Mustadrak al-Hakim — Hadith 5438

وأخبرني أبو عبد الله محمد بن علي الصنعاني بمكة، حدَّثنا إسحاق بن إبراهيم، أخبرنا عبد الرزاق، أخبرنا مَعمرَ، عن عبد الملك بن عُمير، عن قَبِيصة بن جابر الأسدي، قال: كنت مُحرِمًا فرأيتُ ظَبْيًا، فرميتُه فأصبتُ خُشَشَاءَهُ - يعني أصلَ قَرْنِه - فمات، فوَقَعَ في نفسي من ذلك، فأتيتُ عُمر بن الخطاب أسألُه، فوجدتُ إلى جَنْبِه رجلًا أبيضَ رقيقَ الوجه، فإذا هو عبد الرحمن بن عوف، فسألت عمرَ، فالتفَتَ إلى عبد الرحمن فقال: ترى شاةً تكفيه؟ قال: نعم، فأمرني أن أذبَحَ شاةً، فلما قُمْنا من عنده، قال صاحبٌ لي: إنَّ أمير المؤمنين لم يُحسِنُ أن يُفتِيَك حتى سأل الرجلَ، فسمع عمرُ بعضَ كلامِه، فعَلَاهُ عمرُ بالدِّرَّة ضربًا، ثم أقبل عليَّ لِيضْرِبَني، فقلتُ: يا أمير المؤمنين، إني لم أقُلْ شيئًا، إنما هو قالَه، قال: فتركَني، ثم قال: أردتَ أن تقتُلَ الحرامَ، وتتعدّى الفُتْيا؟! ثم قال أمير المؤمنين: إنَّ في الإنسان عشرةَ أخلاقٍ، تسعةٌ حسنةً، وواحدٌ سيِّئ، ويُفسِدُها ذلك السيِّئُ، ثم قال: إياكَ وعَثْرة (1) الشَّباب (2).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

It is narrated from Qabisah bin Jabir al-Asadi that he said: I was in the state of ihram when I saw a deer. I struck it (with a stone or an arrow), and it hit the base of its horn, and it died. I felt uneasy in my heart about this, so I came to Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) to ask about the matter. I found a man of fair complexion with a gentle face sitting beside him, and he was Sayyiduna Abd al-Rahman bin Awf (may Allah be pleased with him). I asked Sayyiduna Umar, and he turned to Abd al-Rahman and asked: "Do you think one sheep (as expiation) is sufficient for him?" He said: "Yes." So he ordered me to slaughter a sheep. When we got up from his presence, a companion of mine said: "The Commander of the Faithful could not give you a fatwa himself until he asked that man." Sayyiduna Umar (may Allah be pleased with him) overheard part of what he said, and he gave him a sound beating with his whip. Then he came towards me to beat me, and I said: "O Commander of the Faithful! I did not say anything; it was he who said it." So he left me. Then he said: "You killed game while in the state of ihram, and now you object to the fatwa?!" Then the Commander of the Faithful said: "In a person there are ten traits, nine of which are good and one bad, and that one bad trait ruins all the rest." Then he said: "Beware of the slips of youth."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(1) في النسخ الخطية: وعشرة، والمثبت من "تلخيص المستدرك" وهو الموافق لرواية البيهقي في "سننه الكبرى" 5/ 181 عن أبي عبد الله الحاكم، بهذا الإسناد، وهو في "مصنف عبد الرزاق" (8239).
Technical note / Defect ('illah): (1) In the manuscripts the word is written "wa 'asharah" (and ten), whereas the correct word is what we have established from "Talkhis al-Mustadrak". This same wording agrees with al-Bayhaqi's "al-Sunan al-Kubra" (5/ 181), from the narration of Abu 'Abdullah al-Hakim, and with "Musannaf 'Abd al-Razzaq" (8239).

(2) إسناده صحيح. وهو في "مصنف عبد الرزاق" (8239).
Grading: (2) Its chain is "sahih".

وأخرجه البيهقي في "السنن الكبرى" 5/ 181، وفي "الصغرى" (1571)، ومن طريقه ابن عساكر 49/ 246 - 247 عن أبي عبد الله الحاكم، بهذا الإسناد.
Reference / Source: It was narrated by al-Bayhaqi in "al-Sunan al-Kubra" (5/ 181) and "al-Sunan al-Sughra" (1571), and via him by Ibn 'Asakir (49/ 246-247), from Abu 'Abdullah al-Hakim, with this chain.
وأخرجه الطبراني في "الكبير" (258)، وعنه أبو نعيم في "معرفة الصحابة" (458) عن إسحاق بن إبراهيم الدَّبَري، به.
Reference / Source: It was narrated by al-Tabarani in "al-Mu'jam al-Kabir" (258), and from him by Abu Nu'aym in "Ma'rifat al-Sahabah" (458), via Ishaq bin Ibrahim al-Dabari.
وأخرجه بنحوه عبد الرزاق (8240)، وأبو عُبيد في "غريب الحديث" 3/ 362، والطبري في "تفسيره" 7/ 45 و 48، والطحاوي في "أحكام القرآن" (1716) و (1717)، وابن أبي حاتم الرازي في "تفسيره" 4/ 1206، والطبراني في "الكبير" (259)، وأبو نعيم في "معرفة الصحابة" (459)، والبيهقي في "الكبرى" 5/ 181، وابن عساكر 49/ 242 و 242 - 244 و 244 - 245 و 245 - 246 من طرق عن عبد الملك بن عُمير، به. وبعضهم لا يُصرّح باسم عبد الرحمن بن عوف في الخبر.
Reference / Source: It was narrated with a similar meaning by 'Abd al-Razzaq (8240), Abu 'Ubayd in "Gharib al-Hadith" (3/ 362), al-Tabari in his "Tafsir" (7/ 45 and 48), al-Tahawi in "Ahkam al-Qur'an" (1716, 1717), Ibn Abi Hatim in his "Tafsir" (4/ 1206), al-Tabarani in "al-Kabir" (259), Abu Nu'aym in "Ma'rifat al-Sahabah" (459), al-Bayhaqi in "al-Kubra" (5/ 181) and Ibn 'Asakir (49/ 242 to 246), through various routes from 'Abd al-Malik bin 'Umayr.
Note / Clarification: In some of these narrations the name of 'Abd al-Rahman bin 'Awf (may Allah be pleased with him) is not stated explicitly.
وأخرجه بنحوه الطبري 7/ 45 و 48 من طريق الشَّعبي، عن قبيصة بن جابر، به.
Reference / Source: Al-Tabari (7/ 45 and 48) narrated it similarly by way of al-Sha'bi, from Qabisah bin Jabir.
