(1) رجاله لا بأس بهم، لكن اختُلف فيه على يونس بن أبي إسحاق، وهو السَّبيعي - فرواه أبو بكر الحنفي - واسمه عبد الكبير بن عبد المجيد - كما هنا، عن يونس، عن أبيه، عن عبد الله بن وهب - وغيره يقول: ابن موهب - عن تَميم الداري، وخالف أبا بكر الحنفي عبيدُ بنُ عُقيل البصري، فرواه عن يونس بن أبي إسحاق، عن عبد العزيز بن عمر بن عبد العزيز، عن عبد الله بن موهب، وهذا أولى بالصواب كما قال النسائي بإثر (6379)، وذكر الدارقطني في "الغرائب والأفراد" كما في "أطرافه" للمقدسي (1525) أنَّ هذا غريب من حديث أبي إسحاق السَّبيعي. فالمحفوظ أنَّ الحديث لعبد العزيز بن عمر كما قال المزي في "التهذيب" 16/ 288.
Grading of the chain: There is no problem with its narrators (la ba's bihim), but there is disagreement among those narrating from Yunus bin Abi Ishaq (al-Sabi'i): (1) The narration of Abu Bakr al-Hanafi (name: Abd al-Kabir bin Abd al-Majid): he narrated it from Yunus, from his father (Abu Ishaq), from Abd Allah bin Wahb (others said Ibn Mawhab), from Tamim al-Dari, as here. (2) Contradiction: Abu Bakr al-Hanafi was contradicted by "'Ubayd bin 'Aqil al-Basri", who narrated it from Yunus bin Abi Ishaq, from "Abd al-Aziz bin Umar bin Abd al-Aziz", from "Abd Allah bin Mawhab".
Preferred view: The narration of 'Ubayd bin 'Aqil is more correct (awla bi-l-sawab), as Imam al-Nasa'i said after hadith (6379). Al-Daraqutni mentioned in "al-Ghara'ib wa al-Afrad" (as cited in the Atraf of al-Maqdisi, 1525) that this is "gharib" as a hadith of Abu Ishaq al-Sabi'i. Therefore what is "preserved" (mahfuz) is that this is the hadith of Abd al-Aziz bin Umar, as al-Mizzi said in "al-Tahdhib" (16/ 288).
ثم إنه اختُلف في هذا الحديث أيضًا عن ابن موهب فرواه سائر أصحاب عبد العزيز بن عمر عنه عن تَميم كما وقع هنا، وجماعة منهم يذكرون تصريح ابن موهب بسماعه من تَميم الداري، منهم وكيع وأبو نعيم الفضل بن دكين.
Technical note / Further disagreement: Then there is also disagreement in transmitting this hadith from "Ibn Mawhab": (1) Most of the students of Abd al-Aziz bin Umar narrated it as "from Ibn Mawhab, from Tamim" (as here). (2) A group of them also mentioned the explicit statement of Ibn Mawhab's "hearing" from Tamim al-Dari, among them Waki' and Abu Nu'aym al-Fadl bin Dukayn.
وخالفهم يحيى بن حمزة الحضرمي كما في الطريق التالية عند المصنف، فذكر بين ابن موهب وبين تَميم رجلًا هو قبيصة بن ذؤيب. ¤ ¤ واختلف أهل العلم في تصحيح الحديث: فصحَّحه أبو حاتم الرازي كما في "العلل" لابنه (1642) نظرًا لتصحيح سماع ابن موهب من تَميم كما في رواية أبي نعيم، حيث صرّح بسماعه منه.
Contradiction: All of them were contradicted by "Yahya bin Hamzah al-Hadrami" (as in the next chain in the author's work), who mentioned another man, "Qabisah bin Dhu'ayb", between Ibn Mawhab and Tamim.
Disagreement among the imams (authentication): The scholars differed over the authentication of this hadith: (1) Abu Hatim al-Razi: he declared it sahih ("al-'Ilal" by his son, 1642), because in the narration of Abu Nu'aym Ibn Mawhab's hearing from Tamim is explicitly stated, which establishes the hearing.
وصحَّحه آخرون بذكر قبيصة بن ذؤيب لكون الواسطة قد عُلمت، وأنه ثقة وأدرك تَميمًا، ومنهم أبو زرعة الدمشقي ويعقوب بن سفيان وابن التركماني وابن القيم.
