بَابُ لَا زَكَاةَ فِي مَالٍ حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ

إِسْحَاقُ : أَخْبَرَنَا أَبُو خَالِدٍ ، حَدَّثَنَا إِسْمَاعِيلُ بْنُ مُسْلِمٍ ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرِ بْنِ عَبْدِ اللهِ ، عَنْ أَبِي بَكْرٍ الصِّدِّيقِ - رَضِيَ اللهُ عَنْهُمْ - أَنَّهُ أَعْطَى جَابِرًا - رَضِيَ اللهُ عَنْهُ - عِدَّةً كَانَتْ لَهُ عِنْدَ رَسُولِ اللهِ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - قَالَ : وَأَزِيدُكَ أَنَّهُ لَا زَكَاةَ فِيهِ حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ .
إِسْمَاعِيلُ هُوَ الْمَكِّيُّ ، فِيهِ ضَعْفٌ ، وَالْعِدَّةُ مَذْكُورَةٌ فِي الصَّحِيحِ بِغَيْرِ هَذَا السِّيَاقِ .

Sayyiduna Jabir bin Abdullah (may Allah be pleased with him) narrates from Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him) that he gave Sayyiduna Jabir (may Allah be pleased with him) the gift (in the form of wealth) that the Messenger of Allah (peace and blessings be upon him) had promised him. Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him) also said: "I will tell you something more: no zakah is due on this wealth until a full year has passed over it."

وَقَالَ مُسَدَّدٌ : حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ إِبْرَاهِيمَ بْنِ عُقْبَةَ ، عَنْ مُحَمَّدِ بْنِ عُقْبَةَ هُوَ أَخُوهُ ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ ، قَالَ : إِنَّ أَبَا بَكْرٍ الصِّدِّيقَ - رَضِيَ اللهُ عَنْهُ - كَانَ إِذَا أَعْطَى الرَّجُلَ عَطَاءً قَالَ : هَلْ لَكَ مَالٌ ؟ فَإِنْ قَالَ : نَعَمْ ، قَالَ : أَدِّ زَكَاتَهُ ، فَإِذْ لَمْ يَكُنْ لَهُ مَالٌ قَالَ : لَا تُزَكِّهِ ، يَعْنِي مَالَ الْعَطَاءِ ، حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ .
قُلْتُ : إِسْنَادُهُ صَحِيحٌ ، إِلَّا أَنَّهُ مُنْقَطِعٌ بَيْنَ الْقَاسِمِ وَجَدِّهِ الصِّدِّيقِ - رَضِيَ اللهُ عَنْهُ - .

It is narrated from al-Qasim bin Muhammad (may Allah have mercy on him) that whenever Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him) gave a man a state stipend or gift, he would ask him: "Do you already have wealth?" If the man said: "Yes," he would say: "(Then) pay its zakah." But if he had no wealth beforehand, he would say that no zakah was due on the wealth of this gift until a year had passed over it.
I (Ibn Hajar) say: Its chain is sahih (authentic), except that it is broken (munqati') between al-Qasim and his grandfather Sayyiduna al-Siddiq al-Akbar (may Allah be pleased with him) (that is, his hearing from him is not established).
