(1) ما بين المعقوفين مكانه بياض في النسخ الخطية، واستدركناه من "السنن الكبرى" للبيهقي 7/ 333 حيث رواه عن المصنف بإسناده ومتنه.
Note / Clarification: In place of what is between the square brackets there is a blank space in the manuscripts, and we have supplied it from al-Bayhaqi's "al-Sunan al-Kubra" 7/333, where he narrated it from the author (al-Hakim) with his chain and text.
وأما الخبر فالصحيح أنه مُرسَل، فقد خولف يعلى بن شبيب -وقد انفرد ابن حبان بتوثيقه- في وصله بذِكْر عائشة كما سيأتي، ويعقوب بن حميد قال الذهبي في "تلخيصه": قد ضعَّفه غير واحدٍ قلنا: لكنه متابَع في روايته هذه عن يعلى.
Grading: As for the report, what is correct is that it is "mursal";
Technical note / Defect ('illah): for Ya'la bin Shabib (whom Ibn Hibban alone declared trustworthy) was contradicted in narrating it as connected by mentioning 'A'ishah (may Allah be pleased with her), as will come. As for Ya'qub bin Humayd, al-Dhahabi said in his "Talkhis": more than one scholar declared him weak. We say: but he is corroborated in this narration of his from Ya'la.
فقد أخرجه الترمذي (1192) عن قتيبة بن سعيد، عن يعلى بن شبيب بهذا الإسناد.
Reference / Source: Thus al-Tirmidhi recorded it (1192) from Qutaybah bin Sa'id, from Ya'la bin Shabib, with this same chain.
ثم أخرجه عن أبي كريب، عن عبد الله بن إدريس، عن هشام بن عروة، عن أبيه بنحوه، ولم يذكر فيه عائشةَ، وقال: وهذا أصحُّ من حديث يعلى بن شبيب.
Reference / Source: Then he recorded it from Abu Kurayb, from Abd Allah bin Idris, from Hisham bin 'Urwah, from his father, with similar wording, without mentioning 'A'ishah in it, and he said: This is more correct than the hadith of Ya'la bin Shabib.
وتابع عبدَ الله بنَ إدريس على إرساله مالك في "الموطأ" 2/ 588، وعنه الشافعي في "الأم" 6/ 616 - 617، ومن طريقه البيهقي في "السنن" 7/ 333، ثم قال البيهقي: هذا مرسل، وهو الصحيح، قاله البخاري وغيره.
Corroborating chains and supporting reports: Abd Allah bin Idris was corroborated in narrating it as mursal by Malik in "al-Muwatta'" 2/588, and from him al-Shafi'i in "al-Umm" 6/616-617, and via him al-Bayhaqi in "al-Sunan" 7/333. Then al-Bayhaqi said: This is mursal, and it is the correct view; al-Bukhari and others said so.
(2) ما بين المعقوفين من المطبوع.
Note / Clarification: What is between the square brackets is taken from the printed edition.
(3) وأعاد المصنف الكلام في ذلك بإثر الحديث (4950)، وذلك أنَّ البخاري روى في موضعين من "صحيحه" (2697) و (3988) عن يعقوب (هكذا غير مقيَّد في روايات البخاري) عن إبراهيم بن سعد.
Note / Clarification: The author (al-Hakim) repeated the discussion of this after hadith (4950). That is because al-Bukhari narrated in two places of his "Sahih", (2697) and (3988), from Ya'qub (left unspecified like this in the narrations of al-Bukhari), from Ibrahim bin Sa'd.
فقُيِّد يعقوبُ في الموضعين في رواية ابن السَّكَن لصحيح البخاري بابن محمد، يعني يعقوب بن محمد الزهري، لكنه قُيِّد في رواية الأصيلي وأبي ذر الهروي بابن إبراهيم، يعني يعقوب بن إبراهيم الدَّورَقي، كما وقع في رواية أبي ذر في الموضع الثاني، حيث قال: يعقوب بن إبراهيم، أي: الدورقي.
Technical note / Defect ('illah): In both places, in Ibn al-Sakan's transmission of Sahih al-Bukhari, Ya'qub is specified as "Ibn Muhammad", i.e. Ya'qub bin Muhammad al-Zuhri; but in the transmission of al-Asili and Abu Dharr al-Harawi he is specified as "Ibn Ibrahim", i.e. Ya'qub bin Ibrahim al-Dawraqi, as occurs in Abu Dharr's transmission in the second place, where he said: Ya'qub bin Ibrahim, meaning al-Dawraqi.
وجوَّز أبو مسعود الدمشقي فيما نقله عنه أبو علي الجيّاني في "تقييد المهمل" 3/ 1064، وابن حجر في "هُدى الساري" 2/ 44، وفي فتح الباري" 8/ 395 أن يكون يعقوب بن إبراهيم في رواية الأصيلي وأبي ذرٍّ هو يعقوب بن إبراهيم بن سعد، وخطّأ ذلك المزي في "تهذيب الكمال" 32/ 321، والذهبي في "تاريخ الإسلام" 5/ 1290، وفي "سير أعلام النبلاء" 11/ 161، والحافظ ابن حجر في "هُدى الساري" 2/ 478 وفي "فتح الباري" 8/ 395، وغيرهم، وذلك لكون البخاري لم يلقَ يعقوبَ بن إبراهيم بن سعد.
