Mustadrak al-Hakim — Hadith 4743

It is narrated from Abu Tihya that when they seized Ibn Muljam and brought him to Sayyiduna Ali (may Allah be pleased with him), he said: "Do with him what the Messenger of Allah (peace and blessings be upon him) did with the man who intended to kill him (peace and blessings be upon him); he (peace and blessings be upon him) ordered that he be killed and burned with fire."

Grading: Its chain is weak because of the weakness of 'Imran bin Zabyan and the poor memory (su' al-hifz) of Sharik. In this narration the two of them contradicted what is "well known" from 'Ali (may Allah be pleased with him) (as preceded, that: If I die, then kill him, and so on). And also because, regarding the man who was set up to kill the Messenger of Allah (peace and blessings be upon him), no one has mentioned that he (peace and blessings be upon him) ordered him to be burned. On this there are two mursal narrations which al-Tabari mentioned in "Tahdhib al-Athar" (3/ 71-72): the first from al-Hasan al-Basri, that he (peace and blessings be upon him) ordered him to be crucified, and the second from 'Urwah bin al-Zubayr, that the man accepted Islam and his Islam was good.
Preponderant view: The mursal of 'Urwah is "stronger and preferable" to the mursal of al-Hasan al-Basri, and the authors of the maghazi and sirah works confined themselves to the mursal of 'Urwah.
Identification of narrators: Sharik: he is Ibn 'Abd Allah al-Nakha'i. Abu Ahmad al-Zubayri: he is Muhammad bin 'Abd Allah bin al-Zubayr al-Asadi.
Reference / Source: Imam Ahmad recorded the narration of Abu Tihya from 'Ali in his "Musnad" (2/ 713) from Abu Ahmad al-Zubayri, with this chain.
Important point: Some narrations state that al-Hasan, al-Husayn, Ibn al-Hanafiyyah and 'Abd Allah bin Ja'far cut off the hands and feet of Ibn Muljam and burned him, (but the research shows that) "nothing whatsoever" of those narrations is established.
