Mustadrak al-Hakim — Hadith 5363

حدثنا محمد بن علي الصَّنْعاني، حدثنا إسحاق بن إبراهيم، أخبرنا عبد الرزاق، أخبرنا الثَّوري، عن سَلَمة بن كُهَيل، عن معاوية بن سُوَيد بن مُقَرِّن، عن سُويد بن مُقرِّن، قال: كنَّا بني مُقرِّن سبعةً على عهدِ رسول الله ﷺ لنا خادمٌ، فلَطَمَه أحدنا، فقال النبي ﷺ: "أعتِقوها" (1). ذكرُ مناقب قَتَادة بن النُّعمان الظَّفَري، وهو أخو أبي سعيد الخُدْري لأُمِّه

It is narrated from Sayyiduna Suwayd bin Muqarrin (may Allah be pleased with him); he said: We, the Banu Muqarrin, were seven brothers in the time of the Messenger of Allah (peace and blessings be upon him) (residing in Madinah). We had a servant girl whom one of us slapped, so the Prophet (peace and blessings be upon him) said (as an expiation): "Set her free."

(1) إسناده صحيح. إسحاق بن إبراهيم: هو الدَّبَري، والثوري: هو سفيان بن سعيد.
Grading: (1) Its chain is sahih (authentic).
Note / Clarification: "Ishaq bin Ibrahim" refers to: al-Dabari, and "al-Thawri" refers to: Sufyan bin Sa'id.
وأخرجه أحمد 24/ (15705) و 39/ (23740)، ومسلم (1658)، وأبو داود (5167)، والنسائي (4992) من طرق عن سفيان الثوري، بهذا الإسناد. وزادوا فيه: قالوا: ليس لنا خادمٌ غيرها، قال: "فليستخدموها، فإذا استغنَوا عنها فليُخَلُّوا سبيلها".
Reference / Source: Ahmad (24/ 15705, 39/ 23740), Muslim (1658), Abu Dawud (5167) and al-Nasa'i (4992) recorded it through several routes from Sufyan al-Thawri, with this same chain.
Details of the narration: They added in it: "They said: We have no servant other than her. He said: 'Then let them use her service, and when they no longer need her, let them set her free (let her go her way).'"
وأخرجه النسائي (4990) من طريق عامر الشعبي، و (4991) من طريق أبي السَّفَر، كلاهما عن معاوية بن سويد، به. غير أنهما جعلا الخادم رجلًا لا امرأةً.
Reference / Source: Al-Nasa'i recorded it (4990) through the route of Amir al-Sha'bi and (4991) through the route of Abu al-Safar, both of them from Mu'awiyah bin Suwayd, with this chain.
Technical note / Defect ('illah): However, both of them made the servant a "man", not a woman.
وأخرجه بنحوه أحمد 24/ (15703)، ومسلم (1658)، والنسائي (4993) من طريق محمد بن المنكدر، عن أبي شعبة مولى سُويد بن مقرِّن، عن مولاهُ سويد بن مقرِّن. وجعل الخادم رجلًا كذلك.
Reference / Source: Ahmad (24/ 15703), Muslim (1658) and al-Nasa'i (4993) recorded something similar through the route of Muhammad bin al-Munkadir, from Abu Shu'bah (the freed slave of Suwayd bin Muqarrin), from his master Suwayd bin Muqarrin. He too made the servant a "man".
لكن سيأتي عند المصنف برقم (8302) من طريق هلال بن يساف عن سويد بن مقرن أنَّ الخادم كانت امرأةً، وفاقًا لرواية سلمة بن كُهيل عن معاوية بن سويد.
Reference / Source: But there will come later with the author, at number (8302), through the route of Hilal bin Yasaf from Suwayd bin Muqarrin, that the servant was a "woman", in agreement with the narration of Salamah bin Kuhayl (from Mu'awiyah bin Suwayd).
