فسمعتُ أبا العباس محمد بن يعقوب يقول: سمعت العباس بن محمد الدُّوْريَّ يقول: سمعتُ يحيى بن مَعِين يقول في حديث أبي البَدّاح بن عاصم بن عَدي: يرويه مالك بن أنس، عن عبد الله بن أبي بكر، عن أبيه، عن أبي البَدّاح بن عاصم بن عَدي عن أبيه: أنَّ رسول الله ﷺ رَخّص للرِّعاء أن يَرمُوا الحِمَارَ ليلًا. قال يحيى: حدَّثَناه سفيان بن عُيينة، عن محمد بن أبي بكر، عن أبيه، عن أبي البَدّاح بن عَدي، عن أبيه: أنَّ رسول الله ﷺ رخّص للرِّعاء أن يَرمُوا يومًا ويدعوا يومًا (1). قال يحيى: وهذا خطأٌ، إنما هو كما قال مالك. قال يحيى: وكان سفيانُ إذا حدثَنا بهذا الحديث قال: ذهَب علَيَّ في هذا الحديث شيءٌ (2). قال الحاكم: وقد أسندَ أبو البَدّاح بن عاصم بن عدي، عن أبيه حديثًا آخَر:
It is narrated from Yahya bin Ma'in that the hadith of Abu al-Baddah bin Asim bin Adi which Imam Malik bin Anas narrates mentions that the Messenger of Allah (peace and blessings be upon him) granted the herders a concession to stone at night. Yahya says that Sufyan bin Uyaynah stated in it the words "to stone one day and leave off one day", but in Yahya's view this is a mistake and the narration of Imam Malik is the correct one; Sufyan himself used to admit some deficiency or uncertainty in this hadith.
Abu al-Baddah bin Asim bin Adi has also narrated another hadith from his father.

Reference / Source: It is in "Tarikh Yahya bin Ma'in" (narration of al-Abbas bin Muhammad al-Duri: 646). وقد جاء في رواية مُسدَّد بن مُسَرهد عند أبي داود (1976): عن سفيان بن عُيينة، عن عبد الله ومحمد ابنَى أبي بكر، عن أبيهما، عن أبي البَدّاح بن عدي، عن أبيه. هكذا قرن عبدَ الله بن أبي بكر بأخيه محمد، فذِكْر محمدٍ في رواية ابن عيينة ثابتٌ أيضًا. Important point: In the narration of Musaddad bin Musarhad in Abu Dawud (1976) it comes as: from Sufyan bin Uyaynah, from Abdullah and Muhammad (both sons of Abu Bakr), from their father, from Abu al-Baddah bin Adi, from his father. Thus his brother Muhammad is mentioned together with Abdullah bin Abi Bakr, so the mention of Muhammad in the narration of Ibn Uyaynah is also established. وقد تقدَّم الحديثُ عند المصنف برقم (1777) من طريق الحُميدي عن سفيان بن عيينة عن عبد الله بن أبي بكر. Note / Clarification: This hadith has already passed with the author (al-Hakim) under number (1777) via al-Humaydi (from Sufyan bin Uyaynah, from Abdullah bin Abi Bakr).
(2) الذي ذهب على سفيان بن عيينة في هذا الحديث هو ذكر الرمي يوم النحر ويوم النّفْر، كما في حديث مالك. Technical note / Defect ('illah): What Sufyan bin Uyaynah missed in this hadith is the mention of stoning (rami) on "Yawm al-Nahr" and "Yawm al-Nafr" (the day of departure from Mina), as in the hadith of Malik.
