Mustadrak al-Hakim — Hadith 499

حدَّثَناه علي بن حَمْشَاذَ العَدْل، أخبرنا عبيد بن عبد الواحد بن شَرِيك، حدثنا يحيى بن بُكَير، حدثني الليث، عن يزيد بن أبي حَبِيب، حدثني الجُلَاح أبو كَثير، أنَّ ابن سلمة المخزومي حدَّثه، أنَّ المغيرة بن أبي بُرْدة أخبره، أنه سمع أبا هريرة يقول: كنا عند رسول الله ﷺ يومًا فجاءه صيَّاد فقال: يا رسول الله، إنا ننطلقُ في البحر نريد الصيدَ فيَحمِلُ معه أحدُنا الإداوَةَ وهو يرجو أن يَأخُذَ الصيدَ قريبًا، فربما وَجَدَه كذلك، وربما لم يَجِدِ الصيدَ حتى يَبلُغَ من البحر مكانًا لم يَظُنَّ أن يَبلُغَه، فلعلَّه يَحتلِمُ أو يتوضَّأُ، فإن اغتسل أو توضَّأَ بهذا الماء فلعلَّ أحدَنا يُهلِكُه العطشُ، فهل ترى في ماء البحر أن نغتسل به أو نتوضأَ به إِذا خِفْنا ذلك؟ فَزَعَمَ أنَّ رسول الله ﷺ قال: "اغتسِلُوا منه وتوضؤوا به، فإنه الطَّهُورُ ماؤُه، الحِلُّ مَيْتتُه" (3). قد احتَجَّ مسلمٌ بالجُلَاح أبي كثير. وقد تابع يحيى بنُ سعيد الأنصاريُّ ويزيدُ بنُ محمد القرشي سعيدَ بنَ سلمة المخزوميَّ على رواية هذا الحديث. واختُلف عليه فيه (1):
It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him): One day we were sitting with the Messenger of Allah (peace and blessings be upon him) when a fisherman came and said: "O Messenger of Allah, we go out to sea for fishing, and one of us takes a water vessel with him, hoping to catch something soon. Sometimes he does find it so, and sometimes he does not find any catch until he reaches a place at sea he never thought he would reach. There he may have a wet dream or need to perform ablution. Now if he performs the ritual bath (ghusl) or ablution with this (drinking) water, he fears perishing from thirst. So in your view, may we take the ritual bath or perform ablution with sea water?" The Messenger of Allah (peace and blessings be upon him) said: "Take the ritual bath from it and perform ablution with it, for its water is pure and its dead (animals) are lawful."
Imam Muslim used al-Julah Abu Kathir as evidence.

(3) إسناده قوي. الليث: هو ابن سعد. ¤ ¤ وأخرجه أحمد 14/ (8912) عن قتيبة بن سعيد عن الليث، عن الجلاح، عن المغيرة بن أبي بردة، به مختصرًا. فسقط من الإسناد عنده يزيد بن أبي حبيب بين الليث والجلاح، وسعيد بن سلمة بين الجلاح والمغيرة.
Grading: Its chain is strong (qawi).
Technical note / Defect ('illah): "Al-Layth" in the chain refers to al-Layth bin Sa'd.
Reference / Source: Imam Ahmad recorded it in abridged form at 14/ (8912) through Qutaybah from al-Layth from al-Julah from al-Mughirah bin Abi Burdah, but in Imam Ahmad's chain the name "Yazid bin Abi Habib" between al-Layth and al-Julah, and "Sa'id bin Salamah" between al-Julah and al-Mughirah, have dropped out.

Technical note / Defect ('illah): The disagreement in this narration occurred over al-Mughirah bin Abi Burdah; for an exhaustive account of it see Imam al-Daraqutni's "al-'Ilal" 9/ 7 (1614). The most precise of them is the one narrated by Imam Malik, as has passed with the author (al-Hakim). None of the chains the author has mentioned here is free of criticism.
