بَابٌ فِيمَنْ نَوَى أَنْ لَا يُؤَدِّيَ صَدَاقَ امْرَأَتِهِ .

عَنْ صُهَيْبِ بْنِ سِنَانٍ قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " أَيُّمَا رَجُلٍ أَصْدَقَ امْرَأَةٍ صَدَاقًا وَاللَّهُ يَعْلَمُ أَنَّهُ لَا يُرِيدُ أَدَاءَهُ إِلَيْهَا فَغَرَّهَا بِاللَّهِ وَاسْتَحَلَّ فَرْجَهَا بِالْبَاطِلِ لَقِيَ اللَّهَ يَوْمَ الْقِيَامَةِ ، وَهُوَ زَانٍ " .
رَوَاهُ أَحْمَدُ ، وَالطَّبَرَانِيُّ ، وَفِي إِسْنَادِ أَحْمَدَ رَجُلٌ لَمْ يُسَمَّ ، وَبَقِيَّةُ رِجَالِهِ ثِقَاتٌ . وَفِي إِسْنَادِ الطَّبَرَانِيِّ مَنْ لَمْ أَعْرِفْهُمْ .
رَوَاهُ أَحْمَدُ ، وَالطَّبَرَانِيُّ ، وَفِي إِسْنَادِ أَحْمَدَ رَجُلٌ لَمْ يُسَمَّ ، وَبَقِيَّةُ رِجَالِهِ ثِقَاتٌ . وَفِي إِسْنَادِ الطَّبَرَانِيِّ مَنْ لَمْ أَعْرِفْهُمْ .
Sayyiduna Suhayb bin Sinan (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) said: "Whoever fixes a dowry for a woman while Allah Almighty knows that he will not pay it to her, and he deceives her in the name of Allah and makes her private part lawful for himself falsely, when that man appears before Allah Almighty on the Day of Resurrection, he will be (counted as) a fornicator."

وَعَنْ أَبِي هُرَيْرَةَ أَنَّهُ قَالَ : عِنْدِي عَنْ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - حَدِيثَانِ أَحَدُهُمَا أَنَّهُ قَالَ : " مَنْ أَحَبَّ الْأَنْصَارَ أَحَبَّهُ اللَّهُ " .
وَالْآخَرُ : " مَنْ تَزَوَّجَ امْرَأَةً عَلَى صَدَاقٍ ، وَهُوَ لَا يُرِيدُ أَنْ يَفِيَ لَهَا بِهِ فَهُوَ زَانٍ " .

And the other report is: "Whoever marries a woman for a dowry while not intending to pay it to her, that man will be counted as a fornicator."

وَعَنْ مَيْمُونٍ الْكُرْدِيِّ عَنْ أَبِيهِ قَالَ : سَمِعْتُ رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - يَقُولُ : " أَيُّمَا رَجُلٍ تَزَوَّجَ امْرَأَةً عَلَى مَا قَلَّ مِنَ الْمَهْرِ أَوْ كَثُرَ لَيْسَ فِي نَفْسِهِ أَنْ يُؤَدِّيَ إِلَيْهَا حَقَّهَا خَدَعَهَا فَمَاتَ ، وَلَمْ يُؤَدِّ إِلَيْهَا حَقَّهَا لَقِيَ اللَّهَ يَوْمَ الْقِيَامَةِ ، وَهُوَ زَانٍ " .

Maymun al-Kurdi narrates from his father: I heard the Prophet (peace and blessings be upon him) saying: "Whoever marries a woman for a dowry, small or large, while it is not in his heart to pay her right to her, deceives that woman; then he dies in that state, not having paid her right to her. On the Day of Resurrection, when he appears before Allah Almighty, he will be counted as a fornicator."
