Mustadrak al-Hakim — Hadith 2285

أخبرني عبد الصمد بن علي بن مُكرَم البزَّاز، حدثنا جعفر بن محمد بن شاكر، حدثنا أبو الوليد الطَّيالِسي وعَفّان بن مسلم ومسلم بن إبراهيم، قالوا: حدثنا هشام بن أبي عبد الله، حدثنا قَتَادة، عن الحسن، عن سمُرة، أنَّ النبي ﷺ قال: "أيُّما رجلٍ باع بيعًا مِن رجلٍ أو رجلَين، فهو للأول منهما، وأيُّما امرأةٍ زَوَّجها وَليّانِ، فهي للأول منهما" (1).
هذا حديث صحيح على شرط البخاري، ولم يُخرجاه.

It is narrated from Sayyiduna Samurah bin Jundub (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "Whoever sells something to one man or two, it belongs to the first buyer; and any woman who is married off by two guardians (separately), she belongs to the first husband."
This hadith is sahih (authentic) on the condition of Imam Bukhari, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) إسناده صحيح، وسماع الحسن - وهو البصري - من سَمُرة - وهو ابن جُندب - صحيح، كما بيناه عند الحديث السالف برقم (151). وقد صحَّحَ هذا الحديثَ أبو زرعة وأبو حاتم، كما في "البدر المنير" لابن الملقن 7/ 590، وانتقاه ابنُ الجارود (622)، وحسّنه الترمذي.
Grading: Its chain is "sahih", and al-Hasan al-Basri's hearing from Samurah bin Jundub is established
Grading: Abu Zur'ah, Abu Hatim and Ibn al-Jarud declared it sahih, while al-Tirmidhi called it "hasan".
وأخرجه أحمد 33/ (20116) و (20141) و (20208)، وأبو داود (2088)، والنسائي (5376) و (5377) من طرق عن هشام، بهذا الإسناد.
Reference / Source: Imam Ahmad (33/ 20116), Abu Dawud (2088) and al-Nasa'i narrated it through the chain of Hisham.
وأخرجه أحمد (20085) و (20263)، وأبو داود (2088) من طريق حماد بن سلمة، ¤ ¤ وأحمد (20090) و (20121)، وأبو داود (2088)، وابن ماجه (2344) من طريق همام بن يحيى، كلاهما عن قتادة، به.
Reference / Source: Imam Ahmad and Ibn Majah (2344) narrated it by way of Hammad bin Salamah and Hammam bin Yahya, from Qatadah.
وسيأتي برقم (2754) من طريق معاذ بن هشام عن أبيه.
Corroborating chains and supporting reports: This narration will come later at number (2754) by way of Mu'adh bin Hisham.
وبرقم (2755) من طريق سعيد بن أبي عَروبة، وبرقم (2756) من طريق سعيد بن بَشير، كلاهما عن قتادة.
Corroborating chains and supporting reports: It will also come at numbers (2755) and (2756) by way of Sa'id bin Abi Arubah and Sa'id bin Bashir.
وبرقم (2757) من طريق أشعث بن عبد الملك الحُمْراني عن الحسن البصري.
Corroborating chains and supporting reports: And at number (2757) it is narrated by way of Ash'ath bin Abd al-Malik, from al-Hasan.
وقال البيهقي في "السنن الكبرى" 10/ 139: للأول حق السبق، والسبق أصل في الشريعة.
Important point: Imam al-Bayhaqi says that the first has the right of precedence, and precedence is an important principle in the Shari'ah.
