Mustadrak al-Hakim — Hadith 5517

حدَّثَناه أبو أحمد الحسين بن علي التَّمِيمي، ﵀، أخبرنا محمد بن المُسيَّب، حدثنا أبو عُمير عيسى بن محمد بن النَّحّاس، حدثنا الوليد بن مسلم، حدثنا شُعيبٌ الخُراساني (2)، عن عطاء الخُراساني، عن سعيد بن المُسيّب: أَنَّ عُمر بن الخطَّاب لما أراد أن يَزِيد في مسجد رسول الله ﷺ وَقَعَتْ زيادته (3) على دارِ العباس ابن عبد المُطلب، فذكر الحديث بنحوٍ منه (1).
It is narrated from Sa'id bin al-Musayyab that when Umar bin al-Khattab (may Allah be pleased with him) intended to enlarge the Mosque of the Messenger of Allah (peace and blessings be upon him), that enlargement reached as far as the house of Abbas bin Abd al-Muttalib (may Allah be pleased with him); then the narrator related an incident like the previous hadith.

(2) كذلك نُسب هذا الرجل في رواية الحاكم خُراسانيًا، كما في "أصول المستدرك"، وكما رواه البيهقي في "سننه الكبرى" 6/ 67 عن أبي عبد الله الحاكم بسنده هذا! وهو وهمٌ يغلب على الظن أنه من جهة الحاكم نفسه، وربما يكون من أحد الرواة بينه وبين الوليد بن مسلم، فقد روى هذا الخبر محمد بن عمرو بن الجَرّاح الغَزّي عن الوليد بن مسلم، فقال: عن شعيب بن رُزَيق، هكذا غير منسوب، وهذا هو الصحيح، فهذا الرجل شامي مقدسي لا شأن له بخُراسان، ومنشأ الوهم هذا - فيما يبدو - هو انتقال النظر إلى نسبة شيخ شعيب في هذا الإسناد؛ وهو عطاء بن أبي مسلم الخُراساني، فكُرِّر سهوًا، والله أعلم.
Technical note / Defect ('illah): (2) Likewise in al-Hakim's narration this man is attributed as "al-Khurasani", as in "the original manuscripts of al-Mustadrak", and as al-Bayhaqi narrated it in "al-Sunan al-Kubra" (6/ 67) from Abu Abdullah al-Hakim with this same chain of his! This is an error (wahm), and most likely it is from al-Hakim himself, or perhaps from one of the narrators between him and al-Walid bin Muslim. For Muhammad bin 'Amr bin al-Jarrah al-Ghazzi narrated this report from al-Walid bin Muslim and said: "From Shu'ayb bin Ruzayq", without any attribution. This is correct, because this man is a Syrian from Jerusalem (Maqdisi) and has no connection with Khurasan. The origin of this error appears to be that (the scribe's) eye moved to the attribution (al-Khurasani) of Shu'ayb's shaykh in this chain, "'Ata' bin Abi Muslim al-Khurasani", so it was inadvertently repeated (with Shu'ayb too). (3) جاء في (ز) و (ب): وقف ساقيه، وفي (ص) و (م): وقعت ساقيه، هكذا غير معجمة، سوى نقطة وضعت في (ص) على ما قبل آخره فأصبحت كأنها نون، والمثبت على الصواب من رواية البيهقي في "الكبرى" 6/ 67 حيث روى هذا الخبر عن أبي عبد الله الحاكم، بإسناده هذا، فما عدا ذلك فهو تحريف.
Technical note / Defect ('illah): (3) In manuscripts (Z) and (B) it came as "waqafa saqayhi", and in manuscripts (S) and (M) "waq'at saqayhi" (without dots), except that in (S) there is a dot over the letter before the last, making it look like a "nun". What we have established in the text has been corrected from the narration of al-Bayhaqi in "al-Kubra" (6/ 67), where he narrated this report from Abu Abdullah al-Hakim with this same chain. Anything else is a distortion.

