عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو وَسَهْلِ بْنِ أَبِي حَثْمَةَ قَالَ : كَانَتْ حَبِيبَةُ [ بِنْتُ سَهْلٍ ] تَحْتَ ثَابِتِ بْنِ قَيْسِ بْنِ شِمَاسٍ الْأَنْصَارِيِّ فَكَرِهَتْهُ ، وَكَانَ رَجُلًا دَمِيمًا ، فَجَاءَتْ إِلَى النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَقَالَتْ : يَا رَسُولَ اللَّهِ إِنِّي لِأَرَاهُ فَلَوْلَا مَخَافَةُ اللَّهِ - عَزَّ وَجَلَّ - لَبَزَقْتُ فِي وَجْهِهِ ، فَقَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَتَرُدِّينَ عَلَيْهِ حَدِيقَتَهُ الَّتِي أَصْدَقَكِ ؟ " قَالَتْ : نَعَمْ ، فَأَرْسَلَ إِلَيْهِ فَرَدَّتْ عَلَيْهِ حَدِيقَتَهُ ، وَفَرَّقَ بَيْنَهُمَا ، فَكَانَ ذَلِكَ أَوَّلَ خُلْعٍ كَانَ فِي الْإِسْلَامِ .
رَوَاهُ أَحْمَدُ ، وَالْبَزَّارُ ، وَالطَّبَرَانِيُّ ، وَفِيهِ الْحَجَّاجُ بْنُ أَرْطَاةَ ، وَهُوَ مُدَلِّسٌ .
Sayyiduna Abdullah bin Amr (may Allah be pleased with him) and Sayyiduna Sahl bin Abi Hathmah (may Allah be pleased with him) narrate: A woman named Habibah bint Sahl was the wife of Sayyiduna Thabit bin Qays bin Shammas (may Allah be pleased with him). She disliked him because he was an unattractive man. She came to the Prophet (peace and blessings be upon him) and said, "I have seen him; were it not for the fear of Allah, I would have spat in his face." The Prophet (peace and blessings be upon him) said, "Will you return to him his garden which he gave you as your dowry?" She replied, "Yes!" The Prophet (peace and blessings be upon him) sent for him, and she returned his garden to him, and the Prophet (peace and blessings be upon him) separated the two of them. This was the first khul' that took place in Islam.
Ahmad, al-Bazzar and Tabarani recorded it. Its chain contains a narrator, Hajjaj bin Artah, and he is a mudallis.

وَعَنْ أَنَسٍ قَالَ : جَاءَتِ امْرَأَةُ ثَابِتِ بْنِ شِمَاسٍ ، وَهُوَ ثَابِتُ بْنُ قَيْسِ بْنِ شِمَاسٍ إِلَى رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَقَالَتْ كَلَامًا كَأَنَّهَا كَرِهَتْهُ ، فَقَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " تَرُدِّينَ عَلَيْهِ حَدِيقَتَهُ ؟ " قَالَتْ : نَعَمْ ، فَأَرْسَلَ النَّبِيُّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - إِلَى ثَابِتٍ : " خُذْ مِنْهَا ذَلِكَ " أَحْسَبُهُ قَالَ : " وَطَلِّقْهَا " .
رَوَاهُ الْبَزَّارُ وَفِيهِ أَبُو جَعْفَرٍ الرَّازِيُّ وَهُوَ ثِقَةٌ وَفِيهِ ضَعْفٌ .
Sayyiduna Anas (may Allah be pleased with him) narrates: The wife of Sayyiduna Thabit bin Shammas (may Allah be pleased with him) came, and he is Sayyiduna Thabit bin Qays bin Shammas (may Allah be pleased with him). She came to the Prophet (peace and blessings be upon him) and said something in which she expressed her dislike of Sayyiduna Thabit bin Qays (may Allah be pleased with him). The Prophet (peace and blessings be upon him) said, "Will you return his garden to him?" She replied, "Yes." So the Prophet (peace and blessings be upon him) sent a message to Sayyiduna Thabit (may Allah be pleased with him) and said, "Take that garden back from her" (the narrator says: I think these words are also in the narration) "and divorce her."
Al-Bazzar recorded it. Its chain contains a narrator, Abu Ja'far al-Razi, and he is thiqah (trustworthy), but there is some weakness in him.

وَعَنْ عُقْبَةَ بْنِ عَامِرٍ قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنَّ الْمُخْتَلِعَاتِ وَالْمُنْتَزِعَاتِ هُنَّ الْمُنَافِقَاتُ " .
رَوَاهُ الطَّبَرَانِيُّ ، وَفِيهِ قَيْسُ بْنُ الرَّبِيعِ ، وَثَّقَهُ الثَّوْرِيُّ وَشُعْبَةُ وَفِيهِ ضَعْفٌ ، وَبَقِيَّةُ رِجَالِهِ رِجَالُ الصَّحِيحِ .
Sayyiduna Uqbah bin Amir (may Allah be pleased with him) narrates that the Prophet (peace and blessings be upon him) said: "The women who seek khul' and those who pull away (from their husbands) are indeed the hypocrites."
Tabarani recorded it. Its chain contains a narrator, Qays bin al-Rabi', whom al-Thawri and Shu'bah declared thiqah (trustworthy), but there is some weakness in him. The rest of the narrators of this narration are the narrators of the Sahih.
