Mu'jam Kabir Tabarani 6307 — The Messenger of Allah ﷺ judged

حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الدَّبَرِيُّ، عَنْ عَبْدِ الرَّزَّاقِ، عَنْ مَعْمَرٍ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ قَبِيصَةَ بْنِ حُرَيْثٍ، عَنْ سَلَمَةَ بْنِ الْمُحَبِّقِ، قَالَ: قَضَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي رَجُلٍ وَطَأَ جَارِيَةَ امْرَأَتَهِ: «إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ، وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا، وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لَهُ أَمَةٌ، وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا»
Sayyiduna Salamah bin al-Muhabbiq (may Allah be pleased with him) narrates: The Messenger of Allah (peace and blessings be upon him) judged concerning a man who had intercourse with his wife's slave-girl: "If he forced her, she becomes free, and he owes her mistress the like of her; and if she yielded to him willingly, she remains his slave-girl, and he owes her mistress the like of her."