(1) صحيح لغيره كسابقه، وهذا إسناد رجاله لا بأس بهم، لكنه مرسل، غير أنه وإن كان كذلك فهو من مراسيل سعيد بن المسيب الذي تُعدُّ مراسيله من أقوى المراسيل حتى عدَّها بعضهم في حكم المسند المتصل لجلالة سعيدٍ. محمد بن المسيّب: هو ابن إسحاق النيسابوري الأرغباني، وشعيب: هو ابن رُزيق - بتقديم الراء - الشامي المقدسي، وعطاء الخراساني: هو ابن أبي مسلم.
Grading: (1) Like the previous narration, this is "sahih li-ghayrihi". This chain is one whose narrators are "la ba'sa bihim" (acceptable), but it is mursal. However, although it is mursal, it is one of the mursal narrations of Sa'id bin al-Musayyib, which are counted among the strongest mursal narrations, so much so that, owing to Sa'id's eminence, some have treated them as having the ruling of a connected musnad narration.
Technical note / Defect ('illah): Muhammad bin al-Musayyib is Ibn Ishaq al-Naysaburi al-Arghiyani; Shu'ayb is Ibn Ruzayq (with the ra' first), the Syrian from Jerusalem (Maqdisi); and 'Ata' al-Khurasani is Ibn Abi Muslim.
وأخرجه البيهقي في "السنن الكبرى" 6/ 76 عن أبي عبد الله الحاكم بهذا الإسناد. وقال في آخره بعد قوله: وقعت زيادته على دار العباس بن عبد المطلب: فذكر قصة وذكر فيها قصة الميزاب.
Reference / Source: It was narrated by al-Bayhaqi in "al-Sunan al-Kubra" (6/ 76) from Abu Abdullah al-Hakim with this same chain. And at the end, after the words "his extension fell upon the house of al-'Abbas bin Abd al-Muttalib", he said: then he mentioned a story, and in it he mentioned the story of the gutter spout (mizab).
وأخرجه البيهقي 6/ 168، ومن طريقه ابن عساكر في "تاريخ دمشق" 26/ 368 من طريق محمد بن عمرو بن الجراح الغَزِّي، عن الوليد بن مسلم، عن شعيب بن رُزيق وغيره، عن عطاء الخراساني، عن أبي سلمة بن عبد الرحمن وسعيد بن المسيب، عن أبي هريرة، قال: لما أراد عمر بن الخطاب أن يزيد في مسجد رسول الله ﷺ … فذكر قصة دار العباس دون قصة الميزاب، وجعل الحديث مسندًا متصلًا بذكر أبي هريرة، ولو كان ذلك محفوظًا لكان الإسناد حسنًا، لكن رُوي هذا الحديث بسند رجاله ثقات عن سعيد بن المسيب ليس فيه ذكر أبي هريرة، وهو المحفوظ، والله تعالى أعلم.
Reference / Source: It was narrated by al-Bayhaqi (6/ 168), and through him by Ibn 'Asakir in "Tarikh Dimashq" (26/ 368), via Muhammad bin 'Amr bin al-Jarrah al-Ghazzi, from al-Walid bin Muslim, from Shu'ayb bin Ruzayq and others, from 'Ata' al-Khurasani, from Abu Salamah bin Abd al-Rahman and Sa'id bin al-Musayyib, from Abu Hurayrah (may Allah be pleased with him), who said: "When 'Umar bin al-Khattab wanted to extend the Mosque of the Messenger of Allah (peace and blessings be upon him)", then he mentioned the story of al-'Abbas's house without the mention of the gutter spout, and made the hadith musnad and connected by mentioning Abu Hurayrah.
Technical note / Defect ('illah): Had this (connected form) been mahfuz, the chain would have been hasan, but this hadith is narrated with a chain of trustworthy narrators from Sa'id bin al-Musayyib without mention of Abu Hurayrah, and that is what is "mahfuz" (more correct). And Allah the Exalted knows best.
