Mustadrak al-Hakim — Hadith 5194

Simak bin Harb said: We were with Mudrik bin al-Muhallab in Sijistan, and there I heard an elderly man narrating from Sayyiduna Abu Sufyan bin al-Harith (may Allah be pleased with him) from the Prophet (peace and blessings be upon him) (as mentioned above), but that narrator did not mention the name of Abdullah bin Abi Sufyan in this chain.

Explanation & Benefits
Shaykh Adil Murshid et al.
Grading: (1) This hadith is "sahih li-ghayrihi", and there is "no harm" (la ba'sa bihim) in the narrators of this chain.
Technical note / Defect ('illah): But what is "mahfuz" (preserved) in it is that it is narrated from 'Abdullah bin Abi Sufyan bin al-Harith as "mursal", without mention of (his father) Abu Sufyan. This is how the author (al-Hakim) himself will record it later at no. (5198) via Muhammad bin Salih bin Hani' from Ibrahim bin Abi Talib, with a chain like the one here but with Abu Sufyan dropped from it.
Reference / Source: Likewise Abu al-Qasim al-Baghawi recorded it in "Mu'jam al-Sahabah" (721) from 'Ubaydullah bin 'Umar al-Qawariri, from Muhammad bin Ja'far (Ghundar), with this same chain. And likewise several narrators reported it from Shu'bah as "mursal". So this is what is "sahih and mahfuz".
Grading: Imam al-Bukhari stated firmly in his "al-Tarikh al-Kabir" [5/101] that it is "mursal", and al-Bayhaqi too, in "al-Sunan al-Kubra" [10/93], declared its being mursal to be correct.
Note / Clarification: As for Ibn Hajar, when he mentioned this "mawsul" (connected) chain in "Ithaf al-Maharah" (17749), he said: "If it is preserved, then it is sahih and connected!" (that is, he doubted whether it is preserved).
Technical note / Defect ('illah): (Disagreement over his being a Companion): Some authors of works on the Companions (such as al-Baghawi and Ibn 'Abd al-Barr) held firmly, on the basis of this very mursal narration, that "'Abdullah bin Abi Sufyan bin al-Harith" was a Companion. But others (such as Ibn Mandah, Abu Nu'aym and Ibn al-Athir) disagreed with them and said that he had neither companionship nor even a sighting of the Prophet. This is also the meaning of Imam al-Bukhari's statement when he stated firmly that this narration is "mursal".
Important point: And this is what is "correct", because this 'Abdullah is not mentioned alongside the Messenger of Allah (peace and blessings be upon him) in any report of the Sirah and the Maghazi. And Allah the Exalted knows best.
Note / Clarification: However, the author (al-Hakim) will bring it later at no. (5197) through another route: "from Shu'bah from Simak bin Harb", who said: "We were with Mudrik bin al-Muhallab in Sijistan, and I heard a shaykh narrating from Abu Sufyan bin al-Harith"
Technical note / Defect ('illah): After the coming narration no. (5197), the author stated firmly that the "unnamed shaykh" in that route is explicitly named in the narration of Muhammad bin Ja'far Ghundar from Shu'bah, meaning that he is "'Abdullah bin Abi Sufyan" himself. It is as if the author is declaring this hadith sahih as "mawsul" with mention of Abu Sufyan.
Important point: This statement of the author is open to "nazar" (question), as Ibn Hajar said in "al-Talkhis al-Habir" [4/184]. What supports Ibn Hajar's view is that Simak mentioned in that route that the shaykh narrated it to him in "Sijistan", when they were with "Mudrik bin al-Muhallab" (Ibn Abi Sufrah al-Azdi). Mudrik bin al-Muhallab took charge of Sijistan on behalf of his brother Yazid bin al-Muhallab (governor of Iraq and Khurasan) in the time of Sulayman bin 'Abd al-Malik bin Marwan, that is, in 96 AH or after. Whereas 'Abdullah bin Abi Sufyan had already been killed at Karbala with al-Husayn bin 'Ali bin Abi Talib in 61 AH.
