Amr bin Shu'ayb narrates from his father, from his grandfather (Sayyiduna Abdullah bin Amr, may Allah be pleased with them both), that the Messenger of Allah (peace and blessings be upon him), Sayyiduna Abu Bakr and Sayyiduna Umar (may Allah be pleased with them both) burned the belongings of the one who committed treachery with the spoils of war, deprived him of his share (of the spoils), and beat him (as a disciplinary punishment).
This is a gharib sahih (rare but authentic) hadith, but the two Shaykhs (Bukhari and Muslim) did not record it.

Grading: Its chain is da'if. Technical note / Defect ('illah): The narrations of the people of Syria from Zuhayr bin Muhammad al-Tamimi are not sound, because he narrated hadiths there from memory, in which he made many mistakes. Al-Walid bin Muslim is from Damascus, and no one other than him narrated this hadith from Zuhayr. Moreover, there is a disagreement over al-Walid in this hadith; it has been narrated as marfu' and muttasil (as with the author (al-Hakim)), and it has also been given as a maqtu' saying of 'Amr bin Shu'ayb, which is evidence of Zuhayr's "idtirab" (inconsistency) in this hadith. Reference / Source: Abu Dawud recorded it at (2715) via Musa bin Ayyub with this same chain of al-Walid bin Muslim. Reference / Source: Abu Dawud, right after no. (2715), narrated it by way of al-Walid bin 'Utbah and 'Abd al-Wahhab bin Najdah from al-Walid bin Muslim from Zuhayr bin Muhammad, but stopped it at the saying of 'Amr bin Shu'ayb (i.e. did not make it marfu'). (2616). Note / Clarification: In this regard, see the earlier narration no. (2616).
