was also present there, and Ibn Abbas (may Allah be pleased with them both) said: "By Allah! This one (Ibn Umar, may Allah be pleased with them both) is more entitled to this matter than you." Mu'awiyah (may Allah be pleased with him) said: "Umar was killed by a disbeliever, whereas Uthman was killed by a Muslim." Ibn Abbas (may Allah be pleased with them both) said: "By Allah! That only weakens your argument further."

Hadith Grading
Hadith Takhrij «
Explanation & Benefits
Shaykh Adil Murshid et al.
Important point: In manuscripts (S, M, B) it has been distorted here into "al-Kamili" (with mim), whereas the correct word is "al-Kabili" (with ba'), as found in manuscript (Z) and in the biographies of the narrator.

Important point: Abu Bakr here refers to the well-known muhaddith "Ibn Abi Shaybah".

Important point: In the manuscripts it is written "Ma'ruf bin Yazid", whereas there is no narrator by this name; the actual teacher of Abu Bakr bin 'Ayyash is "Ma'ruf bin Kharrabudh".

Grading: This chain is "hasan" on account of Abu Bakr bin 'Ayyash and his teacher Ma'ruf, provided that Ma'ruf's hearing from Ibn 'Abbas is established, since there is some hesitation about whether he met him.
