(1) إسناده محتمل للتحسين من أجل نبهان مكاتب أم سلمة، فقد روى عنه الزُّهْري ومحمد بن عبد الرحمن مولى أبا طلحة وذكره ابن حبان في "الثقات"، ووثقه الذهبي في "الكاشف"، وقال الحافظ ابن حجر في "الفتح" 15/ 668 - 669 وهو يتحدث عن حديث نبهان الآخر عن أم سلمة في حديث: "أفعمياوان أنتما": إسناده قوي، وأكثر ما عُلِّل به انفرادُ الزُّهْري بالرواية عن نبهان، وليست بعلة قادحة، فإنَّ من يعرفُه الزُّهْري، ويصفُه بأنه مُكاتَب أم سلمة، ولم يجرحه أحدٌ، لا تُرَدُّ روايته.
Grading of the chain: Because of "Nabhan", the mukatab of Umm Salamah, the chain has the potential to be graded "hasan".
Narrator assessment (Nabhan): Imam al-Zuhri and Muhammad bin Abd al-Rahman (the mawla of the family of Abu Talhah) narrated from him. (1) Ibn Hibban mentioned him in "al-Thiqat". (2) Imam al-Dhahabi declared him trustworthy in "al-Kashif". (3) Al-Hafiz Ibn Hajar, discussing Nabhan's other hadith from Umm Salamah ("Are you two blind?") in "al-Fath" (15/ 668-669), said: "Its chain is strong."
Answering the objection: The main defect (objection) raised against this narration is that Imam al-Zuhri is "alone" in narrating from Nabhan, but this is not a "damaging defect" ('illah qadihah). For one whom an imam like al-Zuhri knows and introduces as "the mukatab of Umm Salamah", and whom no one has criticized, his narration is not rejected.
وأخرجه أحمد 44/ (26629) عن عبد الرزاق، به. دون ذكر القصة.
Reference / Source: Imam Ahmad narrated it (44/ 26629) through Abd al-Razzaq, but did not mention the story.
وأخرجه أحمد (26656) عن محمد بن جعفر، والنسائي (5012) من طريق عبد الأعلى بن عبد الأعلى السامي، كلاهما عن معمر، به. دون ذكر القصة أيضًا.
Reference / Source: Imam Ahmad (26656) narrated it from Muhammad bin Ja'far, and al-Nasa'i (5012) by way of Abd al-A'la bin Abd al-A'la al-Sami, both of them through Ma'mar; they too did not mention the story.
وأخرجه أحمد (26473)، وأبو داود (3928)، وابن ماجه (2520)، والترمذي (1261)، والنسائي (9184) من طريق سفيان بن عيينة، والنسائي (5013) من طريق محمد بن أبي عتيق وموسى بن عقبة، و (5014) من طريق محمد بن إسحاق، و (5015) و (5016) و (9183) من طريق صالح بن كيسان، وابن حبان (4322) من طريق يونس بن يزيد الأيلي، كلهم عن الزُّهْري، به. لم يذكر أحد منهم القصة سوى يونس بن يزيد، فذكرها بأتم وأوضح ممّا هنا. وقال الترمذي: حديث حسن صحيح.
Reference / Source: Ahmad (26473), Abu Dawud (3928), Ibn Majah (2520), al-Tirmidhi (1261) and al-Nasa'i (9184) narrated it by way of Sufyan bin 'Uyaynah; al-Nasa'i also (5013) by way of Muhammad bin Abi 'Atiq and Musa bin 'Uqbah, (5014) by way of Muhammad bin Ishaq, and (5015, 5016, 9183) by way of Salih bin Kaysan; and Ibn Hibban (4322) by way of Yunus bin Yazid al-Ayli. All of them narrate it from Imam al-Zuhri.
Singular narration: None of them mentioned "the story" except "Yunus bin Yazid", who related it more completely and clearly than the narration here.
Al-Tirmidhi's grading: Imam al-Tirmidhi said: This hadith is "hasan sahih".
