Mustadrak al-Hakim — Hadith 4418

حدَّثنا دَعْلَج بن أحمد السِّجْزِي، حدَّثنا عبد العزيز بن معاوية، حدَّثنا محمد بن جَهْضَم، حدَّثنا إسماعيل بن جعفر، حدّثني عبد الرحمن بن الحارث، عن سُليمان بن موسى الأشْدَق، عن مكحُول، عن أبي سَلّام، عن أبي أمامة الباهلي صاحبِ رسول الله ﷺ، عن عُبادة بن الصامِت قال: أخذَ رسولُ الله ﷺ يومَ حُنين وَبَرَة من جَنْبِ بَعير، ثم قال: "يا أيُّها الناسُ، إنه لا يَحِلُّ لي مما أفاءَ اللهُ عليكم قَدرُ هذه إِلَّا الخُمسَ، والخُمْسُ مَردُودٌ عليكم، فأدُّوا الخَيطُ والمِخْيَطَ، وإياكُم والغُلولَ، فإنه عارٌ على أهلِه يومَ القيامة، وعليكُم بالجهاد في سبيل الله فإنه بابٌ من أبواب الجنة، يُذهِبُ اللهُ به الهَمَّ والغَمَّ". قال: وكان رسولُ الله ﷺ يكرهُ الأنفالَ، ويقول: "لِيرُدَّ قويُّ المؤمنين على ضَعِيفهم" (1)
It is narrated from Sayyiduna Ubadah bin al-Samit (may Allah be pleased with him) that on the day of Hunayn the Messenger of Allah (peace and blessings be upon him) took hold of a hair from the side of a camel, then said: "O people! Of the spoils of war that Allah has given you, not even as much as this hair is lawful for me except the fifth (khums), and that fifth too is returned to you (after its prescribed expenditures). So hand over (of the spoils) even the thread and the needle, and beware of embezzlement, for it will be a source of shame and disgrace for the one who embezzles on the Day of Resurrection. And hold fast to jihad in the path of Allah, for it is one of the gates of Paradise, through which Allah Almighty removes worry and grief." The narrator says: The Messenger of Allah (peace and blessings be upon him) disliked extra spoils (nafl), and he would say: "So that the strong among the believers return that wealth to their weak."

(1) صحيح لغيره دون ذكر كراهة النبي ﷺ الأنفال، وهذا إسناد حسن في المتابعات والشواهد من أجل عبد الرحمن بن الحارث. وهو ابن عبد الله بن عيّاش المخزومي - وقد اختُلف في إسناد هذا الخبر عن أبي سلام وهو ممطور الحبشي - فبعضهم يرويه عنه عن أبي أمامة عن عبادة كما في رواية المُصنِّف هنا، وبعضهم يرويه عنه عن المقدام الرَّهاوي وبعضهم يسميه خطأً المقدام بن معدي كرب - عن عبادة، وبعضهم يرويه عنه عن عمرو بن عَبَسة كما سيأتي عند المصنف برقم (6728)، وبعضهم يرويه عنه عن أبي إدريس الخولاني مرسلًا، ورجح البخاريّ هذه الرواية الأخيرة المرسلة في "تاريخه الكبير" بأنَّ راويها عن أبي سلّام أحفظ من عبد الرحمن بن الحارث. قلنا لكن أبا سلّام يروي عن أبي أمامة عن عبادة حديثًا طويلًا في قصة غنائم بدر وغنائم حنين كما تقدم بيانه برقم (2435)، وهذه القطعة هي جزء منه، واقتصر عليها أبو سلّام في روايته عن غير أبي أمامة، فدلَّ ذلك على أنَّ في حديثه عن أبي أمامة ما ليس في حديثه عن غيره، فلا يبعد صحة ذلك عن أبي سلّام، خصوصًا وأنَّ هذه الحادثة قد رآها كثير من الصحابة، فلا يُستنكر أن يكون أبو سلّام سمعها من جماعة منهم أو بواسطةٍ عن جماعة منهم لشهرتها، والله تعالى أعلم.
