Mustadrak al-Hakim — Hadith 2375

حدثنا أبو الوليد الفقيه، حدثنا أبو نُعيم الجُرجاني، حدثنا حماد بن الحسن بن عَنبَسة، حدثنا عُمر بن يونس بن القاسم، حدثنا أبي، عن إسحاق بن عبد الله بن أبي طلحة، عن أنس، قال: نهى رسول الله ﷺ عن المُحاقَلَة والمُخاضَرة والمُنابَذة (2). قال الأستاذ أبو الوليد: المخاضَرة أن لا يباعَ شيء منها حتى يحمرَّ أو يَصفرَّ.
هذا حديث صحيح الإسناد، وقد تفرَّد بإخراجه البخاري.

It is narrated from Sayyiduna Anas (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) forbade muhaqalah (selling standing grain in the field in exchange for harvested grain), mukhadarah (selling fruit before it ripens) and munabadhah (making a sale binding by throwing a garment without inspecting it). Ustadh Abu al-Walid said: Mukhadarah means that none of it is to be sold until it turns red or yellow (that is, until it ripens).
This hadith has a sahih (authentic) chain, and Imam Bukhari is alone in recording it.

(2) إسناده صحيح. أبو نعيم الجُرجاني: هو عبد الملك بن محمد بن عدي الحافظ. ¤ ¤ وأخرجه البخاري (2207) عن إسحاق بن وهب، عن عمر بن يونس، بهذا الإسناد.
Grading: This chain is "sahih", and al-Bukhari (2207) also narrated it.
والمحاقلة: اشتراء الزرع بالحنطة، واستكراء الأرض بالحنطة، وكذا تطلق على بيع الزرع القائم بالحَبّ كيلًا.
Note / Clarification: "Muhaqalah" means buying a standing crop in the field in exchange for wheat, or renting out land in exchange for wheat.
والمنابذة: أن ينبذ الرجل إلى الرجل ثوبه وينبذ الآخر ثوبه، ويكون ذلك بيعهما عن غير نظر ولا تراض. أو هي أن يقول: أنبذ ما معي وتنبذ ما معك، يشتري كلُّ واحدٍ منهما من الآخر، ولا يدري كل واحد منهما كم مع الآخر.
Note / Clarification: "Munabadhah" is a pre-Islamic type of sale in which merely throwing a garment towards one another was considered a sale, without looking and without proper mutual consent.
