Mustadrak al-Hakim — Hadith 5186

حدثنا مُكرَم بن أحمد، حدثنا محمد بن عيسى المَدائني، حدثنا سفيان بن عُيينة، عن الزُّهْري، عن عُبيد الله بن عَبد الله، عن ابن عباس، عن سعد بن عُبادة: أنَّ أمَّه تُوفِّيَت وعليها صومٌ، قال: فسألتُ النبيَّ ﷺ، فأمَرَني أَن أَقضِيَه عنها (1). قد اتَّفق الشيخان على إخراج هذا الحديثِ: أنَّ أم سعد بن عُبادة تُوفّيت، ولم يَصِلَاهُ عنه (1). وهذا صحيحٌ على شرطهما. ذكر مناقبِ أبي سُفيان بن الحارث بن عبد المُطّلب ﵁ -

Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates from Sayyiduna Sa'd bin Ubadah (may Allah be pleased with him) that his mother died while she still owed some fasts. He said: I asked the Prophet (peace and blessings be upon him) about it, and he (peace and blessings be upon him) ordered me: "Make up those fasts on behalf of your mother."
The two Shaykhs agreed on recording the basis of this hadith, that the mother of Sa'd bin Ubadah died, but they did not record it as a connected report from him (Sa'd), while this hadith is sahih (authentic) on the condition of both of them.

(1) حديث صحيح، دون قوله: وعليها صوم، فالمحفوظ أنه قال: وعليها نَذرٌ، والوهم فيه هنا من جهة محمد بن عيسى المدائني - وهو ابن حيّان - فقد اختُلف فيه، وهو إلى الضعف أقرب، بل وهّاه المصنّف كما في "سؤالات السجزي" له (277). فاعجَبْ منه كيف صحَّح إسناده هنا! ولهذا قال الذهبي في "التلخيص": المدائني ضعيف.
Grading: (1) This hadith is "sahih", except for the words: "and she owed fasts".
Technical note / Defect ('illah): For the "mahfuz" (preserved) wording is: "and she owed a vow (nadhr)". The error here came from "Muhammad bin 'Isa al-Mada'ini" (Ibn Hayyan). There is disagreement about him, and he is closer to weakness. Indeed, the author (al-Hakim) himself declared him feeble (wahin) in "Su'alat al-Sijzi" (277). So it is astonishing how he declared his chain sahih here! That is why al-Dhahabi said in "al-Talkhis": "Al-Mada'ini is weak".
وقد اختُلف في هذا الحديث فبعضهم يقول فيه: عن ابن عباس عن سعد بن عُبادة، كما هنا، وبعضهم يقول فيه: عن ابن عباس: أنَّ سعيد بن عبادة استفتى رسول الله ﷺ … فيجعله من مسند ابن عباس. قال ابن حجر في "فتح الباري" 8/ 560: ابن عباس لم يدرك القصة، فتعيَّن ترجيح رواية من زاد فيه: عن سعد بن عُبادة، ويكون ابن عباس قد أخذه عنه، ويحتمل أن يكون أخذه عن غيره، ويكون قولُ من قال: عن سعد بن عُبادة، لم يقصد به الرواية، وإنما أراد: عن قصة سعد بن عُبادة، فتتحد الروايتان.
Technical note / Defect ('illah): (Variation in the chain): There is disagreement over this hadith; some narrate it as "from Ibn 'Abbas from Sa'd bin 'Ubadah" (as here), and some as "from Ibn 'Abbas, that Sa'd bin 'Ubadah asked the Messenger of Allah (peace and blessings be upon him) for a ruling...", making it part of the Musnad of Ibn 'Abbas.
Important point: Ibn Hajar said in "Fath al-Bari" [8/560]: Ibn 'Abbas did not witness this incident, so the narration of those who added "from Sa'd bin 'Ubadah" must be preferred, and Ibn 'Abbas will have taken it from Sa'd. It is also possible that he took it from someone else, and that the narrator who said "from Sa'd bin 'Ubadah" did not mean transmission but meant "concerning the story of Sa'd bin 'Ubadah"; in that way the two narrations become one.
وأخرجه النسائي (6455) عن محمد بن عبد الله بن يزيد المقرئ، عن سفيان بن عيينة، بهذا الإسناد. عن ابن عباس عن سعد أنه قال: ماتت أمي وعليها نذرٌ … الحديث. هكذا رواه بذكر النذر مطلقًا.
Reference / Source: Al-Nasa'i (6455) recorded it from Muhammad bin 'Abdullah bin Yazid al-Muqri', from Sufyan bin 'Uyaynah, with this same chain: from Ibn 'Abbas from Sa'd, that he said: "My mother died and she owed a vow..." Thus he mentioned the "vow" in general terms.
وأخرجه أحمد 3/ (1893)، ومسلم (1638)، والنسائي (4740) و (6454) من طرقٍ أخرى عن سفيان بن عيينة، به. غير أنهم قالوا: عن ابن عباس: أن سعد بن عبادة استفتى رسولَ الله ﷺ في نذرٍ كان على أمّه … هكذا رووه بذكر النذر مطلقًا، وجعلوه من مسند ابن عباس.
Reference / Source: Ahmad [3/(1893)], Muslim (1638) and al-Nasa'i (4740, 6454) recorded it through other routes from Sufyan bin 'Uyaynah.
Technical note / Defect ('illah): But they said: from Ibn 'Abbas, that "Sa'd bin 'Ubadah asked the Messenger of Allah (peace and blessings be upon him) for a ruling about a vow his mother owed..." They too mentioned the "vow" in general terms and made it part of the Musnad of Ibn 'Abbas.
وأخرجه أحمد 39/ (23846)، والنسائي (6450) من طريق سليمان بن كثير. وأخرجه النسائي (6451) من طريق عيسى بن يونس السَّبيعي، و (6452) من طريق محمد بن شعيب بن شابُور، كلاهما (السَّبيعي ومحمد بن شعيب) عن الأوزاعي، كلاهما (سليمان بن كثير والأوزاعي) عن الزهري، عن عبيد الله بن عبد الله، عن ابن عباس، عن سعد. فجعلاه من مسند سعد بن عُبادة، وذكرا النذر مطلقًا، غير أنَّ سليمان بن كثير قال في روايته: أفيجزئ عنها أن أُعتق عنها؟ قال ابن حجر في "الفتح" 8/ 560: أفادت هذه الرواية بيان ما هو النذر المذكور، وهو أنها نذرت أن تُعتق رَقبة، فماتت قبل أن تفعل، ويُحتمل أن تكون نذرت نذرًا مطلقًا غير مُعيَّن، فيكون الحديث حجةً لمن أفتى في النذر المطلق بكفارة يمين، والعتق أعلى كفارات الأيمان، فلذلك أمره أن يعتق عنها. قلنا: هذا إن سلمت روايةُ سليمان بن كثير من الوهم، فقد تكلّم أهلُ العلم بالحديث في روايته عن الزهري خاصةً، قالوا: كان يخطئ فيها.
Reference / Source: Ahmad [39/(23846)] and al-Nasa'i (6450) recorded it via Sulayman bin Kathir; al-Nasa'i (6451) via 'Isa bin Yunus al-Sabi'i, and (6452) via Muhammad bin Shu'ayb bin Shabur. These two (al-Sabi'i and Muhammad bin Shu'ayb) narrate from al-Awza'i, and these two (Sulayman and al-Awza'i) from al-Zuhri, from 'Ubaydullah bin 'Abdullah, from Ibn 'Abbas, from Sa'd. Thus they made it part of the Musnad of Sa'd bin 'Ubadah and mentioned the "vow" in general terms.
Technical note / Defect ('illah): However, Sulayman bin Kathir said in his narration: "Would it suffice for her if I free a slave on her behalf?"
Important point: Ibn Hajar said in "al-Fath" [8/560]: This narration clarifies what the "vow" was, namely a vow to free a slave, and she died before fulfilling it. It is also possible that she made a general (unspecified) vow, in which case the hadith is evidence for those who rule that an unspecified vow requires the expiation of an oath; and freeing a slave is the highest expiation of oaths, which is why he (peace and blessings be upon him) told him to free a slave on her behalf. We say: this holds only if Sulayman bin Kathir's narration is free of error, for the hadith scholars have criticised his narration from al-Zuhri specifically and said that he used to make mistakes in it.