Grading: This hadith is "sahih li-ghayrihi" (sahih due to supporting reports), except for the part mentioning that the Prophet (peace and blessings be upon him) disliked the spoils (anfal).
Technical note / Defect ('illah): Because of Abd al-Rahman bin al-Harith bin Abd Allah bin Ayyash al-Makhzumi, this chain is hasan for the purpose of corroborating chains. There is disagreement among the routes of this narration from Abu Sallam Mamtur al-Habashi: (1) Abu Sallam from Abu Umamah from Ubadah (as here). (2) Abu Sallam from al-Miqdam al-Rahawi (whom some mistakenly called Ibn Ma'dikarib) from Ubadah. (3) Abu Sallam from Amr bin Abasah (as will come at number 6728). (4) Abu Sallam from Abu Idris al-Khawlani (mursal). Al-Bukhari preferred the mursal narration in "al-Tarikh al-Kabir" because its narrator has better memory.
Important point: Our finding is that Abu Sallam narrated from Abu Umamah the long hadith about (the spoils of) Badr and Hunayn (number 2435), and this piece is part of it; so it is not unlikely that Abu Sallam heard it from various Companions, since this event was very well known.
وأخرجه ضمن حديث مطول في ذكر غنائم يوم بدر ويوم حُنين ابن حبان (4855) من طريق محمد بن المثنَّى، عن محمد بن جهضم بهذا الإسناد.
Reference / Source: Ibn Hibban (4855) narrated it within the long hadith about the spoils of Badr and Hunayn, by way of Muhammad bin al-Muthanna, from Muhammad bin Jahdam, with this same chain.
وأخرجه سعيد بن منصور في قسم التفسير من "سننه" (983)، ومن طريقه البيهقيّ في "معرفة السنن" (13082) عن عبد الله بن جعفر، وابن أبي عاصم في الآحاد والمثاني" (1865)، وفي "الجهاد" (7)، والضياء في "المختارة" 8/ (362) من طريق المغيرة بن عبد الرحمن بن الحارث، والهيثم بن كليب الشاشي في "مسنده" (1176)، والطبراني في "مسند الشاميين" (3583)، والضياء المقدسي 8/ (361) من طريق عبد الرحمن بن أبي الزناد، وأبو طاهر المُخلِّص في "المخلصيات" (1528) و (1529) من طريق محمد بن فُليح بن سليمان، أربعتهم عن عبد الرحمن بن الحارث به ضمن الحديث المطوّل كذلك.
Reference / Source: Sa'id bin Mansur (983), al-Bayhaqi (13082), Ibn Abi Asim (1865 and "al-Jihad" 7), al-Diya' al-Maqdisi ("al-Mukhtarah" 8/ 362 and 8/ 361), al-Haytham bin Kulayb (1176), al-Tabarani (3583) and Abu Tahir al-Mukhallis narrated it through various routes (al-Mughirah bin Abd al-Rahman, Abd al-Rahman bin Abi al-Zinad, Muhammad bin Fulayh) via Abd al-Rahman bin al-Harith, as part of the long hadith.
وأخرجه أحمد 37 (22718) والنسائي (4424)، والبيهقي في "الكبرى" 6/ 303، وابن المنذر في "الأوسط" (6073)، وابن عبد البر في التمهيد 20/ 50 من طريق أبي إسحاق الفزاري، عن سفيان الثوري، وابن زنجويه في "الأموال" (1187) من طريق عبد العزيز بن محمد، وابن المنذر (6138)، والطحاوي في "شرح معاني الآثار" 3/ 241 من طريق عبد الرحمن بن أبي الزناد، أربعتهم عن عبد الرحمن بن الحارث، به مختصرًا بذكر الخُمس، وذكر الطحاوي وحده كراهة النبي ﷺ للأنفال وقوله: "ليردّ قوي المؤمنين على ضعيفهم".
