قَالَ مُسَدَّدٌ : حَدَّثَنَا يَحْيَى ، عَنِ ابْنِ جُرَيْجٍ ، ثَنَا عَمْرُو بْنُ دِينَارٍ ، وَأَبُو الزُّبَيْرِ ، أَنَّهُمَا سَمِعَا شُرَيْحًا قَالَ : كُلُّ شَيْءٍ فِي الْبَحْرِ مَذْبُوحٌ . قَالَ : فَذَكَرْتُ ذَلِكَ لِعَطَاءٍ فَقَالَ : أَمَّا الطَّيْرُ فَأَرَى أَنْ تَذْبَحَهُ .
It is narrated from Amr bin Dinar and Abu al-Zubayr that they heard Qadi Shurayh (may Allah have mercy on him) say: "Everything that is (found) in the sea is slaughtered (that is, lawful)." The narrator (Ibn Jurayj) says: I mentioned this (what Shurayh said) to Imam Ata' (may Allah have mercy on him), and he said: "As for sea birds, my view is that they should be slaughtered."
