أخبرني أبو عون محمد بن أحمد بن ماهَان الجزّار بمكة، حدثنا علي بن عبد العزيز، حدثنا حجاج بن مِنْهال، حدثنا حماد بن سَلَمة، عن قيس بن سعد، عن عطاء، عن جابر، قال: بِعْنا أمهاتِ الأولاد على عهد رسول الله ﷺ وأبي بكر، فلما كان عمرُ نهانا فانتَهَينا (1). هذا حديث صحيح على شرط مسلم، ولم يُخرجاه. وله شاهد صحيح: [التعليق - من تلخيص الذهبي] ترقيم العلميه 2189 - على شرط مسلم وشاهده صحيح
It is narrated from Sayyiduna Jabir (may Allah be pleased with him) that he said: In the time of the Messenger of Allah (peace and blessings be upon him) and Sayyiduna Abu Bakr (may Allah be pleased with him) we used to sell ummahat al-awlad (slave women who had borne children to their masters), but when the time of Sayyiduna Umar (may Allah be pleased with him) came, he forbade us from it, so we stopped.
This hadith is sahih (authentic) on the condition of Muslim, but the two Shaykhs did not record it.

(1) إسناده صحيح. عطاء: هو ابن أبي رباح. Grading: Its chain is "sahih" Note / Clarification: Ata is Ibn Abi Rabah. وأخرجه أبو داود (3954)، وابن حبان (4324) من طريقين عن حماد بن سلمة، بهذا الإسناد. Reference / Source: Abu Dawud (3954) and Ibn Hibban (4324) narrated it through two routes from Hammad bin Salamah, with this same chain. وأخرجه أحمد 22/ (14446)، وابن ماجه (2517)، والنسائي (5021) و (5022)، وابن حبان (4323) من طريق ابن جُرَيج، أخبرني أبو الزُّبَير، أنه سمع جابر بن عبد الله يقول: كنا نبيع سَرَاريَّنا وأمهاتِ أولادنا والنبي ﷺ فينا حيٌّ، لا نرى بذلك بأسًا. Reference / Source: Imam Ahmad (22/ 14446), Ibn Majah (2517), al-Nasa'i (5021 and 5022) and Ibn Hibban (4323) narrated it through the route of Ibn Jurayj, who said: Abu al-Zubayr informed me that he heard Jabir bin Abd Allah say: We used to sell our slave-women and our umm walads (a slave-woman who has borne her master a child) while the Prophet (peace and blessings be upon him) was alive among us, and we saw no harm in it. قال البيهقي في "سننه الكبرى" 10/ 348: ليس في شيء من الطرق أنه اطلع على ذلك وأقرهم عليه ﷺ. Technical note / Defect ('illah): Imam al-Bayhaqi says in "al-Sunan al-Kubra" (10/ 348): None of the routes mentions that the Prophet (peace and blessings be upon him) came to know of this act and approved them in it (that is, this is not a hadith of tacit approval). وقال ابن حزم في "المحلى" 9/ 219: ليس فيه أنَّ رسول الله ﷺ علم ذلك. Technical note / Defect ('illah): Imam Ibn Hazm says in "al-Muhalla" (9/ 219): There is nothing in it to show that the Messenger of Allah (peace and blessings be upon him) knew of it. وقد ثبت عن علي بن أبي طالب أنه قال: اجتمع رأيي ورأي عمر في أمهات الأولاد أن لا يُبَعن، ثم رأيتُ بعد أن يُبعن، قال عَبيدة السَّلماني: فقلت له: فرأيك ورأي عمر في الجماعة أحبّ إليَّ ¤ ¤ من رأيك وحدك في الفُرقة. أخرجه عبد الرزاق (13224). Reference / Source: It is established from Ali bin Abi Talib that he said: My view and the view of Umar agreed that the umm walads should not be sold, then later my view was that they may be sold; at this Abidah al-Salmani said: Your view and the view of Umar, held together with the community (in agreement), is dearer to me than your view alone, which brings division Reference / Source: Abd al-Razzaq narrated it at (13224). لكن ثبت عن علي أنه رجع عن ذلك أخيرًا إلى رأي عمر، وذلك فيما قاله لِعَبيدة السَّلْماني وشريح: اقضوا كما كنتم تقضون، فإني أكره الاختلاف، حتى يكون للناس جماعة، أو أموت كما مات أصحابي. أخرجه البخاري (3707). Important point: But it is established from Ali that in the end he withdrew from his view and adopted the view of Umar, as he said to Abidah al-Salmani and Shurayh: Judge as you used to judge, for I dislike disagreement, until the people are united in one community or I die as my companions died Reference / Source: Imam al-Bukhari narrated it at (3707). قال البَغَوي في "شرح السنة" 9/ 370: هذا يدلُّ على أنه وافق الجماعة على أنها لا تُباع، واختلاف الصحابة إذا خُتم باتفاق وانقرض العصر عليه، كان إجماعًا. General principle: Imam al-Baghawi says in "Sharh al-Sunnah" (9/ 370): This shows that he agreed with the community on this issue, that they are not to be sold; and when a disagreement of the Companions ends in agreement and that era passes, it becomes "ijma'" (consensus). قلنا: لكن يعكّر على القول بالإجماع ما رواه سفيان بن عيينة في "جزئه" برواية زكريا بن يحيى (19) عن عمرو بن دينار، عن عطاء بن أبي رباح، عن ابن عباس، قال: والله ما أمُ ولدك إلّا بمنزلة شاتك أو بعيرك. قال البخاري في "تاريخه الكبير" 2/ 388: هذا المعروف من فُتيا ابن عباس. قلنا: ولعلَّ قصد ابن عباس أنَّ حكمها كذلك في حال حياة سيدها من حيث عدم استحقاقها حقوق الزوجة الحرة، وعدم ترتب الآثار اللازمة فيه كما في نكاح المسلم للمرأة الحرة، كعدم جواز الزيادة على الأربع في النكاح، والله تعالى أعلم. Main discussion: (The editors say that) the claim of consensus is affected by the narration that Sufyan bin Uyaynah recorded in his "Juz'", in the recension of Zakariyya bin Yahya (19), from Amr bin Dinar from Ata bin Abi Rabah from Ibn Abbas: By Allah! Your umm walad is only like your sheep or your camel Reference / Source: Imam al-Bukhari says in "al-Tarikh al-Kabir" (2/ 388) that this is the well-known fatwa of Ibn Abbas Note / Clarification: Perhaps Ibn Abbas meant that during her master's lifetime her ruling is such that she does not have the rights of a free wife, nor do the consequences of marriage to a free woman apply (such as the limit of four wives), and Allah knows best.