Reference / Source: Ahmad (37/ 22718), al-Nasa'i (4424), al-Bayhaqi (6/ 303), Ibn al-Mundhir (6073, 6138), Ibn Abd al-Barr (20/ 50), Ibn Zanjawayh (1187) and al-Tahawi (3/ 241) narrated it from Abd al-Rahman bin al-Harith in abridged form, mentioning the "khumus" (one-fifth).
Details of the narration: Only al-Tahawi reported the dislike of the anfal and the words: "so that the strong among the believers return (wealth) to the weak".
وقد اختُلف في رواية أبي إسحاق الفزاري عن عبد الرحمن بن الحارث كما هو ظاهر، فبعض من روى هذا الخبر عنه ذكر بينه وبين عبد الرحمن رجلًا هو سفيان الثوري، وحصل نظير ذلك في قطعة أخرى من الحديث المطول تقدمت عند المصنف برقم (2435) فراجع الكلام عليها ثمة.
Technical note / Defect ('illah): There is disagreement in the narration of Abu Ishaq al-Fazari from Abd al-Rahman bin al-Harith; some mentioned Sufyan al-Thawri as an intermediary between them. A similar disagreement occurred in another piece of this long hadith, which has passed at number (2435).
وأخرجه أحمد 37/ (22699) من طريق أبي بكر بن عبد الله بن أبي مريم، عن أبي سلّام، عن المقدام بن معدي كرب: أنه جلس مع عبادة بن الصامت وأبي الدرداء والحارث بن معاوية فتذاكروا حديث رسول الله ﷺ. وأبو بكر ضعيف، وتقييد المقدام بابن معدي كرب خطأ لما سيأتي بيانه، وانظر تمام تخريجه من طريق ابن أبي مريم في "المسند".
Technical note / Defect ('illah): Ahmad (37/ 22699) narrated it by way of Abu Bakr bin Abd Allah bin Abi Maryam, in which the narrator's name is given as "al-Miqdam bin Ma'dikarib"; but Abu Bakr is weak, and calling al-Miqdam "Ibn Ma'dikarib" is a mistake (he is al-Miqdam al-Rahawi).
وأخرجه عبد الله بن أحمد في زياداته على "المسند" لأبيه 37/ (22777) من طريق سعيد بن يوسف، عن يحيى بن أبي كثير، عن أبي سلّام عن المقدام، عن عبادة وسعيد بن يوسف ضعيف، وقُيِّد المقدام هنا أيضًا بأنه ابن معدي كرب، وهو خطأ لما سيأتي بيانه.
Technical note / Defect ('illah): Abd Allah bin Ahmad narrated it in "Zawa'id al-Musnad" (37/ 22777) by way of Sa'id bin Yusuf, but Sa'id is weak, and here too calling al-Miqdam "Ibn Ma'dikarib" is a mistake.
وأخرجه كذلك يعقوب بن سفيان في "المعرفة والتاريخ" 2/ 359، والدولابي في "الكنى" (2061)، والشاشي (1263)، والبيهقي في "الكبرى" 9/ 103، وابن عساكر في "تاريخ دمشق" 26/ 176 من طريق منصور الخولاني، عن أبي يزيد غيلان بن أنس، عن أبي سلّام، عن المقدام بن معدي كرب، عن الحارث بن معاوية الكندي، عن عبادة. ومنصور الخولاني لم نتبينه وتقييد المقدام هنا كذلك بابن معدي كرب، وكذا ذكر الحارث بن معاوية خطأ، كما سيأتي بيانه.
Technical note / Defect ('illah): Ya'qub bin Sufyan, al-Dulabi, al-Shashi, al-Bayhaqi and Ibn Asakir narrated it by way of Mansur al-Khawlani, but we could not identify Mansur; and here too calling al-Miqdam Ibn Ma'dikarib and making al-Harith bin Mu'awiyah an intermediary is a mistake.
