بَابُ بَيْعِ الْمَلَاقِيحِ ، وَالْمَضَامِينِ ، وَحَبَلِ الْحَبَلَةِ .

عَنِ ابْنِ عَبَّاسٍ أَنَّ رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - نَهَى عَنْ بَيْعِ الْمَضَامِينِ ، وَالْمَلَاقِيحِ ، وَحَبَلِ الْحَبَلَةِ .
رَوَاهُ الطَّبَرَانِيُّ فِي الْكَبِيرِ ، وَالْبَزَّارُ ، وَفِيهِ إِبْرَاهِيمُ بْنُ إِسْمَاعِيلَ بْنِ أَبِي حَبِيبَةَ ؛ وَثَّقَهُ أَحْمَدُ ، وَضَعَّفَهُ جُمْهُورُ الْأَئِمَّةِ .
رَوَاهُ الطَّبَرَانِيُّ فِي الْكَبِيرِ ، وَالْبَزَّارُ ، وَفِيهِ إِبْرَاهِيمُ بْنُ إِسْمَاعِيلَ بْنِ أَبِي حَبِيبَةَ ؛ وَثَّقَهُ أَحْمَدُ ، وَضَعَّفَهُ جُمْهُورُ الْأَئِمَّةِ .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates: The Prophet (peace and blessings be upon him) forbade the sale of malaqih (that is, the offspring still in the loins of the male animal), madamin (that is, the offspring still in the womb of the female animal) and habal al-habalah (the offspring of the offspring).
Al-Tabarani recorded it in al-Mu'jam al-Kabir, and al-Bazzar recorded it; its chain contains a narrator Ibrahim bin Isma'il bin Abi Habibah. Ahmad declared him trustworthy, and the majority of the imams declared him da'if (weak).

وَعَنْ أَبِي هُرَيْرَةَ أَنَّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - نَهَى عَنْ بَيْعِ الْمَلَاقِيحِ وَالْمَضَامِينِ .

وَعَنْ عُبَيْدِ بْنِ نَضْلَةَ الْخُزَاعِيِّ قَالَ : أَصَابَ النَّاسَ جُهْدٌ شَدِيدٌ عَلَى عَهْدِ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ : فَعَشَرَ رَجُلٌ بَعِيرًا لَهُ عَشْرًا ، ثُمَّ قَالَ : مَنْ أَحَبَّ أَنْ يَأْخُذَ عَشِيرًا مِنْ هَذَا اللَّحْمِ بِقَلُوصٍ إِلَى حَبَلِ الْحَبَلَةِ ؟ قَالَ : فَأَخَذَ نَاسٌ فَبَلَغَ ذَلِكَ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَأَمَرَ أَنْ يُرَدَّ فَرُدَّ الْبَيْعُ .

Sayyiduna Ubayd bin Nadlah al-Khuza'i (may Allah be pleased with him) narrates: In the blessed time of the Prophet (peace and blessings be upon him), the people were struck by severe hunger. The narrator says: A man divided the meat of his camel into ten portions and then said: Whoever wishes may take a tenth of this meat in exchange for the she-camel that will be born of his pregnant animal. The narrator says: People took the meat on these terms. When the Prophet (peace and blessings be upon him) was informed of this, he said: Let it be cancelled. So that sale was annulled.