قلنا: ولا يعارض هذا حديث عبد الله بن عمرو بن العاص المتقدم برقم (2899) الذي فيه أنَّ المكاتب عبد ما بقي عليه شيء من مال مكاتبته، ولا مع عمل أم المؤمنين عائشة الذي أخرجه البيهقي 10/ 324، لما استأذن عليها سليمان بن يسار، فقالت له: من هذا؟ فقال: سليمان، قالت: كم بقي عليك من مكاتبتك؟ قال: عشر أواقٍ، قالت: ادخُل، فإنك عبد ما بقي عليك درهم. وذلك أنَّ معنى حديث أم سلمة هنا ما إذا كان عنده ما يقضي مكاتبته ويمنعه وهو واجب عليه لأجل أن يتسع له النظر ولا يمنع من الدخول على مُكاتِبتِه، كما تفيده رواية يونس بن يزيد الأيلي عن الزُّهْري عن نبهان: أنَّ أم سلمة كاتبته، فبقي من كتابته ألفا درهم، قال نبهان: فكنت أمسكها لكي لا تحتجب عني أم سلمة، فذكر نحو القصة. وكما تفيده رواية محمد بن إسحاق عن الزُّهْري، أنَّ أم سلمة قالت: إنَّ رسول الله ﷺ عهد إلينا إذا كان عند مكاتب إحداكن وفاءً بما بقي من مكاتَبته فاحتجبن منه. ¤ ¤ وحمل الترمذيُّ الحديثَ على معنى التورُّع، والأقرب حملُه على ما ذكرنا لمساعدة الروايات المذكورة له.
Analysis and reconciliation: We say: This narration does not conflict with the earlier hadith of Abd Allah bin Amr bin al-'As, number (2899), which states that "the mukatab remains a slave as long as anything of his contract payment remains due". Nor does it contradict the practice of the Mother of the Believers Aishah (may Allah be pleased with her), which al-Bayhaqi (10/ 324) narrated: when Sulayman bin Yasar asked her permission to enter, she asked: Who is it? He said: Sulayman. She said: How much of your contract payment remains due? He said: Ten uqiyahs. She said: Come in, for you are still a slave as long as a single dirham remains due from you.
Interpretation: The reason is that the meaning of the hadith of Umm Salamah here applies to the case where the mukatab has the money to pay but withholds it (so that he may still be able to see his mistress), although paying it is obligatory on him.
Supporting reports: (1) This meaning is supported by the narration of Yunus bin Yazid al-Ayli, from al-Zuhri, from Nabhan, that Umm Salamah made him a mukatab and two thousand dirhams of it remained due from him. Nabhan said: "I held back that amount so that Umm Salamah would not veil herself from me", and then he mentioned the story. (2) Likewise the narration of Muhammad bin Ishaq from al-Zuhri also supports it, that Umm Salamah said: The Messenger of Allah (peace and blessings be upon him) instructed us: "When the mukatab of any of you has the means to pay the remaining amount, then veil yourselves from him."
Preferred view: Imam al-Tirmidhi interpreted this hadith as referring to "wara'" (scrupulous caution), but the "closer" (more correct) interpretation is the one we have mentioned, because the narrations cited above support it.
وحمله الإمام الشافعي فيما نقله عنه البيهقي في "المعرفة" (20719) على محمل آخر، فقال: هذا في شأن أمهات المؤمنين بالنظر إلى ما عظَّمهن الله به، وخصّهن به، وأنَّ احتجاب المرأة ممَّن له أن يراها واسعٌ لها، وقد أمر النبي ﷺ سَوْدةَ أن تحتجب من رجل قضى أنه أخوها، وذلك يشبه أن يكون للاحتياط وأنَّ احتجاب المرأة ممَّن له أن يراها مباحٌ.
Statement of al-Shafi'i: Imam al-Shafi'i (as al-Bayhaqi transmitted in "al-Ma'rifah" 20719) interpreted it in another way. He said: "This ruling is specific to the status of the Mothers of the Believers, because of the honour and distinction that Allah granted them. And it is permissible (wasi') for a woman to veil herself from a man who has the right to see her. The Prophet (peace and blessings be upon him) ordered Sawdah (may Allah be pleased with her) to veil herself from a man whom he had ruled to be her brother (the case involving the brother of Sa'd bin Abi Waqqas). This resembles caution, and it is permissible for a woman to veil herself from someone who is allowed to see her."
قلنا: ويجوز أن يكون لما أحالت أمُّ سلمة نبهانَ على ابن أخيها ليدفع له ما بقي من كتابته صارت في حكم من استوفى كامل مال المكاتبة، وصار مكاتَبُها في حقها حرًّا تترتب عليه أحكام الأحرار من الاحتجاب وغيره، والله تعالى أعلم.
Further interpretation: We say: It is also possible that when Umm Salamah referred Nabhan to her nephew (by way of hawalah) so that he would pay him the remaining amount, she came under the ruling of one who has received the contract payment in full. Thus her mukatab became "free" with respect to her, and the rulings for free persons, such as veiling and others, applied to him. And Allah the Exalted knows best.