فقد أخرجه ابن أبي شيبة في "مسنده" كما في "إتحاف الخيرة" للبوصيري (1128)، والبزار (2713) و (4149)، والطحاوي في "شرح معاني الآثار" 1/ 385، والشاشي (1261) و (1262)، وأبو نُعيم في "معرفة الصحابة" (4107)، وابن عساكر في "تاريخ دمشق" 26/ 176 من طريق زياد المصفّر، عن الحسن البصري، عن مقدام الرُّهاوي، قال: جلس عبادة وأبو الدرداء والحارث ابن معاوية، فقال أبو الدرداء: أيكم يذكر يوم صلى رسول الله ﷺ إلى بعير من المغنم؟ فقال عبادة: أنا، قال: فحدث، قال … فذكره. ورجاله إلى المقدام الرُّهاوي ثقات عن آخرهم، فهذا أوثق الطرق التي ذكر فيها المقدام، وبه وبطريق ابن أبي مريم الذي تقدم تخريجه يتبيَّن أنَّ الحارث بن معاوية كان أحد الحاضرين في المجلس مع أبي الدرداء وعُبادة لا أنه حدَّث المقدام عن عبادة كما في رواية أبي يزيد غيلان والظاهر أنَّ أبا سلام هو مَن كان يُخطئ في اسم المقدام لتعدد الطرق إليه بذلك، والله أعلم. والمقدام الرُّهاوي يكون بذلك روى عنه أبو سلَّام والحسن البصري، وحضر مجلس أولئك الصحابة الثلاثة المذكورين، فهو تابعي كبير، فيحسَّن حديثُه إن شاء الله.
Reference / Source: Ibn Abi Shaybah narrated it in his "Musnad" (as in al-Busiri's "Ithaf al-Khiyarah" (1128)), al-Bazzar (2713) and (4149), al-Tahawi in "Sharh Ma'ani al-Athar" (1/ 385), al-Shashi (1261) and (1262), Abu Nu'aym in "Ma'rifat al-Sahabah" (4107) and Ibn Asakir in "Tarikh Dimashq" (26/ 176) by way of Ziyad al-Musaffar, from al-Hasan al-Basri, from al-Miqdam al-Rahawi.
Details of the narration: Al-Miqdam al-Rahawi relates that Ubadah bin al-Samit, Abu al-Darda' and al-Harith bin Mu'awiyah (may Allah be pleased with them) were sitting in a gathering, and Abu al-Darda' asked: "Which of you remembers the day when the Messenger of Allah (peace and blessings be upon him) led the prayer facing a camel from the spoils?" Ubadah said: "I remember." He said: "Then relate it." So he mentioned the whole hadith.
Technical note / Defect ('illah): All the narrators of this chain up to al-Miqdam al-Rahawi are fully "thiqah", and this is the strongest of all the routes narrated through al-Miqdam.
Important point: From this route and the earlier route of Ibn Abi Maryam it becomes clear that al-Harith bin Mu'awiyah was actually present in the gathering with Abu al-Darda' and Ubadah, not that he narrated this hadith to al-Miqdam from Ubadah (as was mistakenly given in the narration of Abu Yazid Ghaylan). Apparently it was Abu Sallam who erred in al-Miqdam's name, since the routes reaching him contain it in this way from many directions.
Grading: Both Abu Sallam and al-Hasan al-Basri narrated from al-Miqdam al-Rahawi, and he attended the gathering of the three Companions mentioned, so he is a senior Successor (tabi'i kabir), and his hadith is of "hasan" level, if Allah wills.
وأخرجه مسدَّد في "مسنده" كما في "إتحاف الخيرة" (1127)، وعنه البخاريّ في "تاريخه" 8/ 57 عن هشيم، قال: حدَّثنا داود بن عمرو، قال: حدَّثنا أبو سلّام عن أبي إدريس الخُولاني مرسلًا مختصرًا بذكر الخُمس. ورجَّح البخاريّ هذه الرواية على رواية عبد الرحمن بن الحارث.
Reference / Source: Musaddad in his "Musnad", and through him al-Bukhari in "al-Tarikh" (8/ 57), narrated it by way of Hushaym as mursal, mentioning the "khumus", and al-Bukhari preferred this version.
