Muhammad bin Yahya bin Habban (may Allah have mercy on him) related that a slave stole a palm seedling from a man's garden and planted it in his master's garden. The owner of the seedling went out looking for his seedling and found it, so he sought redress against the slave from Marwan bin al-Hakam. Marwan imprisoned the slave and wanted to cut off his hand. The slave's master went to Sayyiduna Rafi' bin Khadij (may Allah be pleased with him) and asked him about that, and he informed him that he had heard the Messenger of Allah (peace and blessings be upon him) say: "There is no cutting off (of the hand) for (stealing) fruit or the palm-pith."
