It is narrated from Abu Harb bin Abi al-Aswad al-Dili that he said: I was present with Sayyiduna Ali and Sayyiduna al-Zubayr (may Allah be pleased with them both) when Sayyiduna al-Zubayr (may Allah be pleased with him) turned back on his mount, cutting through the ranks of the army. His son Sayyiduna Abdullah (bin al-Zubayr) came before him and asked: What has happened to you? He replied: Ali (may Allah be pleased with him) has reminded me of a hadith that I heard from the Messenger of Allah (peace and blessings be upon him): "You will surely fight him (Ali) while you are the one wronging him," so now I will not fight him. His son said: "You did not come to fight, but rather to make peace between the people, so that Allah may set this matter right through you." Sayyiduna al-Zubayr (may Allah be pleased with him) said: "I have sworn an oath that I will not fight." His son said: "Then free your slave Jarjis (as expiation for the oath) and stay here so that you may make peace between the people." The narrator says: So he freed his slave Jarjis and stayed there. Then, when the affair of the people went wrong, he rode off on his horse.
Al-Zubayr's acknowledgement of this to Ali (may Allah be pleased with them both) has also been narrated through routes and narrations other than these.

Explanation & Benefits

Grading: (1) These are two chains whose narrators are acceptable (la ba'sa bihim), except "Fadl bin Fadalah" in the second chain; it has not become clear to us who he is. Technical note / Defect ('illah): Among those who narrate from Abu Harb bin Abi al-Aswad al-Dili is "al-Mufaddal bin Fadalah bin Abi Umayyah al-Qurashi" (their mawla); perhaps it is he, and his name has been corrupted in this chain. And Allah knows best. Technical note / Defect ('illah): There is disagreement in the chain of this report from the author's (al-Hakim's) shaykh "Abu 'Amr bin Matar al-'Adl". Reference / Source: Al-Bayhaqi narrated it in "Dala'il al-Nubuwwah" 6/ 414 - 415, and via him Ibn 'Asakir 18/ 409 - 410, from Abu Bakr Ahmad bin al-Hasan al-Qadi, from Abu 'Amr bin Matar, from Abu al-'Abbas 'Abdullah bin Muhammad bin Sawwar al-Hashimi al-Kufi, from Minjab bin al-Harith, from 'Abdullah bin al-Ajlah, from his father, from Yazid al-Faqir, from his father. (He said:) And I heard al-Fadl bin Fadalah narrating to my father from Abu Harb bin Abi al-Aswad al-Dili, from his father (the narration of one entered into that of the other); he said: When 'Ali and his companions drew near to Talhah and al-Zubayr and the ranks drew close … and he mentioned the report. Details of the narration: Al-Bayhaqi's shaykh Abu Bakr Ahmad bin al-Hasan al-Qadi added "the father of Yazid al-Faqir" in the first chain, and added "Abu al-Aswad al-Dili" (the father of Abu Harb) in the second chain. Important point: The addition of Abu al-Aswad is the more likely, since Abu al-Aswad took part in the Battle of the Camel with 'Ali; so it is he who witnessed 'Ali and al-Zubayr, not his son Abu Harb.