وأخرجه دون قصة الميزاب كذلك أحمد بن حنبل في "فضائل الصحابة" (1753)، وأخرجه علي بن حرب الطائي في الجزء الثاني من "حديثه عن ابن عيينة" (11)، ومن طريقه الخطيب البغدادي في "المتفق والمفترق" (273)، وابن عساكر 26/ 367، وأخرجه ابن حزم في "المحلى" 7/ 236 من طريق عبد الله بن الزبير الحميدي، ثلاثتهم (أحمد بن حنبل وعلي بن حرب والحميدي) عن سفيان بن عيينة، عن بشر بن عاصم الثقفي، عن سعيد بن المسيب، مرسلًا، إلّا الحميدي، فقال في روايته: عن سعيد بن المسيب، عن أبي بن كعب، قال: إنَّ عمر بن الخطاب والعباس بن عبد المطلب تحاكما. ورجاله ثقات، وسماع سعيد بن المسيب من أبي بن كعب محتمل، لأنَّ سعيدًا ولد لسنتين مضتا من خلافة عمر، وأبيّ بن كعب مات في خلافة عثمان على الصحيح، فلو ثبت ذكر أبي بن كعب لكان الإسناد صحيحًا، لكن قول الجماعة الذين أرسلُوه أولى بالقبول، ولعلَّ الحُميدي لما قال: عن أبي بن كعب، أراد عن قصة أبي بن كعب في تحكيم عمر والعباس إياه في خصومتهما، والله تعالى أعلم. وأخرجه أبو سعيد المُفضَّل محمد الجَنَدي في "فضائل المدينة" (50) عن ابن أبي عمر العَدَني وسعيد بن منصور، عن سفيان بن عيينة، عن بشر بن عاصم، مرسلًا ليس فيه ذكر سعيد بن المسيب.
Reference / Source: It was narrated without the story of the gutter spout by Ahmad bin Hanbal in "Fada'il al-Sahabah" (1753). Also 'Ali bin Harb al-Ta'i narrated it in the second part of "Hadithuhu 'an Ibn 'Uyaynah" (11), and through him al-Khatib al-Baghdadi in "al-Muttafiq wa al-Muftariq" (273) and Ibn 'Asakir (26/ 367); and Ibn Hazm narrated it in "al-Muhalla" (7/ 236) via Abdullah bin al-Zubayr al-Humaydi. All three of them (Ahmad, 'Ali bin Harb and al-Humaydi) narrated it from Sufyan bin 'Uyaynah, from Bishr bin 'Asim al-Thaqafi, from Sa'id bin al-Musayyib, as mursal; except al-Humaydi, who said in his narration: "From Sa'id bin al-Musayyib, from Ubayy bin Ka'b, who said: 'Umar bin al-Khattab and al-'Abbas bin Abd al-Muttalib took their dispute to arbitration."
Technical note / Defect ('illah): Its narrators are thiqah, and it is possible that Sa'id bin al-Musayyib heard from Ubayy bin Ka'b, because Sa'id was born two years into the caliphate of 'Umar, and according to the correct view Ubayy bin Ka'b died during the caliphate of 'Uthman. If the mention of Ubayy bin Ka'b were established, the chain would be sahih, but the statement of the group who narrated it as mursal is more worthy of acceptance. Perhaps when al-Humaydi said "from Ubayy bin Ka'b", he meant "about the story of Ubayy bin Ka'b", in which 'Umar and al-'Abbas made him the arbiter in their dispute. And Allah knows best. Also Abu Sa'id al-Mufaddal (bin) Muhammad al-Janadi narrated it in "Fada'il al-Madinah" (50) from Ibn Abi 'Umar al-'Adani and Sa'id bin Mansur, from Sufyan bin 'Uyaynah, from Bishr bin 'Asim, as mursal, without even the mention of Sa'id bin al-Musayyib.
