فأخبرَناه بَكْر بن محمد الصَّيرفي، حدثنا عبد الصمد بن الفضل، حدثنا قَبيصة، حدثنا سفيان. وحدثنا أبو عبد الله الصَّفار، حدثنا أحمد بن محمد بن عيسى، حدثنا أبو حُذيفة، حدثنا سفيان، عن ابن أبي ذئب، عن مخلد بن خُفاف، عن عُرْوة، عن عائشة: أنَّ رسول الله ﷺ قضى أنَّ الخَرَاج بالضَّمان (1). وأما حديث ابن المبارك:
It is narrated from Sayyidah Aishah (may Allah be pleased with her) that the Messenger of Allah (peace and blessings be upon him) issued the ruling that the benefit is in return for the liability.

(1) حديث صحيح، وهذا إسناد حسن كسابقه. قبيصة: هو ابن عقبة السُّوَائي، وأبو حذيفة: هو موسى بن مسعود النَّهْدي.
Grading: The chain is
hasan and the hadith is
sahih. Qabisah and Abu Hudhayfah are trustworthy narrators.
وأخرجه أبو داود (3509) من طريق محمد بن يوسف الفريابي، عن سفيان الثَّوري به عن مخلد قال: كان بيني وبين أناس شركة في عبدٍ، فاقتَويتُه (أي: استخدمته) وبعضنا غائب، فأغلَّ عليّ غلَّةً، فخاصمني في نصيبه إلى بعض القضاة، فأمرني أن أردّ الغَلّة، فأتيت عروة بن الزُّبَير، فحدثتُه، فأتاه عروة، فحدّثه عن عائشة، عن رسول الله ﷺ قال: "الخراج بالضمان".
Incident and reference: Makhlad says: I had a share in a slave, who earned something for me. When a dispute arose, the judge told me to return the earnings, but 'Urwah bin al-Zubayr (may Allah be pleased with him) narrated the hadith through 'A'ishah (may Allah be pleased with her): "The benefit belongs to the one who bears liability (daman) for the loss".
