Mustadrak al-Hakim — Hadith 2830

حدثنا أبو بكر محمد بن أحمد بن بالَوَيهِ، حدثنا محمد بن عثمان بن أبي شَيْبة، حدثنا أحمد بن يونس، حدثنا مُعرِّف بن واصِل، عن مُحارِب بن دِثار، عن عبد الله بن عمر، قال: قال رسول الله ﷺ: "ما أحلَّ اللهُ شيئًا أبغضَ إليه مِن الطلاق" (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه، ومن حُكْم هذا الحديث أن يُبدَا به في كتاب الطلاق.

It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "Of lawful things, the most disliked in the sight of Allah is divorce."
This hadith is sahih (authentic) in its chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it. The scholarly standing of this hadith is such that the Book of Divorce should begin with it.

(1) رجاله ثقات إلّا أنه قد اختُلف في وصله وإرساله على مُعرِّف بن واصل، وقد صحَّح إرسالَه أبو حاتم الرازي كما في "العلل" لابنه (1297)، ورجَّحه الدارقطني في "العلل" (3123)، والبيهقي في "سننه الكبرى" 7/ 322، وقال: المرسل هو المشهور. وخالفهم آخرون فصحَّحوه موصولًا، منهم ابن القطان الفاسي في "بيان الوهم" 5/ 422 في باب أحاديث ضعفها عبد الحق الإشبيلي وهي صحيحة أو حسنة وما أعلَّها به ليس بعلة، وكذلك مال إلى ترجيح الوصل ابنُ التركماني في "الجوهر النقي" 7/ 323.
Grading: Its narrators are trustworthy (thiqat), but there is disagreement over "Mu'arrif bin Wasil" as to whether it is "connected" (mawsul) or "mursal". Abu Hatim al-Razi declared the "mursal" version correct (al-'Ilal 1297), and al-Daraqutni (al-'Ilal 3123) and al-Bayhaqi (al-Sunan al-Kubra 7/ 322) also preferred it, saying: "the mursal is the well-known version".
Technical note / Defect ('illah): Others, however, disagreed and declared it correct as "connected" (mawsul), among them Ibn al-Qattan al-Fasi ("Bayan al-Wahm" 5/ 422, in the chapter on hadiths that Abd al-Haqq al-Ishbili declared weak although they are sahih or hasan); and Ibn al-Turkmani ("al-Jawhar al-Naqi" 7/ 323) also inclined towards preferring the connected version.
وأخرجه أبو داود (2177) عن أحمد بن يونس عن معرِّف، عن محارب، مرسلًا.
Reference / Source: Abu Dawud (2177) narrated it from Ahmad bin Yunus, from Mu'arrif, from Muharib, as "mursal".
وأخرجه أبو داود أيضًا (2178) من طريق محمد بن خالد الوهبي، عن معرف، عن محارب، عن ابن عمر، موصولًا.
Reference / Source: Abu Dawud also narrated it (2178) via Muhammad bin Khalid al-Wahbi, from Mu'arrif, from Muharib, from Ibn 'Umar (may Allah be pleased with them both), as "connected" (mawsul).
وأخرجه ابن أبي شيبة 5/ 253 عن وكيع بن الجراح، وأخرجه ابن المبارك في "البر والصلة" كما في "التذكرة" للزركشي (1)، وأخرجه البيهقي في "السنن الكبرى" 7/ 322، وفي "السنن الصغرى" (2653) من طريق يحيى بن أبي بكير الكرماني، ثلاثتهم (وكيع وابن المبارك وابن أبي بكير) عن مُعرِّف، عن محارب، مرسلًا.
Reference / Source: Ibn Abi Shaybah (5/ 253) narrated it from Waki' bin al-Jarrah; Ibn al-Mubarak in "al-Birr wa al-Silah" (as cited in al-Zarkashi's "al-Tadhkirah": 1); and al-Bayhaqi in "al-Sunan al-Kubra" (7/ 322) and "al-Sunan al-Sughra" (2653) via Yahya bin Abi Bukayr al-Kirmani. All three (Waki', Ibn al-Mubarak and Ibn Abi Bukayr) narrate it from Mu'arrif, from Muharib, as "mursal".
وأخرجه ابن ماجه (2018) من طريق عبيد الله بن الوليد الوَصّافي، عن محارب، عن ابن عمر موصولًا. لكن الوصّافي ضعيف.
Reference / Source: Ibn Majah (2018) narrated it via 'Ubayd Allah bin al-Walid al-Wassafi, from Muharib, from Ibn 'Umar, as "connected" (mawsul).
Technical note / Defect ('illah): But (the narrator) al-Wassafi is weak.
