Ikrimah, the freed slave of Sayyiduna Ibn Abbas (may Allah be pleased with them both), relates that Sayyiduna Ali (may Allah be pleased with him) issued this ruling concerning a muhrim (a person in the state of ihram) who breaks ostrich eggs: "Let the stallion loose upon your she-camels, then when their pregnancy becomes evident, designate (the young to be born) in the same number as the eggs you destroyed, and say that these are 'hady' (sacrificial animals); you are not responsible for guaranteeing their safety. So those of them that are born healthy will serve as the expiation, and for those that are lost there is no burden upon you, because this matter is just like that of eggs: some of them turn out useful and some go bad." The narrator says: Sayyiduna Mu'awiyah (may Allah be pleased with him) expressed surprise at this insightful ruling of Sayyiduna Ali (may Allah be pleased with him), whereupon Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: "Rather than this ijtihad, Sayyiduna Mu'awiyah (may Allah be pleased with him) prefers only the method in which an amount equal to the market price of those eggs is given in charity."
