بَابُ مَا يحرم مِنْ النساء

قَالَ إِسْحَاقُ : أَخْبَرَنَا يَحْيَى بْنُ آدَمَ ، ثَنَا شَرِيكٌ ، عَنْ جَابِرٍ ، عَنْ أَبِي جَعْفَرٍ ، قَالَ : أَخَذَ عَلِيٌّ رَضِيَ اللهُ عَنْهُ بِيَدِ كَعْبِ بْنِ عُجْرَةَ رَضِيَ اللهُ عَنْهُ ، فَأَقَامَهُ بَيْنَ السِّمَاطَيْنِ ، فَقَالَ لَهُ : حَدِّثْ بِمَا سَمِعْتَ مِنْ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ ! فَقَالَ رَضِيَ اللهُ عَنْهُ : سَمِعْتُهُ يَقُولُ : " لَا تَحِلُّ ابْنَةُ الْأَخِ وَابْنَةُ الْأُخْتِ مِنَ الرَّضَاعَةِ " .
هَذَا الْإِسْنَادُ ضَعِيفٌ ، وَجَابِرٌ هُوَ الْجُعْفِيُّ ضَعِيفٌ بِمَرَّةٍ ، وَأَبُو جَعْفَرٍ لَمْ يَسْمَعْ مِنْ عَلِيٍّ ، وَلَا مِنْ كَعْبٍ رَضِيَ اللهُ عَنْهُمَا .
هَذَا الْإِسْنَادُ ضَعِيفٌ ، وَجَابِرٌ هُوَ الْجُعْفِيُّ ضَعِيفٌ بِمَرَّةٍ ، وَأَبُو جَعْفَرٍ لَمْ يَسْمَعْ مِنْ عَلِيٍّ ، وَلَا مِنْ كَعْبٍ رَضِيَ اللهُ عَنْهُمَا .
Sayyiduna Ali (may Allah be pleased with him) took the hand of Sayyiduna Ka'b bin Ujrah (may Allah be pleased with him), made him stand between two rows, and said to him: "Narrate what (hadith) you heard from the Messenger of Allah (peace and blessings be upon him)!" So he related: I heard him (peace and blessings be upon him) saying: "A brother's daughter and a sister's daughter through suckling (a foster relationship) are not lawful (to marry)." This chain is da'if (weak); its narrator Jabir (bin Yazid) al-Ju'fi is very weak, and Imam Abu Ja'far's hearing from Sayyiduna Ali and Sayyiduna Ka'b (may Allah be pleased with them both) is not established.
وَقَالَ أَبُو يَعْلَى : حَدَّثَنَا أَبُو خَيْثَمَةَ ، ثَنَا أَبُو عَلِيٍّ الْحَنَفِيُّ ، ثَنَا ابْنُ مَوْهَبٍ ، قَالَ : سَمِعْتُ مَالِكَ بْنَ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ يُحَدِّثُ ، عَنْ عَمْرَةَ ، عَنْ عَائِشَةَ رَضِيَ اللهُ عَنْهَا ، قَالَتْ : وُجِدَ فِي قَائِمِ سَيْفِ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ ... فَذَكَرَتِ الْحَدِيثَ ، قَالَتْ : وَفِي الْآخِرِ : " وَلَا تُنْكَحُ الْمَرْأَةُ عَلَى عَمَّتِهَا وَلَا عَلَى خَالَتِهَا ، وَلَا تُسَافِرُ الْمَرْأَةُ ثَلَاثَ لَيَالٍ مَعَ غَيْرِ ذِي مَحْرَمٍ ".
It is narrated from Sayyidah Aishah (may Allah be pleased with her) that a writing was found in the hilt of the sword of the Messenger of Allah (peace and blessings be upon him). Then she narrated the full hadith, in the last part of which was written: "A woman shall not be married (as a co-wife) alongside her paternal aunt or her maternal aunt, and no woman shall travel a distance of three nights without her mahram."
