Mustadrak al-Hakim — Hadith 3117

أخبرنا أبو محمد جعفر بن محمد بن نُصَير الخُلْدي، حدثنا علي بن عبد العزيز، حدثنا حجَّاج بن مِنهال، حدثنا حمَّاد بن سَلَمة، حدثنا عمرو بن دينار، عن جابر بن زيد، عن ابن عبَّاس: ﴿فَمَنْ عُفِيَ لَهُ مِنْ أَخِيهِ شَيْءٌ﴾ [البقرة: 178]، قال: هو: العَمْد يَرضَى أهلُه (1).
هذا حديث صحيح على شرط مسلم ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) concerning this saying of Allah Almighty, "But whoever is pardoned something by his brother" [Surah al-Baqarah: 178], that he said: This refers to deliberate murder, that is, killing done intentionally, in which the family of the slain person agree to the blood money.
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

Grading: Its chain is sahih.
وأخرجه الطبري في "تفسيره" 2/ 107 عن المثنى بن إبراهيم، عن حجاج بن المنهال، بهذا الإسناد - وفيه: يرضى أهله بالدية.
Reference / Source: Al-Tabari recorded it in his "Tafsir" 2/ 107 from al-Muthanna bin Ibrahim, from Hajjaj bin al-Minhal, with this same chain - and in it: "his family agree to accept the blood-money (diyah)".
وكذلك أخرجه البيهقي 8/ 52 من طريق أبي عامر العقدي، عن حماد بن سلمة، به.
Reference / Source: Likewise al-Bayhaqi recorded it in 8/ 52 via the route of Abu Amir al-Aqadi, from Hammad bin Salamah, with this same chain.
وبنحوه أخرجه البخاري (4498) و (6881)، والنسائي (6957) و (10947)، وابن حبان (6010) من طريق مجاهد، عن ابن عبَّاس.
Reference / Source: Something similar was recorded by al-Bukhari in (4498) and (6881), al-Nasa'i in (6957) and (10947), and Ibn Hibban in (6010), via the route of Mujahid, from Ibn Abbas.