Reference / Source: Ahmad [5/(3048)] recorded it from Muhammad bin Mus'ab al-Qarqasa'i, and al-Nasa'i (6453) via al-Walid bin Mazyad, both from al-Awza'i; Ahmad (3078) and Muslim (1638) via Ma'mar bin Rashid; Ahmad (3506) via Muhammad bin Abi Hafsah; al-Bukhari (2761), Muslim (1638) and Abu Dawud (3307) via Malik bin Anas; al-Bukhari (6698) via Shu'ayb bin Abi Hamzah; al-Bukhari (6959), Muslim (1638), Ibn Majah (2132), al-Tirmidhi (1546) and al-Nasa'i (4741, 6456) via al-Layth bin Sa'd; Muslim (1638) via Yunus bin Yazid; and Muslim (1638) and al-Nasa'i (4742, 6457) via Bakr bin Wa'il. All these narrators (al-Awza'i, Ibn Abi Hafsah, Malik, Shu'ayb, al-Layth, Yunus, Bakr) narrate it from al-Zuhri with this same chain: from 'Abdullah bin 'Abbas, that "Sa'd bin 'Ubadah asked for a ruling..." Thus all of them made it part of the Musnad of Ibn 'Abbas and mentioned the "vow" in general terms.
وقد روي عن ابن عباس حديثٌ آخر في قصة أخرى غير قصة سعد بن عُبادة بذكر الصوم من رواية سعيد بن جبير وغيره عنه كما عند أحمد 3/ (1860) والبخاري (1953) ومسلم (1148) وغيرهم، والصواب أنها قصة أخرى كما قال البيهقي في "السنن" 4/ 256 وابن عبد البر في "التمهيد" 9/ 26 وابن حجر في "فتح الباري" 8/ 561.
General principle: Another hadith is reported from Ibn 'Abbas (may Allah be pleased with them both), in a story other than that of Sa'd bin 'Ubadah, mentioning "fasts", through Sa'id bin Jubayr and others; as found in Ahmad [3/(1860)], al-Bukhari (1953) and Muslim (1148).
Important point: The correct view is that it is a separate story, as al-Bayhaqi stated in "al-Sunan" [4/256], Ibn 'Abd al-Barr in "al-Tamhid" [9/26] and Ibn Hajar in "Fath al-Bari" [8/561].

(1) يعني جعلاه من مسند ابن عباس، وهو كذلك، لكنهما لم يقع عندهما أنَّ الذي كان على أمّ سعد صيامٌ، إنما جاء في روايتهما أنه كان نذرًا هكذا مطلقًا غير مقيَّد كما تقدم بيانه في التخريج.
Note / Clarification: (1) That is, the two of them (al-Bukhari and Muslim) made it part of the Musnad of Ibn 'Abbas, and it is so. But in their versions it is not mentioned that Sa'd's mother owed "fasts"; rather their narration has that it was a "vow" (in general terms, without specification), as has been explained in the takhrij.
