Note / Clarification: (3) The word "Abi" had dropped out of manuscripts (Z) and (B). He is "Muhammad bin Abi al-Sari al-Asqalani", and the name of Abu al-Sari is "al-Mutawakkil".
(1) إسناده ضعيف لضعف صالح بن يحيى بن المقدام، وقد اختُلف عليه في إسناده كذلك، فكان أحيانًا يرويه عن جده المقدام مباشرة ولا يذكر أباه، على أنَّ في متنه نكارة أيضًا، وقد نقل الحافظُ المنذريُّ في "اختصار سنن أبي داود" 5/ 316 - 317 تضعيف أهل العلم لهذا الحديث وإنكارهم له، منهم الواقدي وأحمد بن حنبل والبخاري والخطابي والدارقطني والبيهقي وابنُ عبد البر. قلنا: وضعَّفه كذلك الجُوْرقاني في "الأباطيل" 2/ 263، وابنُ حزم في "المحلى" 7/ 407، وعبدُ الحق الإشبيلي فيما نقلَه عنه ابن القطان في "بيان الوهم" 3/ 575، ووافقه عليه، وضعَّفه أيضًا الحافظ المنذريُّ في "اختصار سنن أبي داود" 5/ 309، والحافظُ ابن حجر في "فتح الباري" 17/ 107، وقال: هو شاذٌّ منكر. قلنا: ووجه نكارته فيما قاله الواقدي وأحمد والبخاري وابن عبد البر وابن حجر أن خالد بن الوليد لم يشهد خيبر، لأنه إنما أسلم بعدها وقُبيل الفتح كما يدلُّ عليه حديثُ عمرو بن العاص الآتي برقم (5377).
Grading: (1) This chain is "da'if" (weak) because of the weakness of "Salih bin Yahya bin al-Miqdam".
Technical note / Defect ('illah): There is also disagreement over him in its chain: sometimes he narrated it directly from his grandfather al-Miqdam without mentioning his father. Moreover, there is "nakarah" (objectionable content) in its text as well. Al-Hafiz al-Mundhiri, in "Ikhtisar Sunan Abi Dawud" (5/ 316-317), quoted the scholars' weakening and rejection of this hadith, among them al-Waqidi, Ahmad bin Hanbal, al-Bukhari, al-Khattabi, al-Daraqutni, al-Bayhaqi and Ibn Abd al-Barr. We (the editors) say: it was likewise declared weak by al-Jawraqani ("al-Abatil" 2/ 263), Ibn Hazm ("al-Muhalla" 7/ 407) and Abd al-Haqq al-Ishbili (as quoted from him by Ibn al-Qattan in "Bayan al-Wahm" 3/ 575, who agreed with him). Al-Hafiz al-Mundhiri also declared it weak in "Ikhtisar Sunan Abi Dawud" (5/ 309), and al-Hafiz Ibn Hajar in "Fath al-Bari" (17/ 107), who said: "It is shadh and munkar." We say: the reason for its being munkar, according to what al-Waqidi, Ahmad, al-Bukhari, Ibn Abd al-Barr and Ibn Hajar said, is that Khalid bin al-Walid was not present at Khaybar, because he accepted Islam only after it, shortly before the conquest (of Makkah), as the hadith of Amr bin al-As which will come at number (5377) indicates.
ووجه آخر في نكارة هذا الحديث، وهو أنه ورد فيه عند غير المصنف أنَّ رسول الله ﷺ قال يومئذٍ: "حرامٌ عليكم حُمر الأهلية وخيلها وبغالها"، وأنَّ هذا يخالف حديث جابر بن عبد الله الذي أخرجه الشيخان: البخاري (4219)، ومسلم (1941): أنه ﷺ أذن لهم يوم خيبر في لحوم الخيل.
Technical note / Defect ('illah): Another reason for this hadith being munkar is that, in narrations other than the author's, it states that the Messenger of Allah (peace and blessings be upon him) said on that day: "Forbidden to you are the domestic donkeys, and horses and mules." This contradicts the hadith of Jabir bin Abdullah (al-Bukhari 4219, Muslim 1941) that "he (peace and blessings be upon him) permitted them the meat of horses on the day of Khaybar."
