وحدَّثَناه أبو علي الحافظ، حدثنا عبد الله بن محمود، حدثنا أحمد بن عبد الله بن الحَكَم، حدثنا وَكيع، عن ابن أبي ذِئْب، عن عطاء ومحمد بن المنكدِر، عن جابر بن عبد الله قال: قال رسول الله ﷺ: "لا طلاقَ قبل نِكاحٍ" (2). قال الحاكم: مدارُ سند هذا الحديث على إسنادَين واهيَين: جُوَيبر (1) عن الضحَّاك عن النَّزَّال بن سَبْرة عن علي، وعمرو بن شعيب عن أبيه عن جدِّه، فلذلك لم يَقَعِ الاستقصاءُ من الشيخين في طلب هذه الأسانيد الصحيحة، والله أعلم.
It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "There is no divorce before marriage."
Imam al-Hakim says that the chains of this hadith revolve around two extremely weak chains (those of Juwaybir and of Amr bin Shu'ayb); that is why the two Shaykhs (Bukhari and Muslim) did not search deeply for these authentic chains. And Allah knows best.

(2) إسناده ضعيف لانقطاعه واضطرابه، وقد سلف بيان الانقطاع فيه بين عطاء بن أبي رباح وجابر برقم (2855)، وقد أشار البزار بإثر الحديث (1499 - كشف الأستار) إلى أنَّ بعض الرواة رواه عن ابن أبي ذئب عمَّن حدَّثه عن محمد بن المنكدر وعطاء؛ فوقع فيه على هذا انقطاع أيضًا بين ابن المنكدر وجابر، على أنَّ حديث ابن المنكدر فيه اضطراب أيضًا كما سبق بيانه عند الحديثين السابقين. Grading: Its chain is da'if because it is broken (munqati') and inconsistent (mudtarib). The break between Ata' bin Abi Rabah and Jabir has been explained at number (2855). Technical note / Defect ('illah): Al-Bazzar indicated after the hadith (1499, Kashf al-Astar) that some narrators narrated it from Ibn Abi Dhi'b, from someone who narrated to him from Muhammad bin al-Munkadir and Ata'; on this basis there is also a break between Ibn al-Munkadir and Jabir. Moreover, the hadith of Ibn al-Munkadir is itself inconsistent (mudtarib), as has been explained under the two previous hadiths. وأخرجه ابن أبي شيبة 5/ 16، ومن طريقه البيهقي 7/ 319، وأخرجه البزار (1499) عن يوسف بن موسى، كلاهما (ابن أبي شيبة ويوسف) عن وكيع، بهذا الإسناد. Reference / Source: Ibn Abi Shaybah (5/ 16) recorded it (and via him al-Bayhaqi 7/ 319), and al-Bazzar (1499) from Yusuf bin Musa; both of them (Ibn Abi Shaybah and Yusuf) from Waki', with this same chain. وأخرجه حرب الكرماني في "مسائله" 1/ 387 عن إسحاق بن راهويه، عن وكيع، به - ولم يذكر فيه محمدَ بن المنكدر. Reference / Source: Harb al-Kirmani recorded it in his "Masa'il" (1/ 387) from Ishaq bin Rahawayh, from Waki', with this same chain, but did not mention "Muhammad bin al-Munkadir" in it.
(1) جويبر هذا: هو ابن سعيد الأزدي متروك الحديث، وحديثه هذا عند ابن ماجه برقم (2049)، وانظر تتمة تخريجه هناك، والراجح فيه أنه عن عليٍّ موقوف. Grading: This Juwaybir is "Ibn Sa'id al-Azdi", who is matruk al-hadith. This hadith of his is in Ibn Majah (2049); see its full sourcing there. Important point: The preferred view is that it is mawquf on Ali (may Allah be pleased with him). وأما حديث عمرو بن شعيب فقد سلف أن خرَّجه المصنف برقم (2856)، وهو حديث مشهور عن عمرو بن شعيب، وهو أحسن شيء مرفوع في الباب، والعجب من المصنف هنا كيف وهّاه وهو قد صحَّح لعمرو بن شعيب عن أبيه عن جده في غير موضع من كتابه هذا، فهذا يدلُّ على أنه قد اضطرب فيه. Important point: The hadith of Amr bin Shu'ayb has passed; the author recorded it at number (2856). It is a well-known hadith from Amr bin Shu'ayb and it is the best marfu' report on this topic. It is surprising that the author (al-Hakim) declared it weak here, when he has authenticated Amr bin Shu'ayb from his father from his grandfather in more than one place in this very book; this shows that he was inconsistent about it.
