Mustadrak al-Hakim — Hadith 2310

حدثنا أبو العباس محمد بن يعقوب، حدثنا العباس بن محمد الدُّوري، حدثنا أبو النضر هاشم بن القاسم، حدثنا عِكْرمة بن عمار، حدثنا طارق بن عبد الرحمن القرشي، قال: جاء رفاعةُ بن رافع إلى مجلس الأنصار، فقال: لقد نهانا رسولُ الله ﷺ اليومَ؛ فذكر أشياء، فقال: نهانا عن كَسْبِ الأَمَة إلَّا ما عَمِلَتْ بيدها (1)؛ وقال هكذا بإصبعه، نحو الغَزْل والخَبْزِ والنَّقْش (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه. وله شاهدٌ عن رافع بن خَديج:

It is narrated from Sayyiduna Rifa'ah bin Rafi' (may Allah be pleased with him) that he came to a gathering of the Ansar and said that today the Messenger of Allah (peace and blessings be upon him) had forbidden us certain things. He (peace and blessings be upon him) forbade us the earnings of a slave-girl (which are imposed on her), except what she earns by working with her own hands, and he (peace and blessings be upon him) gave examples by pointing with his blessed finger, such as spinning yarn, baking bread, or embroidery and decorative work.
This hadith has an authentic chain (sahih al-isnad), but the two Shaykhs (Bukhari and Muslim) did not record it. It also has a supporting report (shahid) narrated from Sayyiduna Rafi' bin Khadij (may Allah be pleased with him).

(1) حديث حسن، وهذا إسناد محتمل للتحسين إلّا أنه مرسلٌ، لأنَّ رفاعة بن رافع هذا تابعي، وهو ابن خَديج، وليس هو رافع بن رفاعة كما وقع مسمَّى في رواية أحمد وأبي داود، وقد جاء على الصواب في رواية المصنف هنا، وكذلك في رواية ابن منده في "معرفة الصحابة" 1/ 586 من طريق عبد الرحمن بن غزوان عن عكرمة بن عمار، وكذلك جاء في رواية الطحاوي في "شرح مشكل الآثار" (4657) من طريق عمر بن يونس اليمامي عن عكرمة، إلّا أنه قال في روايته: ¤ ¤ عن رفاعة بن رافع أو رافع بن رفاعة، بالشك، والظاهر أنَّ هذا الشك والاختلاف من طارق بن عبد الرحمن المذكور - وهو ابن القاسم القرشي - وقد وثقه العجلي وذكره ابن حبان في "الثقات"، وقال في "مشاهير علماء الأمصار": من سادات أهل المدينة، ولم يرو عنه غير عكرمة بن عمار.
Grading: This hadith is hasan. This chain has the possibility of being graded hasan, but it is "mursal", because Rifa'ah bin Rafi' is a Successor (tabi'i), and he is Ibn Khadij.
Technical note: His name is not Rafi' bin Rifa'ah, as occurred in the narration of Ahmad and Abu Dawud; here, in the author's narration, the correct name (Rifa'ah bin Rafi') is recorded. Regarding Tariq bin Abd al-Rahman, al-Ijli said that he is thiqah, and Ibn Hibban mentioned him in "al-Thiqat".
وممّا يُقوّي كونه رفاعة بن رافع بن خديج أنَّ الحديث روي من وجه آخر من طُرق عن أبي بَلْج يحيى بن سليم عن عَبَاية بن رفاعة بن رافع بن خديج مرسلًا كذلك، ورواه حُصين بن نمير عن أبي بَلْج فزاد فيه ذكر رفاعة بن رافع، وروايته عند الطبراني في "الكبير" (4407)، وانفرد بذلك من بين سائر أصحاب أبي بَلْج، فالصحيح أنه في رواية أبي بلج هذه عن عَبَاية بن رفاعة بن رافع مرسلًا.
Corroborating chains and supporting reports: That this is indeed Rifa'ah bin Rafi' bin Khadij is strengthened by the fact that this hadith has also been narrated as mursal through other routes from Abu Balj, from Abayah bin Rifa'ah bin Rafi'. In al-Tabarani (4407), Husayn bin Numayr added mention of Rifa'ah bin Rafi', but the correct view is that in Abu Balj's narration it is mursal from Abayah.
وسيأتي الحديث عند المصنف بعده لرافع بن خديج، وإسناده حسن، وهو يُقوِّي أنَّ المرسل الذي هنا لولده رفاعة، إذ لعله يكون سمعه منه. وإذا علمنا ذلك فباجتماع مرسلَي رفاعة وولده عباية مع الموصول الذي بعده عن رافع بن خديج، يحسُنُ الحديث إن شاء الله، ولا يبعد أن يكونا إنما سمعاه من رافع بن خديج، فلكليهما سماعٌ منه، والله أعلم بالصواب.
Grading: With the author, the next hadith will come from Rafi' bin Khadij with a hasan chain, which strengthens the view that this mursal narration is indeed that of his son Rifa'ah. By the combination of these two mursal narrations and the following connected (mawsul) narration, this hadith becomes "hasan", in sha' Allah.
وأخرجه أحمد 31/ (18998) عن هاشم بن القاسم، وأبو داود (3426) عن هارون بن عبد الله، عن هاشم بن القاسم، بهذا الإسناد. غير أنهما قالا: رافع بن رفاعة.
Reference / Source: Imam Ahmad 31/ (18998) and Abu Dawud (3426) narrated it by way of Hashim bin al-Qasim with this same chain, but they gave the name as "Rafi' bin Rifa'ah".
وأخرجه أحمد 28/ (17268) عن أبي النضر هاشم بن القاسم، عن شعبة، عن أبي بَلْج، عن عباية بن رفاعة مرسلًا. وانظر تمام تخريجه في "المسند".
Reference / Source: Imam Ahmad 28/ (17268) narrated it as mursal from Shu'bah, from Abu Balj, from Abayah bin Rifa'ah. For the full takhrij, see "al-Musnad".

