The inheritance of the grandfather

الْحَارِثُ : حَدَّثَنَا إِسْحَاقُ - يَعْنِي الطَّبَّاعَ - ثَنَا أَبُو مَعْشَرٍ ، عَنْ عِيسَى بْنِ أَبِي عِيسَى ، قَالَ : إِنَّ زَيْدَ بْنَ ثَابِتٍ - رَضِيَ اللهُ عَنْهُ - قَالَ لِعُمَرَ - رَضِيَ اللهُ عَنْهُ - : أَعْطَى رَسُولُ اللهِ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - الْجَدَّ سُدُسَ الْمَالِ مَعَ الْوَلَدِ الذَّكَرِ ، وَمَعَ الْأَخِ الْوَاحِدِ النِّصْفَ ، وَمَعَ الِاثْنَيْنِ فَصَاعِدًا الثُّلُثَ ، وَإِذَا لَمْ يَكُنْ وَارِثٌ غَيْرُهُ فَأَعْطَاهُ الْمَالَ كُلَّهُ .
It is narrated from Sayyiduna Zayd bin Thabit (may Allah be pleased with him) that he told Sayyiduna Umar (may Allah be pleased with him): "The Messenger of Allah (peace and blessings be upon him) gave the grandfather one sixth of the estate when there was a male child, half when there was one brother, and one third in the case of two or more brothers; and if the deceased had no heir other than the grandfather, he (peace and blessings be upon him) would give him the entire wealth."
وَقَالَ أَبُو بَكْرٍ : حَدَّثَنَا قَبِيصَةُ ، ثَنَا سُفْيَانُ ، عَنْ زَيْدِ بْنِ أَسْلَمَ ، عَنْ عِيَاضٍ ، عَنْ أَبِي سَعِيدٍ - رَضِيَ اللهُ عَنْهُ - قَالَ : كُنَّا نُوَرِّثُهُ عَلَى عَهْدِ رَسُولِ اللهِ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - يَعْنِي الْجَدَّ .
1533 \ 2 - وَقَالَ أَبُو يَعْلَى : حَدَّثَنَا أَبُو بَكْرٍ بِهَذَا .
1533 \ 3 - وَقَالَ الْبَزَّارُ : حَدَّثَنَا ابْنُ عُمَرَ بْنِ هَيَّاجٍ ، ثَنَا قَبِيصَةُ . قَالَ الْبَزَّارُ : لَا نَعْلَمُهُ بِهَذَا اللَّفْظِ عَنْ أَبِي سَعِيدٍ - رَضِيَ اللهُ عَنْهُ - إِلَّا مِنْ هَذَا الْوَجْهِ ، وَأَحْسَبُ أَنَّ قَبِيصَةَ أَخْطَأَ فِي لَفْظِهِ ، وَإِنَّمَا كَانَ عِنْدَهُ : كُنَّا نُؤَدِّيهِ - يَعْنِي الْفِطْرَ - وَلَمْ يُتَابَعْ قَبِيصَةُ عَلَى هَذَا .
1533 \ 2 - وَقَالَ أَبُو يَعْلَى : حَدَّثَنَا أَبُو بَكْرٍ بِهَذَا .
1533 \ 3 - وَقَالَ الْبَزَّارُ : حَدَّثَنَا ابْنُ عُمَرَ بْنِ هَيَّاجٍ ، ثَنَا قَبِيصَةُ . قَالَ الْبَزَّارُ : لَا نَعْلَمُهُ بِهَذَا اللَّفْظِ عَنْ أَبِي سَعِيدٍ - رَضِيَ اللهُ عَنْهُ - إِلَّا مِنْ هَذَا الْوَجْهِ ، وَأَحْسَبُ أَنَّ قَبِيصَةَ أَخْطَأَ فِي لَفْظِهِ ، وَإِنَّمَا كَانَ عِنْدَهُ : كُنَّا نُؤَدِّيهِ - يَعْنِي الْفِطْرَ - وَلَمْ يُتَابَعْ قَبِيصَةُ عَلَى هَذَا .
It is narrated from Sayyiduna Abu Sa'id al-Khudri (may Allah be pleased with him) that he said: "In the blessed time of the Messenger of Allah (peace and blessings be upon him) we used to make him (i.e. the grandfather) an heir." Imam al-Bazzar said: We do not know this narration with these words from Sayyiduna Abu Sa'id (may Allah be pleased with him) except through this route, and I think the narrator Qabisah made an error in conveying these words, because in fact the words he had were: "We used to pay it (i.e. Sadaqat al-Fitr)"; and no other narrator corroborated Qabisah in narrating these particular words.