وَقَالَ مُسَدَّدٌ : حَدَّثَنَا مُعَاذُ بْنُ هِشَامٍ ، ثَنَا أَبِي ، عَنْ عَامِرٍ الْأَحْوَلِ ، عَنِ الْحَسَنِ رَضِيَ اللهُ عَنْهُ ، قَالَ : " نَهَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنْ تُنْكَحَ الْأَمَةُ عَلَى الْحُرَّةِ ".
It is narrated from al-Hasan (al-Basri) (may Allah have mercy on him) that "The Messenger of Allah (peace and blessings be upon him) forbade marrying a slave woman in addition to a free woman (already in one's marriage)."
حَدَّثَنَا سُفْيَانُ ، عَنْ عَمْرِو بْنِ دِينَارٍ ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللهُ عَنْهُمَا ، قَالَ : " نِكَاحُ الْحُرَّةِ عَلَى الْأَمَةِ طَلَاقُ الْأَمَةِ ".
It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that he said: "Marrying a free woman in addition to a slave woman (while she is in one's marriage) is (equivalent to) divorce for the slave woman."
حَدَّثَنَا يَحْيَى ، عَنِ ابْنِ أَبِي عَرُوبَةَ ، عَنْ مَطَرٍ الْوَرَّاقِ ، عَنِ الْحَسَنِ ، عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ رَضِيَ اللهُ عَنْهُ ، قَالَ : " أَيُّمَا رَجُلٍ تَزَوَّجَ وَهُوَ مُحْرِمٌ انْتَزَعْنَا مِنْهُ امْرَأَتَهُ ، وَلَمْ نُجِزْ نِكَاحَهُ ".
It is narrated from Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) that he said: "Any man who marries while he is in the state of ihram, we will separate his wife from him, and we will not consider that marriage of his valid."
قَالَ الْحَارِثُ : حَدَّثَنَا يَعْقُوبُ بْنُ مُحَمَّدٍ ، ثَنَا مُحَمَّدُ بْنُ حُجْرٍ ، ثَنَا سَعِيدُ بْنُ عَبْدِ الْجَبَّارِ بْنِ وَائِلِ بْنِ حُجْرٍ ، عَنْ أَبِيهِ ، عَنْ وَائِلٍ رَضِيَ اللهُ عَنْهُ ، قَالَ: إِنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ كَتَبَ كِتَابًا فِيهِ : " لَا جَلَبَ ، وَلَا جَنَبَ ، وَلَا وِرَاطَ ، وَلَا شِغَارَ فِي الْإِسْلَامِ ، وَكُلُّ مُسْكِرٍ حَرَامٌ ، وَمَنْ أَجْبَا فَقَدْ أَرْبَا ".
It is narrated from Sayyiduna Wa'il bin Hujr (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) wrote a decree in which it was stated: "In Islam it is not permitted to drive animals far away (for the collection of zakah) (jalab), nor for the collector to stay far from the settlement and force the owners of livestock to come to him there (janab); nor is it right to mix animals together to avoid zakah (wirat); and the exchange marriage (shighar) is forbidden in Islam. Moreover, every intoxicant is unlawful, and whoever sold grain (before its ripeness and soundness became evident) has certainly engaged in usury (riba)."
وَقَالَ أَبُو يَعْلَى : حَدَّثَنَا أَبُو الرَّبِيعِ ، ثَنَا حَمَّادٌ ، عَنْ أَيُّوبَ ، عَنْ نَافِعٍ ، عَنْ نُبَيْهِ بْنِ وَهْبٍ ، عَنْ أَبَانَ بْنِ عُثْمَانَ ، قَالَ : " الْمُحْرِمُ لَا يَنْكِحُ ، وَلَا يَخْطُبُ عَلَى نَفْسِهِ ، وَلَا عَلَى مَنْ سِوَاهُ ".
It is narrated from Aban bin Uthman (may Allah have mercy on him) that he said: "A person in the state of ihram should neither marry himself nor send a proposal of marriage, either for himself or for anyone else."