Grading: Others (researchers) declared it "sahih" with the mention of Qabisah bin Dhu'ayb;
Technical note / Defect ('illah): because the intermediary (in the chain) has become known, and he is trustworthy and lived in the time of Tamim (al-Dari, may Allah be pleased with him).
Reference / Source: Among those (who declared it sahih) are Abu Zur'ah al-Dimashqi, Ya'qub bin Sufyan, Ibn al-Turkumani and Ibn al-Qayyim.
وضعَّف هذا الحديثَ آخرون بانقطاعه بين ابن موهب وبين تَميم وأنه لا يصح ذكر قبيصة فيه لتفرده بذلك، منهم الشافعي والترمذي وابن المنذر والبيهقي وعبد الحق الإشبيلي، وضعفه البخاري لمعارضته حديث "الولاء لمن أعتق" (المخرّج في "الصحيحين" من حديث عائشة).
Weakening (declaring it weak): Other hadith scholars declared it weak: (1) Because of a break in the chain: they say there is a break between Ibn Mawhab and Tamim, and the mention of Qabisah is not correct because Yahya bin Hamzah is alone in it. Among them are Imam al-Shafi'i, al-Tirmidhi, Ibn al-Mundhir, al-Bayhaqi and Abd al-Haqq al-Ishbili. (2) A defect in the text: Imam al-Bukhari called it weak because this hadith conflicts with the hadith "al-wala' li-man a'taq" (wala' belongs to the one who frees) (which is narrated from Aishah in the two Sahihs).
واختلف فيه قول أحمد، فمرة يقول فيه: لا أعلم إلّا أنَّ ابن موهب لقي تَميمًا، كما في "العلل" برواية ابنه عبد الله (2901). وسأله ابنه صالح أيضًا عن هذا الحديث وأن فيه مخالفة لحديث "الولاء لمن أعتق"، فقال له أحمد: لهذا وجه ولهذا وجه. قلنا: ونحو هذا قول الشافعي في "الأم" 5/ 163 - 164.
Position of Imam Ahmad: Imam Ahmad's statements on this differed: (1) Once he said: "As far as I know, Ibn Mawhab did meet Tamim." (al-'Ilal, narration of Abd Allah, 2901). (2) When his son Salih asked him about this hadith and its contradicting the hadith "al-wala' li-man a'taq", he said: "This has an explanation, and that has an explanation."
Note: We say: Imam al-Shafi'i adopted a similar view in "al-Umm" (5/ 163-164).
وضعَّف أحمد الحديث في أحيان أخرى لمعارضته لحديث "الولاء لمن أعتق"، وقد بَسَطَ ذلك في روايات عنه أبو بكر الخلّال في "أحكام أهل الملل والردة" (954 - 965).
Weakening: At other times Imam Ahmad declared this hadith weak because it conflicts with the hadith "al-wala' li-man a'taq" (wala' belongs to the one who frees).
Reference: Abu Bakr al-Khallal set this out in detail in the narrations from Imam Ahmad in "Ahkam Ahl al-Milal wa al-Riddah" (954 - 965).
وأعلَّه الشافعي أيضًا وابن القطان بجهالة ابن موهب.
Defect ('illah): Imam al-Shafi'i and Ibn al-Qattan also found a defect in it on the grounds that "Ibn Mawhab" is "majhul" (unknown).
وأخرجه النسائي (6378) عن محمد بن المثنى، عن أبي بكر الحنفي، بهذا الإسناد.
Reference / Source: Al-Nasa'i (6378) narrated it through Muhammad bin al-Muthanna, from Abu Bakr al-Hanafi, with this same chain.
وأخرجه أيضًا (6379) من طريق عبيد بن عقيل، عن يونس بن أبي إسحاق، عن عبد العزيز بن عمر بن عبد العزيز عن عبد الله بن موهب، به. وقال بإثره: هذا حديث أولى بالصواب من الذي قبله.
Reference / Source: Al-Nasa'i narrated it (6379) by way of 'Ubayd bin 'Aqil, from Yunus bin Abi Ishaq, from Abd al-Aziz bin Umar bin Abd al-Aziz, from Abd Allah bin Mawhab.