Technical note / Defect ('illah): Abu Mas'ud al-Dimashqi (as Abu 'Ali al-Jayyani reported from him in "Taqyid al-Muhmal" 3/1064, and Ibn Hajar in "Hady al-Sari" 2/44 and "Fath al-Bari" 8/395) allowed that Ya'qub bin Ibrahim in the transmission of al-Asili and Abu Dharr might be Ya'qub bin Ibrahim bin Sa'd. This was declared a mistake by al-Mizzi in "Tahdhib al-Kamal" 32/321, al-Dhahabi in "Tarikh al-Islam" 5/1290 and "Siyar A'lam al-Nubala'" 11/161, al-Hafiz Ibn Hajar in "Hady al-Sari" 2/478 and "Fath al-Bari" 8/395, and others, because al-Bukhari did not meet Ya'qub bin Ibrahim bin Sa'd.
وجزم أبو علي الصَّدَفي فيما نقله عنه الحافظ في "الفتح" بأنه الدورقي، يعني كما قال أبو ذر الهروي في الموضع الثاني، واحتمله الذهبيُّ في "السير" 11/ 161، ورجَّحه ابن حجر في "هدي الساري" 2/ 479 وفي "الفتح" 8/ 395.
Technical note / Defect ('illah): Abu 'Ali al-Sadafi (as al-Hafiz reported from him in "al-Fath") stated firmly that he is al-Dawraqi (i.e. as Abu Dharr al-Harawi said in the second place); al-Dhahabi considered it possible in "al-Siyar" 11/161, and Ibn Hajar preferred it in "Hady al-Sari" 2/479 and "al-Fath" 8/395.
وجزم بخلاف ذلك كله أبو نصر الكَلَاباذي في "رجال البخاري" ترجمة (1392)، وأبو الوليد الباجي في "التعديل والتجريح" الترجمة (1533)، حيث جزما بأنه يعقوب بن حميد بن كاسب، وجزم به كذلك أبو أحمد الحاكم كما نقله عنه المصنف، وجزم به أيضًا الذهبي في "الكاشف" (6387) وفي "تذكرة الحفاظ" 2/ 466، ورجَّحه في "سير أعلام النبلاء" 11/ 160 - 161، واحتمله المزي في "تهذيب الكمال". ونقل الحافظ في "هدى الساري" 2/ 44 و 478 وفي "فتح الباري" 8/ 95 و 12/ 65 أنه أيضًا قول أبي عبد الله بن منده وأبي إسحاق الحبّال. وقال الحافظ بعد ذلك 8/ 395: ردَّ ذلك البرقاني بأنَّ يعقوب بن حميد ليس من شرط البخاري، وأيد في "الفتح" 12/ 65 قول البرقاني هذا فقال بعد أن نقل قول أبي أحمد الحاكم وابن منده والحبّال: هو متعقَّبٌ بما في رواية الأصيلي وأبي ذرٍّ.
Technical note / Defect ('illah): Contrary to all of that, Abu Nasr al-Kalabadhi in "Rijal al-Bukhari" (biography 1392) and Abu al-Walid al-Baji in "al-Ta'dil wa al-Tajrih" (biography 1533) stated firmly that he is Ya'qub bin Humayd bin Kasib. Abu Ahmad al-Hakim also stated this firmly (as the author reported from him), and al-Dhahabi likewise stated it firmly in "al-Kashif" (6387) and "Tadhkirat al-Huffaz" 2/466, preferred it in "Siyar A'lam al-Nubala'" 11/160-161, and al-Mizzi considered it possible in "Tahdhib al-Kamal". Al-Hafiz reported in "Hady al-Sari" 2/44 and 478 and in "Fath al-Bari" 8/95 and 12/65 that it is also the view of Abu Abd Allah bin Mandah and Abu Ishaq al-Habbal. After that al-Hafiz said (8/395): Al-Barqani rejected this on the grounds that Ya'qub bin Humayd does not meet al-Bukhari's criteria. And in "al-Fath" 12/65 he supported this statement of al-Barqani, saying, after quoting the view of Abu Ahmad al-Hakim, Ibn Mandah and al-Habbal: It is open to objection from what is in the transmission of al-Asili and Abu Dharr.
وأما أبو علي الجياني فكأنه مال في "تقييد المهمل" إلى القول بأنه يعقوب بن محمد الزهري، يعني كما قُيِّد في رواية ابن السكن، وكما جزم به أبو عبد الله الحاكم، إذ ختم الجياني الخلاف في ذلك بقوله: وقال البخاري في "تاريخه": يعقوب بن محمد بن عيسي بن عبد الملك بن حميد بن عبد الرحمن بن عوف أبو يوسف الزهري، سمع إبراهيم بن سعد والمَخْرَمي.
Technical note / Defect ('illah): As for Abu 'Ali al-Jayyani, he seems in "Taqyid al-Muhmal" to lean towards the view that he is Ya'qub bin Muhammad al-Zuhri (i.e. as specified in Ibn al-Sakan's transmission, and as Abu Abd Allah al-Hakim stated firmly), since al-Jayyani closed the disagreement with his statement: "Al-Bukhari said in his 'Tarikh': Ya'qub bin Muhammad bin 'Isa bin Abd al-Malik bin Humayd bin Abd al-Rahman bin 'Awf, Abu Yusuf al-Zuhri; he heard from Ibrahim bin Sa'd and al-Makhrami."