وأخرجه أحمد 28/ (16818) عن علي بن بحر، عن محمد بن حرب، بهذا الإسناد. وزاد فيه عن خالد بن الوليد قوله: ففعلتُ، فقام في الناس فقال: "يا أيها الناس ما بالكم أسرعتُم في حظائر يهود؟ ألا لا تحل أموال المعاهَدين إلا بحقها، وحرام عليكم حمر الأهلية والإنسية وخيلُها وبغالُها، وكل ذي نابٍ من السَّبُع وكل ذي مِخلَبٍ من الطير".
Reference / Source: Ahmad (28/ 16818) recorded it from Ali bin Bahr, from Muhammad bin Harb, with this same chain. In it there is an addition, the statement of Khalid bin al-Walid: "So I did so. Then he stood among the people and said: 'O people, what is the matter with you, that you rushed into the enclosures of the Jews? Indeed, the wealth of those under covenant (mu'ahadun) is not lawful except by its right. And forbidden to you are the domestic and tame donkeys, and horses and mules, and every predator with fangs among the beasts of prey and every bird with talons.'"
وأخرجه بطوله أحمد (16816) عن أحمد بن عبد الملك الحراني، وأبو داود (3806) عن عمرو بن عثمان الحمصي، كلاهما عن محمد بن حرب الخولاني، عن أبي سلمة سليمان بن سُليم، عن صالح بن يحيى بن المقدام، عن جده المقدام، عن خالد بن الوليد. فلم يذكر صالحٌ أباه يحيى بن المقدام، لكن لم يذكر فيه أبو داود القطعة التي في حديث المصنِّف فيما أمر النبي ﷺ خالدًا أن ينادي به في الناس.
Reference / Source: It was recorded in full by Ahmad (16816) from Ahmad bin Abd al-Malik al-Harrani, and Abu Dawud (3806) from Amr bin Uthman al-Himsi, both of them from Muhammad bin Harb al-Khawlani, from Abu Salamah Sulayman bin Sulaym, from Salih bin Yahya bin al-Miqdam, from his grandfather al-Miqdam, from Khalid bin al-Walid.
Technical note / Defect ('illah): In it Salih did not mention his father Yahya bin al-Miqdam. But Abu Dawud did not mention in it the portion that is in the author's hadith, about what the Prophet (peace and blessings be upon him) commanded Khalid to proclaim among the people.
وقد روى منه قطعة النهي عن لحوم الحمر الأهلية والخيل والبغال وكل ذي ناب من السباع: ثورُ بن يزيد، عن صالح بن يحيى بن المقدام بن معدي كرب، عن أبيه، عن جده، عن خالد بن الوليد، لكن ليس فيه أنَّ ذلك كان يومَ خيبر. أخرجه من طريق أحمد (16817)، وأبو داود (3790)، وابن ماجه (3198)، والنسائي (4824) و (4825) و (6606). وقوله: الصلاة جامعةً، هو بالنصب فيهما على الحكاية، ونصب "الصلاة" على الإغراء، و "جامعة" على الحال، أي: احضروا الصلاة في حال كونها جامعة. وقيل: يرفعهما على أنَّ "الصلاة" مبتدأ، و "جامعة" خبره، ومعناه: ذات جماعة.
Reference / Source: The portion of it prohibiting the meat of domestic donkeys, horses, mules and every predator with fangs among the beasts of prey was narrated by Thawr bin Yazid, from Salih bin Yahya bin al-Miqdam bin Ma'dikarib, from his father, from his grandfather, from Khalid bin al-Walid, but it does not say that this was on the day of Khaybar. It was recorded through his route by Ahmad (16817), Abu Dawud (3790), Ibn Majah (3198) and al-Nasa'i (4824, 4825, 6606).
Note / Clarification: "al-salata jami'atan": both words are in the accusative (nasb) as a quotation; "al-salata" is accusative as an exhortation (ighra') and "jami'atan" as a circumstantial state (hal), that is: attend the prayer, it being a congregational one. It is also said that both are in the nominative (raf'), with "al-salatu" as the subject and "jami'atun" as its predicate, meaning: it is (a prayer) held in congregation.