Al-Nasa'i's verdict: After the hadith he said: This hadith is "more correct" (awla bi-l-sawab) than the one before it.
وكذلك أخرجه أحمد 28/ (16944) عن إسحاق بن يوسف الأزرق، وأحمد (16948)، وابن ماجه (2752)، والترمذي (2112) من طريق وكيع بن الجراح، والترمذي (2112) من طريق أبي أسامة وابن نمير، والنسائي (6380) من طريق عبد الله بن داود الخُريبي، خمستهم عن عبد العزيز بن عمر بن عبد العزيز، عن عبد الله بن موهب، عن تَميم. وصرَّح وكيع في روايته بسماع ابن موهب من تَميم، وتابعه أبو نُعيم الفضل بن دكين عند الدارمي (3076) وغيره، وكان أبو نعيم يقول: أنا سمعت عبد العزيز بن عمر يذكر عن عبد الله بن موهب، قال: سمعت تَميمًا الداري، نقله عنه أبو زرعة الدمشقي في "تاريخه" 1/ 569.
References: Ahmad (28/ 16944) narrated it from Ishaq bin Yusuf al-Azraq; Ahmad (16948), Ibn Majah (2752) and al-Tirmidhi (2112) by way of Waki' bin al-Jarrah; al-Tirmidhi (2112) by way of Abu Usamah and Ibn Numayr; and al-Nasa'i (6380) by way of Abd Allah bin Dawud al-Khuraybi. All five of these narrators narrate it from Abd al-Aziz bin Umar bin Abd al-Aziz, from Abd Allah bin Mawhab, from Tamim.
Explicit statement of hearing: In his narration Waki' explicitly stated Ibn Mawhab's "hearing" from Tamim.
Corroboration: And Abu Nu'aym al-Fadl bin Dukayn corroborated him in "al-Darimi" (3076) and elsewhere. Abu Nu'aym used to say: I heard Abd al-Aziz bin Umar mention from Abd Allah bin Mawhab, who said: I heard Tamim al-Dari. (Abu Zur'ah al-Dimashqi transmitted this statement in his Tarikh, 1/ 569.)
وقد بيَّن الشافعيُّ في "الأم" 5/ 164 وجه هذا الحديث، فقال: أقول: إنَّ قول رسول الله ﷺ: "إنما الولاء لمن أعتق"، ونهيه عن بيع الولاء وعن هبته، وقوله: "الولاء لُحمة كلُحمة النسب ¤ ¤ لا يُباع ولا يُوهب" فيمن أعتق، لأنَّ العتق نسب والنسب لا يُحوّل، والذي يُسلم على يدي الرجل ليس هو المنهي أن يُحوّل ولاؤه.
Al-Shafi'i's interpretation: Imam al-Shafi'i, explaining this hadith in "al-Umm" (5/ 164), said: I say that the saying of the Messenger of Allah (peace and blessings be upon him), "Wala' belongs only to the one who frees", his (peace and blessings be upon him) forbidding the sale and gifting of wala', and his saying, "Wala' is a bond like the bond of lineage; it cannot be sold or given away", all concern the one who frees. For freeing is a lineage, and lineage cannot be transferred. As for a person who accepts Islam at the hands of someone, he is not included in this prohibition that his wala' cannot be transferred.
(1) كذا جزم المصنف بأنَّ هذا عبد الله بن وهب بن زمعة! وهو قول لم يتقدمْه أحدٌ إليه، ولم يتابعه عليه أحدٌ، وإنما هو عبد الله بن موهب الفِلَسطيني، وقد اغتر المصنف بما ورد في إسناديه للحديث هنا، وفي نسبته في ثاني الإسنادين قرشيًا، فجزم بذلك، وهو خطأ لما سيأتي بيانه.
Correcting an error: The author (al-Hakim) has stated here firmly that this narrator is "Abd Allah bin Wahb bin Zam'ah"! This is a view that no one before him held, and no one agreed with him on it. In reality, he is "Abd Allah bin Mawhab al-Filastini". The author was misled by the two chains of the hadith here and by the attribution "al-Qurashi" in the second chain, and so he stated it firmly, although it is a mistake, as will be explained later.
