Regarding a Man Who Dies Leaving a Son, Father, and Mawla, Then the Mawla Dies Leaving Wealth

Qatadah narrates from Hazrat Shurayh and Zayd bin Thabit regarding a man who dies and leaves behind his son, father, and mawla. Then the mawla dies and leaves wealth. Hazrat Shurayh said that one-sixth of the wealth is for the father and the rest is for the son, while Zayd bin Thabit said that the wealth is for the son and nothing is for the father.

33666 - And Zayd ibn Thabit said: The wealth belongs to the son, and the father has nothing (1).

Mughira reports that I asked Ibrahim about a man who emancipated his slave, then he (the emancipator) died and the freed slave also died, and the one who had freed him left behind his father and son. Ibrahim said that one-sixth of the wealth is for his father and the remainder is for his son.

Mansoor Hasan narrates that he said: It is for the son.

Muhammad bin Salim narrates from Sha'bi that he also used to say the same.

Shu’bah says: I heard Hakam and Hammad say that it is for the son.

Shu’bah says: I asked Hakam, Hammad, and Abu Iyas Mu’awiyah bin Qurrah about the woman who freed her slave, then she died and left behind her father and her son. All of them said that the wala’ (right of inheritance from the freed slave) is for the son, and Abu Iyas said in this way: the wala’ is for her offspring as long as any of them remain.

33672 - Abu Iyas said: The wala’ belongs to her child as long as any of them remain.

Ibn Jurayj narrates from Ata that wala’ is for the son.

Sufyan says that this statement reached me from Zaid bin Thabit, he said: The right of wala’ is for the son.

Sufyan narrates from Hammad that he said: "Wala' is for the son," and this is also the statement of Sufyan.

33676 - And this is the statement of Sufyan.

Abu Ma'shar says that Ibrahim used to say that for the father there is one-sixth of the wala', and for the son the remaining five parts. Shu'bah says that I asked Abu Ma'shar, "Have you heard Ibrahim say this?" He replied, "I have heard it." And Mughira says that I have heard Ibrahim say this.

33678 - Shu’bah said: I said to Abu Ma’shar: Did you hear it from Ibrahim saying it? He said: I heard it. And Mughira said: I heard it from Ibrahim saying it.

Shu'bi narrates that Shurayh used to say that wala' is like property.

Sha'bi narrates from Shurayh through another chain that he used to consider wala' as equivalent to property.