وسيأتي عند المصنف برقم (6728) من طريق عبد الله بن العلاء بن زَبْر، عن أبي سلّام، عن عمرو بن عَبَسَة.
Note / Clarification: This same narration will come at number (6728) by way of Abd Allah bin al-Ala', from Amr bin Abasah (may Allah be pleased with him).
وقد تقدَّم فضل الجهاد منه برقم (2435) من طريق أبي إسحاق الفزاري، عن عبد الرحمن بن عيّاش - وهو عبد الرحمن بن الحارث بن عبد الله بن عيّاش - عن سليمان بن موسى، عن مكحول، عن أبي أمامة، عن عبادة بإسقاط ذكر أبي سلّام، والصحيح ذكره.
Technical note / Defect ('illah): The part on the virtue of jihad has passed at number (2435), where the name of Abu Sallam had dropped out of the chain, whereas the correct version is that he is mentioned.
وأخرجه ابن ماجه (2850) من طريق أبي سنان عيسى بن سنان، عن يعلى بن شداد، عن عبادة بن الصامت مختصرًا بذكر الخمس والغلول وإسناده حسن في المتابعات والشواهد.
Grading: The narration of Ibn Majah (2850), mentioning "the khumus and ghulul (stealing from the spoils)", is hasan for the purpose of corroborating chains.
وفي باب ذكر الخمس والغلول عن عمرو بن شعيب، عن أبيه، عن جده عند أحمد 11/ (6729)، والنسائي (6482). وإسناده حسن. وهو عند أبي داود (2694) بذكر الخمس وحده.
Grading: This narration, with the chain Amr bin Shu'ayb from his father from his grandfather, is hasan in Ahmad (11/ 6729) and al-Nasa'i (6482), while in Abu Dawud (2694) only the khumus is mentioned.
وعن أم حبيبة بنت العرباض بن سارية عن أبيها عند أحمد 28/ (17154) وغيره.
Reference / Source: This narration is reported from al-Irbad bin Sariyah (may Allah be pleased with him) through his daughter Umm Habibah in Ahmad (28/ 17154).
وفي باب ذكر الخمس وحده عن جُبَير بن مطعم عند أبي عُبيد في "الأموال" (767)، وابن زنجويه في "الأموال" (1140)، والبزار (3418) و (3419)، وابن المنذر في "الأوسط" (6072)، وابن أبي حاتم في "تفسيره" 5/ 1703، وإسناده صحيح.
Grading: The chain of the narration about the "khumus" from Jubayr bin Mut'im (may Allah be pleased with him) is sahih; it is found in Abu Ubayd, Ibn Zanjawayh, al-Bazzar, Ibn al-Mundhir and Ibn Abi Hatim.
وفي باب فضل الجهاد وأنه من أبواب الجنة عن أبي موسى الأشعري عند مسلم (1902) وغيره، بلفظ: "أبواب الجنة تحت ظلال السيوف". وقد سلف عند المصنف برقم (2419).
Reference / Source: On the virtue of jihad, the narration of Abu Musa al-Ash'ari (may Allah be pleased with him) is in Sahih Muslim (1902) with these words: "The gates of Paradise are beneath the shade of swords", and it has passed at number (2419).
وعن عبد الله بن أبي أوفى عند البخاريّ (2818) ومسلم (1742) وغيرهما، بلفظ: "الجنة تحت ظلال السيوف". وقد سلف أيضًا برقم (2444). وعن أبي هريرة عند أحمد 13/ (7633)، والبخاري (1897)، بلفظ: "من كان من أهل الجهاد دعي من باب الجهاد".
Reference / Source: From Abd Allah bin Abi Awfa (may Allah be pleased with him) it is narrated in al-Bukhari (2818) and Muslim (1742) with the words "Paradise is beneath the shade of swords" (number 2444). Also, from Abu Hurayrah (may Allah be pleased with him) it is narrated in Ahmad (13/ 7633) and al-Bukhari (1897) that "Whoever is among the people of jihad will be called from the gate of jihad".
