بَابُ الْمَصْرُورِ، وَمَا يَحِلُّ مِنَ الْمَيْتَةِ .

عَنْ أَبِي وَاقِدٍ قَالَ : قُلْتُ : يَا رَسُولَ اللَّهِ ، إِنَّا بِأَرْضٍ يُصِيبُنَا فِيهَا مَخْمَصَةٌ ، فَمَا يَحِلُّ لَنَا مِنَ الْمَيْتَةِ ؟ قَالَ : " إِذَا لَمْ تَصْطَبِحُوا أَوْ لَمْ تَغْتَبِقُوا ، وَلَمْ تَحْتَفِئُوا بَقْلًا فَشَأْنُكُمْ بِهَا " .
رَوَاهُ أَحْمَدُ بِإِسْنَادَيْنِ رِجَالُ أَحَدِهِمَا رِجَالُ الصَّحِيحِ ، إِلَّا الْمِزِّيُّ قَالَ : لَمْ يَسْمَعْ حَسَّانُ بْنُ عَطِيَّةَ مِنْ أَبِي وَاقِدٍ ، وَاللَّهُ أَعْلَمُ .
رَوَاهُ أَحْمَدُ بِإِسْنَادَيْنِ رِجَالُ أَحَدِهِمَا رِجَالُ الصَّحِيحِ ، إِلَّا الْمِزِّيُّ قَالَ : لَمْ يَسْمَعْ حَسَّانُ بْنُ عَطِيَّةَ مِنْ أَبِي وَاقِدٍ ، وَاللَّهُ أَعْلَمُ .
Sayyiduna Abu Waqid (may Allah be pleased with him) narrates: I said: "O Messenger of Allah! We live in a land where hunger strikes us; so what of carrion is lawful for us?" The Prophet (peace and blessings be upon him) said: "When you cannot get anything in the morning or in the evening, and you cannot gather any herbs, then you may make use of it."
Ahmad recorded it with two chains, the narrators of one of which are the narrators of the Sahih; however, al-Mizzi said that Hassan bin Atiyyah did not hear from Sayyiduna Abu Waqid. And Allah knows best.

وَعَنْ أَبِي وَاقِدٍ : أَنَّ قَوْمًا مَاتَ لَهُمْ بَغْلٌ ، وَلَمْ يَكُنْ لَهُمْ شَيْءٌ يَأْكُلُونَهُ فَجَاءُوا إِلَى رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَرَخَّصَ لَهُمْ فِيهِ .
رَوَاهُ الْبَزَّارُ ، وَرِجَالُهُ رِجَالُ الصَّحِيحِ .

Sayyiduna Abu Waqid (may Allah be pleased with him) narrates: A mule belonging to some people died, and they had nothing to eat. They came to the Prophet (peace and blessings be upon him), and the Prophet (peace and blessings be upon him) granted them a concession regarding it (eating its meat).
