حدثنا أبو بكر بن إسحاق، أخبرنا أبو المثنَّى، حدثنا مُسدَّد، حدثنا يحيى بن سعيد، حدثني عبيد الله بن الأخْنَس، عن عمرو بن شعيب، عن أبيه، عن جده: أنَّ مَرثَد بن أبي مَرثَد الغَنَوي كان يَحمِل الأُسارى بمكة، وكان بمكة بَغِيٌّ يقال لها: عَنَاقٌ، وكانت صديقتَه، قال: فجئتُ النبيَّ ﷺ فقلتُ: يا رسولَ الله، أنكِحُ عَنَاقًا؟ قال: فسكت عنّي، فنزلت: ﴿الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ وَحُرِّمَ ذَلِكَ عَلَى الْمُؤْمِنِينَ﴾ [النور: 3]، فقرأه عليَّ رسول الله ﷺ، وقال: "لا تَنكِحْها" (1). هذا حديث صحيح الإسناد، ولم يُخرجاه. Amr bin Shu'ayb narrates from his father, from his grandfather, that Sayyiduna Marthad bin Abi Marthad al-Ghanawi (may Allah be pleased with him) used to carry captives from Makkah (to Madinah). In Makkah there was an immoral woman named Anaq who was his friend. Marthad said: I came to the Prophet (peace and blessings be upon him) and said: O Messenger of Allah, shall I marry Anaq? He (peace and blessings be upon him) remained silent until this verse was revealed: "The fornicator does not marry except a fornicatress or a polytheist woman, and none marries the fornicatress except a fornicator or a polytheist man, and that has been made unlawful for the believers." [Surah al-Nur: 3] Then the Messenger of Allah (peace and blessings be upon him) recited this verse to me and said: "Do not marry her."
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it.

Technical note / Defect ('illah): Among the narrators, Abu al-Muthanna is Mu'adh bin al-Muthanna al-Anbari, Musaddad is Ibn Musarhad, and Yahya bin Sa'id is al-Qattan. وأخرجه أبو داود (2051)، والنسائي (5319) عن إبراهيم بن محمد التيمي، عن يحيى بن سعيد، بهذا الإسناد. Reference / Source: Abu Dawud (2051) and al-Nasa'i (5319) recorded it from Ibrahim bin Muhammad al-Taymi, from Yahya bin Sa'id al-Qattan, with this same chain. وأخرجه الترمذي (3177) من طريق روح بن عبادة، عن عبيد الله بن الأخنس، به. وقال الترمذي: حسن غريب. Reference / Source: Al-Tirmidhi (3177) recorded it via Rawh bin Ubadah, from Ubayd Allah bin al-Akhnas. Grading: Al-Tirmidhi graded it "hasan gharib". وقد وقع في رواية الحاكم هذه صرف كلمة "عناق" وإعرابها، وكذلك وقع في رواية الترمذي، وكذا في رواية أبي داود التي وقعت لابن الجوزي في "التحقيق" (1745)، مع أنَّ المعروف في المؤنث الذي على وزن "فَعَال" أحدُ وجهين: إما المنع من الصرف على لغة بني تَميم، وأما البناء على الكسر على لغة أهل الحجاز. Technical note / Defect ('illah): In al-Hakim's narration here, in al-Tirmidhi's narration, and in Abu Dawud's narration as it reached Ibn al-Jawzi in "al-Tahqiq" (1745), the word "'Anaq" is treated as fully declinable (i.e. it takes tanwin). General principle: Yet in Arabic, for a feminine name on the pattern "fa'al" two usages are known: either it is treated as diptote (ghayr munsarif) according to the dialect of Banu Tamim, or it is indeclinable with a fixed kasrah (mabni) according to the dialect of the people of the Hijaz. وسيأتي بنحوه برقم (2821) و (3537) من طريق القاسم بن محمد عن عبد الله بن عمرو.
