أخبرنا عبد الله بن محمد الصَّيدلاني، حدثنا إسماعيل بن قُتيبة، حدثنا أبو بكر بن أبي شَيْبة، حدثنا يحيى بن زكريا بن أبي زائدة، عن محمد بن عمرو، عن أبي سلمة، عن أبي هريرة، قال: قال رسول الله ﷺ: "من باع بَيْعَتَين في بيعةٍ، فله أَوكَسُهما أو الرِّبا" (1). صحيح على شرط مسلم، ولم يُخرجاه. It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever makes two sales in one sale, it is permissible for him to take the lower price of the two (the original price); otherwise it is usury (riba)."
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) شاذٌّ بهذا اللفظ، وقد انفرد به يحيى بن زكريا من بين سائر أصحاب محمد بن عمرو - وهو ابن علقمة الليثي - الذين رووه بلفظ: نهى رسول الله ﷺ عن بيعتين في بَيعة، كما بسطناه في "سنن أبي داود". Grading: With this wording the narration is "shadh"; Yahya bin Zakariyya is alone in it. The other students of Muhammad bin 'Amr narrated it with the wording "the prohibition of two sales in one sale", as we have written in detail in "Sunan Abi Dawud". وأخرجه أبو داود (3461)، وابن حبان (4974) من طريق أبي بكر بن أبي شيبة، بهذا الإسناد. Reference / Source: Abu Dawud (3461) and Ibn Hibban (4974) recorded it through Abu Bakr bin Abi Shaybah with this same chain. وأخرجه أحمد 15/ (9584)، والنسائي (6183) من طريق يحيى بن سعيد القطان، وأحمد 16/ (10535) عن يزيد بن هارون، والترمذي (1231)، وابن حبان (4973) من طريق عبدة بن سليمان، ثلاثتهم عن محمد بن عمرو، عن أبي سلمة، عن أبي هريرة، بلفظ: نهى رسول الله ﷺ عن بيعتين في بيعة - وإسناده حسن. Reference / Source: Ahmad 15/ (9584), al-Nasa'i (6183), al-Tirmidhi (1231) and Ibn Hibban (4973) recorded it through Muhammad bin 'Amr with the wording "the prohibition of two sales in one sale", and its chain is hasan. وكذلك رواه بهذا اللفظ عن محمد بن عمرو جماعةٌ آخرون، منهم عبدُ الوهاب بن عطاء عند أبي يعلى (6124)، والبيهقي 5/ 343، ومحمدُ بنُ عبد الله الأنصاري عند ابن المنذر في "الأوسط" (7928)، والخطابي في "معالم السنن" 3/ 122، وعبدُ العزيز بنُ محمد الدراوردي عند الخطابي في "المعالم" 3/ 122، والبيهقي في "معرفة السنن والآثار" (11473)، وابن عبد البر في "التمهيد" 24/ 389، وحكاه البيهقي أيضًا عن إسماعيل بن جعفر ومعاذ بن معاذ. Reference / Source: Likewise a large group narrated it, including in Ibn al-Mundhir (al-Awsat 7928), al-Khattabi (Ma'alim al-Sunan 3/ 122), al-Bayhaqi (Ma'rifat al-Sunan wa-l-Athar 11473) and Ibn 'Abd al-Barr (al-Tamhid 24/ 389). وقد رواه بهذا اللفظ كذلك جمع من الصحابة كما بيناه في "سنن أبي داود"، بالنهي عن البيعتين في بيعة، دون ذكر الأوكس من البيعتين أو الربا. Corroborating chains and supporting reports: A group of Companions also narrated it in the same way (two sales in one sale), as we have explained in "Sunan Abi Dawud"; they do not have the words "awkas" (the lower price) or "riba". وقال الخطابي: لا أعلم أحدًا من الفقهاء قال بظاهر هذا الحديث أو صحَّح البيع بأوكس الثمنين إلّا شيء يُحكى عن الأوزاعي، وهو مذهب فاسد، وذلك لما تتضمنه هذه العقدة من الغرر والجهل، وإنما المشهور من طريق محمد بن عمرو عن أبي سلمة عن أبي هريرة، عن النبي ﷺ: أنه نهى عن بيعتين في بيعة. General principle: Imam al-Khattabi (may Allah have mercy on him) says: I know of no jurist who acted on the apparent (shadh) meaning of this hadith or held the sale valid at the lower of the two prices, except a view attributed to al-Awza'i, and that position is unsound because it involves gharar (deception). The well-known narration is the one prohibiting "two sales in one sale". قلنا: وممَّن كان يقضي بأوكس البيعتين القاضي شُريح، كما في "مصنف عبد الرزاق" (14629) بسند صحيح عنه. Reference / Source: We say: among those who used to judge by the lower of the two prices (awkas al-bay'atayn) was the judge Shurayh, as reported from him with a sahih chain in "Musannaf Abd al-Razzaq" (14629). وقد حكى شيخ الإسلام ابن تيمية في "مجموع الفتاوى" 29/ 499 - 500 الإجماع على جواز بيع الأجل، وهو التقسيط. Reference / Source: Shaykh al-Islam Ibn Taymiyyah reported in "Majmu' al-Fatawa" 29/ 499-500 a consensus on the permissibility of a deferred-payment sale (sale by instalments). وشرطُه أنه لا بد أن يتم الافتراق بين المتبايعَين على وجهٍ واحدٍ بعد المساومة على الدفع نقدًا أو إلى أجل مع زيادة في الثمن، فإنَّ للأجل قسطًا من الثمن. وانظر "الاستذكار" لابن عبد البر (29709). General principle: Its (an instalment sale's) condition is that the buyer and seller part having decided definitively on one form (cash or deferred) when completing the deal, since in the deferred form part of the price is in exchange for the time.
