Mustadrak al-Hakim — Hadith 1809

أخبرنا أبو بكر بن إسحاق الفقيه، أخبرنا أبو المُثنّى، حدثنا مُسدَّد، حدثنا بِشْر بن المُفضَّل، حدثنا عبد الرحمن بن إسحاق، عن أبيه، عن عامر بن سعد بن أبي وقَّاص، عن أبيه سعدٍ: أنه كان يَخرُج من المدينة فيجدُ الحاطبَ من الحُطَّاب معه شجرٌ (1) رَطْبٌ قد عَضَدَه من بعض شَجَر المدينة، فيأخذُ سَلَبَه، فيكلِّمُه فيه - وقال بِشْر: فيُكلَّم فيه - فيقول: لا أدَعُ غَنيمةً غنَّمَنِيها رسولُ الله ﷺ وأنا من أكثر الناس مالًا (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه.
It is narrated from Sayyiduna Sa'd bin Abi Waqqas (may Allah be pleased with him) that he would go out of Madinah, and if he found a woodcutter who had cut a fresh branch from one of the trees of Madinah, he would seize his belongings. When he was spoken to about this, he would say: "I will not give up spoils that the Messenger of Allah (peace and blessings be upon him) has granted me," even though he was among the very wealthy people.
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs did not record it.

Technical note: In manuscripts (z) and (s) the word is "shajarah" (tree).

(2) حديث صحيح، وهذا إسناد حسن من أجل عبد الرحمن بن إسحاق - وهو ابن عبد الله بن الحارث القرشي المدني - وقد توبع. أبو بكر بن إسحاق: اسمه أحمد، وأبو المثنى: هو معاذ بن المثنى.
Grading: The hadith is sahih, and the chain is "hasan" because of 'Abd al-Rahman bin Ishaq, and he is also corroborated (mutaba'ah).
Technical note: Abu Bakr bin Ishaq's name is Ahmad, and Abu al-Muthanna is Mu'adh bin al-Muthanna.
وأخرجه البزار (1126)، والبيهقي 5/ 199 من طريقين عن بشر بن المفضل، بهذا الإسناد.
Reference / Source: It was narrated by al-Bazzar (1126) and al-Bayhaqi (5/199) through two routes from Bishr bin al-Mufaddal, with this same chain.
ووقع في مسند البزار تسمية والد عبد الرحمن بن إسحاق: إسحاق بن سالم، وهو خطأ قديم، صوابه كما قال البيهقي بإثره: أبوه إسحاق بن الحارث القرشي.
Technical note / Defect ('illah): In Musnad al-Bazzar the name of 'Abd al-Rahman's father is written "Ishaq bin Salim", which is an old error; the correct name is "Ishaq bin al-Harith al-Qurashi", as al-Bayhaqi stated explicitly.
وأخرج أحمد 3/ (1460)، وأبو داود (2037) من طريق سليمان بن أبي عبد الله قال: رأيت سعد بن أبي وقاص أخذ رجلًا يصيد في حرم المدينة الذي حرم رسولُ الله ﷺ فسلبه ثيابه، فجاء مواليه فكلموه فيه، فقال: إنَّ رسول الله ﷺ حرَّم هذا الحرم، وقال: "من أخذ أحدًا يصيد فيه فليسلبه ثيابه"، فلا أردُّ عليكم طُعمةً أطعمنيها رسول الله ﷺ، ولكن إن شئتم دفعت إليكم ثمنه. ¤ ¤ وأخرج أبو داود (2038) من طريق صالح مولى التوأمة عن مولىً لسعد: أنَّ سعدًا وجد عبيدًا من عبيد المدينة يقطعون من شجر المدينة، فأخذ متاعهم وقال - يعني لمواليهم -: سمعت رسول الله ﷺ ينهى أن يُقطَع من شجر المدينة شيء، وقال: "من قطع منه شيئًا فلمن أخذه سَلَبُه".
Reference / Source: Ahmad and Abu Dawud narrated that Sa'd bin Abi Waqqas (may Allah be pleased with him) seized the belongings of a man who was hunting in the sanctuary (haram) of Madinah and said: The Prophet (peace and blessings be upon him) declared Madinah a sanctuary and said that whoever hunts here, his belongings are to be seized.
Reference / Source: In another narration of Abu Dawud it is stated that he also seized the belongings of those cutting trees on the same basis.
