Al-Matalib al-'Aliyah 1876 — Discretionary punishment for one

It is narrated from Sayyiduna Abu Sa'id (may Allah be pleased with him), the freed slave (mawla) of Sayyiduna Abu Usayd, that in Makkah some people were sitting near the tent of Sayyidah Aishah (may Allah be pleased with her) when Sayyiduna Uthman (may Allah be pleased with him) passed by. Abu Sa'id (may Allah be pleased with him) said: Apart from me, everyone present there reviled him or cursed him. Among them was a native of Kufah, with whom Sayyiduna Uthman (may Allah be pleased with him) was angrier than with the others, and, as though threatening him, he said, "O Kufan! Do you revile me?" The narrator said: When that Kufan came to Madinah, he was advised, "Turn to Sayyiduna Talhah (may Allah be pleased with him)." So Sayyiduna Talhah (may Allah be pleased with him) took him along and came to Sayyiduna Uthman (may Allah be pleased with him), and Sayyiduna Uthman (may Allah be pleased with him) said (in a stern tone), "By Allah, I will certainly give you a hundred lashes." Sayyiduna Talhah (may Allah be pleased with him) promptly replied, "By Allah, you cannot flog him unless he is proven to be a fornicator." Sayyiduna Uthman (may Allah be pleased with him) said, "Then I will stop your stipend from the treasury." At this Sayyiduna Talhah (may Allah be pleased with him) said to that man, "O Kufan! (Do not worry,) Allah will provide for you."