Grading: So it is certain that the unnamed shaykh who narrated to Simak in the pavilion of Mudrik bin al-Muhallab cannot be 'Abdullah bin Abi Sufyan. This is therefore another narration of Simak from another unnamed shaykh whose name he did not disclose.
General principle: Thus Simak has two shaykhs for this hadith: first "'Abdullah bin Abi Sufyan bin al-Harith", whose narration is mursal; and second the "unnamed shaykh" who narrated it from Abu Sufyan bin al-Harith in connected form. And it is not known whether this unnamed shaykh heard from Abu Sufyan or not, since Abu Sufyan died early. And Allah knows best. In any case, the hadith has supporting reports through which it is authentic (if Allah wills).
Reference / Source: Abu al-Qasim al-Baghawi recorded it in "Mu'jam al-Sahabah" (1721), and via him Ibn 'Asakir in "Tarikh Dimashq" [29/72], from 'Ubaydullah bin 'Umar al-Qawariri, from Muhammad bin Ja'far Ghundar, from Shu'bah, from Simak, from 'Abdullah bin Abi Sufyan as "mursal".
Reference / Source: Abu al-Qasim al-Baghawi also recorded it (1721) - and via him Ibn 'Asakir [29/72] - via Abu Dawud al-Tayalisi; and Ibn Qani' in "Mu'jam al-Sahabah" [2/113], Abu Nu'aym in "Ma'rifat al-Sahabah" (4212), al-Bayhaqi in "Shu'ab al-Iman" (10717), and al-Diya' al-Maqdisi in "al-Ahadith al-Mukhtarah" [9/(393)] via Mu'adh bin Mu'adh al-'Anbari. Both of them (al-Tayalisi and Mu'adh) narrate it from Shu'bah, from Simak, from 'Abdullah bin Abi Sufyan, likewise as "mursal".
Corroborating chains and supporting reports: It is supported (as a shahid) by the hadith of Abu Sa'id al-Khudri in Ibn Majah (2426), and its chain is sahih.
Technical note / Defect ('illah): But his narration states that the woman from whom the Messenger of Allah (peace and blessings be upon him) borrowed dates was "Khawlah bint Qays", which is an "error" (wahm). The correct name is "bint Hakim", as in this narration (under discussion).
Corroborating chains and supporting reports: And as in the second supporting report of this hadith, the hadith of Abu Humayd al-Sa'idi [see: Abu 'Awanah's Sahih (7075), al-Tabarani's al-Saghir (1045), Abu Nu'aym's al-Hilyah 10/189]. He mentioned the like of our hadith, but it does not contain the final marfu' part. It also mentions that the woman who gave the loan was "Khawlah bint Hakim".
Corroborating chains and supporting reports: It has a third supporting report from the hadith of 'A'ishah (may Allah be pleased with her), found in 'Abd bin Humayd (1499), al-Bazzar (88), al-'Uqayli's "al-Du'afa'" (1820), and al-Bayhaqi's "al-Kubra" [6/20] and "Shu'ab al-Iman" (10718). It too mentions "Khawlah bint Hakim".
Note / Clarification: "Al-'athari": originally refers to crops and date palms that drink through their roots from rainwater collected in a hollow, as if it came upon the water ('athara 'ala al-ma') without any labour from its owner. But what is meant in this report - and Allah knows best - is that the dates were hollow, not filled out.
Note / Clarification: "Al-muta'ta'": a man afflicted by something that troubles or unsettles him.

Technical note / Defect ('illah): (1) (Ghundar) is the nickname of Muhammad bin Ja'far.

Grading: (1) This hadith is "sahih li-ghayrihi", and there is "no harm" in the narrators of this chain, were it not for this "unnamed shaykh" who is not named. And he is not 'Abdullah bin Abi Sufyan, as we have explained earlier.
Technical note / Defect ('illah): (Identifying the narrators): "Abu al-'Abbas al-Sayyari" refers to al-Qasim bin al-Qasim, "Abu al-Muwajjih" refers to Muhammad bin 'Amr al-Fazari, and "'Abdan" is the nickname of 'Abdullah bin 'Uthman bin Jabalah al-Marwazi.
Note / Clarification: This narration will come with the author (al-Hakim) later at no. (5197) via Ahmad bin Sayyar al-Marwazi from 'Abdan.

Technical note / Defect ('illah): (2) In the manuscripts this word has been corrupted into "yasma'".
