Mustadrak al-Hakim — Hadith 134

حدثنا أبو العباس محمد بن يعقوب، حدثنا أبو جعفر محمد بن علي الورَّاق ولقبُه حمدان، حدثنا أبو سَلَمة موسى بن إسماعيل، حدثنا حماد بن سلمة، حدثنا يونس بن عُبَيد، عن الحسن، عن أبي بَكْرة، أنَّ رسول الله ﷺ قال: "مَن قتل نفسًا مُعاهَدة بغير حقِّها، لم يَجِدْ رائحة الجنة، وإن رائحتها لتُوجَد من مَسيرة خمس مئة عام" (1).
هذا حديث صحيح على شرط مسلم، ولم يُخرجاه. وقد وَجَدْنا لحمّاد بن سلمة شاهدًا فيه:

It is narrated from Sayyiduna Abu Bakrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever unjustly kills a mu'ahad (a non-Muslim under a covenant of protection or granted refuge) will not even find the fragrance of Paradise, although its fragrance is perceived from a distance of five hundred years' travel."
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two of them did not record it. We have found a supporting narration for Hammad bin Salamah in it:

(1) إسناده صحيح، لكن قوله فيه: "خمس مئة عام" شاذٌّ، والمحفوظ في حديث أبي بكرة: "مئة عام". الحسن: هو ابن أبي الحسن البصري.
Grading: Its chain is sahih.
Technical note / Defect ('illah): The words "five hundred years" in this narration are shadh (not preserved), whereas the preserved wording in the hadith of Abu Bakrah (may Allah be pleased with him) is "a hundred years".
Note / Clarification: Al-Hasan in the chain is "al-Hasan al-Basri".
وأخرجه النسائي (8691) من طريق حجاج بن منهال، وابن حبان مختصرًا (4881) من طريق أحمد بن يحيى الطويل، كلاهما سلمة، بهذا الإسناد ـ ولم يذكر فيه أحمد الطويل قوله: "وإنَّ رائحتها … " إلخ.
Reference / Source: Imam al-Nasa'i narrated it (8691) via Hajjaj bin Minhal, and Imam Ibn Hibban in abridged form (4881) via Ahmad bin Yahya al-Tawil, both of them from (Hammad bin) Salamah with this same chain.
Note / Clarification: The words "and its fragrance …" are not mentioned in Ahmad al-Tawil's narration.
وأخرجه ابن حبان (7382) من طريق حماد بن زيد عن يونس بن عبيد، به - وقال فيه حماد بن زيد: "من مسيرة مئة عام"، وهو المحفوظ، فحماد بن زيد أثبت وأتقن من حماد بن سلمة، لكن تابع حماد ابن سلمة على لفظه شَريكُ بن الخطّاب في الحديث التالي عند المصنف، وشريك قد وثقه المصنف لاحقًا وذكره ابن حبان في "ثقاته" 8/ 311، ولم يؤثر توثيقه عن غيرهما، وهما معروفان بالتساهل.
Reference / Source: Imam Ibn Hibban (7382) narrated it through the chain of Hammad bin Zayd from Yunus bin Ubayd.
Grading: Hammad bin Zayd's narration has the words "from a distance of a hundred years", and this is what is "preserved" (mahfuz, correct).
Technical note / Defect ('illah): Hammad bin Zayd is more trustworthy and more precise than Hammad bin Salamah. However, in the author's next narration Sharik bin al-Khattab corroborated Hammad bin Salamah's wording (500 years).
Note / Clarification: The author (Imam al-Hakim) declared Sharik trustworthy and Ibn Hibban mentioned him in "al-Thiqat" (8/311), but both of these imams are known for leniency in declaring narrators trustworthy.
وأخرجه أحمد 34 / (20469) من طريق قتادة وغير واحد، وابن حبان (7383) من طريق هشام بن حسان، جميعهم عن الحسن البصري، به ـ قال قتادة فيه: "مئة عام"، وقال هشام: "خمس مئة عام"، وفي الطريق إلى هشام مسلمُ بن أبي مسلم الجرمي، قال فيه ابن حبان في "ثقاته": ربما أخطأ. وسيأتي من طريق قتادة عند المصنف برقم (2611).
Reference / Source: Imam Ahmad narrated it (34/20469) via Qatadah and others, and Ibn Hibban (7383) via Hisham bin Hassan, all of them narrating from al-Hasan al-Basri.
Grading: Qatadah's narration mentions "a hundred years", whereas Hisham's narration mentions "five hundred years".
Technical note / Defect ('illah): The chain to Hisham includes Muslim bin Abi Muslim al-Jarmi, about whom Ibn Hibban says, "he sometimes made mistakes".
Important point: Through the route of Qatadah this narration will come ahead at number (2611).
وسيأتي مختصرًا برقم (2663) من طريق عبد الرحمن بن جوشن عن أبي بكرة.
Important point: This narration will come in abridged form ahead at number (2663) through the route of Abd al-Rahman bin Jawshan from Abu Bakrah (may Allah be pleased with him).
وله شاهد من حديث عبد الله بن عمرو عند البخاري برقم (3166) و (6914)، وقال فيه: ¤ ¤ "من مسيرة أربعين عامًا".
Corroborating chains and supporting reports: One supporting report for it is the hadith of Abdullah bin Amr (may Allah be pleased with them both), which is in Sahih al-Bukhari (3166, 6914), and it has the words "a distance of forty years".
