Mustadrak al-Hakim — Hadith 2772

أخبرنا أبو جعفر محمد بن علي الشَّيباني بالكوفة، حدثنا أحمد بن حازم بن أبي غَرَزة، حدثنا إسماعيل بن الخَليل، حدثنا علي بن مُسهِر، حدثنا داود بن أبي هند، عن الشَّعْبي، عن علقمة بن قيس: أنَّ قومًا أتوا عبد الله بن مسعود، فقالوا له: إنَّ رجلًا منا تزوّج امرأةً ولم يَفْرِضْ لها صداقًا، ولم يَجمَعْها إليه حتى مات، فقال لهم عبد الله: ما سُئلتُ عن شيءٍ منذ فارقتُ رسولَ الله ﷺ أشدَّ عليَّ من هذه، فأْتُوا غيري، قالوا: فاختلفوا إليه فيها شهرًا، ثم قالوا له في آخر ذاك: مَن نسألُ إذا لم نسألك وأنت آخِيّةُ أصحاب محمد ﷺ في هذا البلد، ولا نَجِدُ غيرك، فقال: سأقول فيها بجُهد رأيي، فإن كان صوابًا فمِن الله وحدَه لا شريك له، وإن كان خطأً فمنّي، واللهُ ورسولُه منه بَريء، أَرى أن أجعلَ لها صَداقًا كصَداق نسائها، لا وَكْسَ ولا شَطَطَ، ولها الميراث، وعليها العِدّة أربعةَ أشهر وعشرًا، قال: وذلك يَسمعُ ناسٌ من أشجَعَ، فقاموا، فقالوا: نشهدُ أنك قضيتَ بمثل الذي قضى به رسولُ الله ﷺ في امرأةٍ منا يقال لها: بَرْوَعُ بنتُ واشِقٍ، قال: فما رُئِيَ عبدُ الله فَرِحَ بشيءٍ ما فرحَ يومئذٍ إلّا بإسلامه، ثم قال: اللهم إن كان صوابًا فمنك وحدَك لا شريك لك، وإن كان خطأً فمنّي ومن الشيطان، واللهُ ورسولُه منه بَريءٌ (1).
هذا حديث صحيح على شرط مسلم، ولم يُخرجاه.

It is narrated from Alqamah bin Qays that some people came to Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) and said: "A man among us married a woman but did not fix a dowry for her, and he died before the marriage was consummated (what is the ruling on this?)." Abdullah bin Mas'ud (may Allah be pleased with him) said to them: "Since I parted from the Messenger of Allah (peace and blessings be upon him), I have not been asked a question harder for me than this; go to someone else." The narrator says: They kept coming to him about it for a month, then finally they said: "If we do not ask you, whom shall we ask, when you are the most trusted pillar of the Companions of Muhammad (peace and blessings be upon him) in this city?" So he said: "I will give my opinion on this matter with my utmost effort of reasoning (ijtihad). If it is correct, it is from Allah alone, who has no partner; and if it is wrong, it is from me, and Allah and His Messenger are free of it. My opinion is that she should have a dowry like the dowry of the women of her family (mahr al-mithl), with neither decrease nor excess; she will also receive a share of the inheritance, and she must observe a waiting period ('iddah) of four months and ten days." The narrator says: Some people of the tribe of Ashja' were present there; they stood up and said: "We bear witness that you have given exactly the same judgement as the Messenger of Allah (peace and blessings be upon him) gave concerning a woman of ours, Barwa' bint Washiq." The narrator says: Abdullah bin Mas'ud (may Allah be pleased with him) was never seen as happy about anything, after his acceptance of Islam, as he was that day. Then he said (out of humility): "O Allah, if this judgement is correct, it is from You alone; and if it is wrong, it is from me and from Satan, and Allah and His Messenger are free of it."
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

Grading: Its isnad is "sahih".
Technical note / Defect ('illah): "Al-Sha'bi" refers to 'Amir bin Sharahil (al-Kufi).
وأخرجه النسائي (5494)، وابن حبان (4101) من طريق علي بن حجر، عن علي بن مُسهِر، بهذا الإسناد.
Reference / Source: Al-Nasa'i (5494) and Ibn Hibban (4101) narrated it via 'Ali bin Hujr from 'Ali bin Mushir, with the above isnad.
وأخرجه مختصرًا أحمد 30/ (18462) من طريق حماد بن سلمة، و (18463) من طريق يحيى ابن زكريا بن أبي زائدة، كلاهما عن داود بن أبي هند، به.
Reference / Source: Ahmad narrated it in "al-Musnad" (30/ 18462) through the route of Hammad bin Salamah, and (18463) through the route of Yahya bin Zakariyya bin Abi Za'idah, in "abridged form"; both of these narrators narrate from Dawud bin Abi Hind.
وأخرجه مختصرًا أيضًا أحمد 25/ (15943) و 30/ (18461) و (18465) و (18466)، ¤ ¤ وابن ماجه (1891 م)، والترمذي (1145)، والنسائي (5489) و (5490) و (5493) و (5688)، وابن حبان (4100) من طريق إبراهيم النخعي، عن علقمة، به. وقُرن به في بعض طرقه الأسود بن يزيد النخعي.
Reference / Source: Ahmad (25/ 15943 and 30/ 18461, 18465, 18466), Ibn Majah (1891 m), al-Tirmidhi (1145), al-Nasa'i (5489, 5490, 5493, 5688) and Ibn Hibban (4100) narrated it in "abridged form" through the chain of Ibrahim al-Nakha'i from 'Alqamah bin Qays.
Technical note / Defect ('illah): In some routes, the name of al-Aswad bin Yazid al-Nakha'i is also mentioned alongside 'Alqamah as a paired narrator (maqrun).
