It is narrated from Abu al-Malih (may Allah have mercy on him) that Haml bin al-Nabighah had two wives, named Mulaykah and Umm Afif. One of them hurled a stone at the other which struck her side (the middle part of the body), as a result of which she miscarried a dead child. When this case was brought before the blessed presence of the Messenger of Allah (peace and blessings be upon him), he (peace and blessings be upon him) ruled: "The payment of the blood-money (diyah) is binding upon the aqilah (the men of the tribe) of the woman who killed, and for the unborn child a 'ghurrah' must be given, that is, a male or female slave, or ten camels, or one hundred goats." At this her (the killer's) guardian or father said: "O Messenger of Allah, what penalty for one who neither ate, nor drank, nor was born and cried out? In such a case the compensation ought to be void." Then the Messenger of Allah (peace and blessings be upon him) said (in response to his rhymed speech of the days of Ignorance): "We have nothing to do with the rhymed speech (rhyming phrases) of the days of Ignorance (Jahiliyyah)."