وقد صحَّ النهيُ عن كسبِ الأَمَة مطلقًا دون تقييد ذلك من حديث أبي جحيفة وحديث أبي هريرة، وكلاهما عند البخاري (2238) و (2283).
General principle: The absolute prohibition (without any restriction) of the earnings of a slave-woman is established from the hadith of Abu Juhayfah and Abu Hurayrah, which are in al-Bukhari (2238) and (2283).
وأخرج مالك في "موطئه" 2/ 981 عن عثمان بن عفان قال: لا تُكلِّفوا الأَمة غير ذاتِ الصَّنْعةِ الكسبَ، فإنكم متى كلَّفتموها ذلك كَسَبَت بفرجها. وإسناده صحيح.
Reference / Source: Imam Malik narrated in "al-Muwatta'" 2/ 981 from Uthman bin Affan (may Allah be pleased with him): "Do not compel a slave-woman who knows no craft to earn, for when you compel her, she will earn by means of her private parts".
Grading: Its chain is sahih.

(1) كذلك أُعجمت في (ز)، بالقاف، وكذلك في مطبوع "السنن الكبرى" للبيهقي 6/ 126 عن أبي عبد الله الحاكم، بإسناده، ووقع في رواية أحمد وأبي داود: النفش، بالفاء بدل القاف، والنفش - بالفاء -: ندف القطن والصوف، والنقش - بالقاف -: التطريز والتزيين.
Technical note: In manuscript (Z) and in al-Bayhaqi's "al-Sunan al-Kubra" (6/ 126) this word is "al-naqsh" (with qaf), whereas in the narration of Ahmad and Abu Dawud it is "al-nafsh" (with fa'). "Al-nafsh" means carding cotton or wool, while "al-naqsh" means embroidery and decoration.
