عَنِ ابْنِ عَبَّاسٍ قَالَ : نَهَى رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - يَوْمَ حُنَيْنٍ عَنْ بَيْعِ الْخُمْسِ حَتَّى تُقَسَّمَ .
وَفِيهِ عِصْمَةُ بْنُ الْمُتَوَكِّلِ ، وَهُوَ ضَعِيفٌ .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates: On the occasion of the Battle of Hunayn, the Prophet (peace and blessings be upon him) forbade selling the khumus (one-fifth) before it was distributed. Its chain contains a narrator Ismah bin al-Mutawakkil, who is da'if (weak).

Hadith Takhrij «اخرجه الطبراني فى المعجم الكبير (11145)»
وَعَنْ أَبِي أُمَامَةَ أَنَّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - نَهَى أَنْ تُبَاعَ السِّهَامُ حَتَّى تُقَسَّمَ .
رَوَاهُ الطَّبَرَانِيُّ فِي الْكَبِيرِ ، وَرِجَالُهُ رِجَالُ الصَّحِيحِ .
Sayyiduna Abu Umamah (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) forbade that the shares (of the spoils of war) be sold until they are distributed.
Al-Tabarani recorded it in al-Mu'jam al-Kabir, and its narrators are the narrators of the Sahih.

وَعَنْ عِمْرَانَ بْنِ حَيَّانَ الْأَنْصَارِيِّ ، عَنْ أَبِيهِ قَالَ : خَطَبَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - يَوْمَ خَيْبَرَ فَنَهَاهُمْ أَنْ يُبَاعَ سَهْمٌ مِنْ مَغْنَمٍ حَتَّى يُقَسَّمَ ، وَأَنْ تُوطَأَ الْحَبَالَى حَتَّى يَضَعْنَ ، وَعَنِ الثَّمَرَةِ أَنْ تُبَاعَ حَتَّى يَبْدُوَ صَلَاحُهَا وَيُؤْمَنَ عَلَيْهَا الْعَاهَةُ .
زَادَ دُحَيْمٌ فِي حَدِيثِهِ : وَأَحَلَّ لَهُمْ ثَلَاثَةَ أَشْيَاءَ كَانَ نَهَاهُمْ عَنْهَا : أَحَلَّ لَهُمْ لُحُومَ الْأَضَاحِيِّ وَزِيَارَةَ الْقُبُورِ وَالْأَوْعِيَةِ .
رَوَاهُ الطَّبَرَانِيُّ فِي الْكَبِيرِ . وَعِمْرَانُ لَمْ يَرْوِهِ عَنْهُ غَيْرُ حُمَيْدٍ .
Imran bin Hayyan al-Ansari reports from his father: On the occasion of the Battle of Khaybar, the Prophet (peace and blessings be upon him), while delivering a sermon, forbade the people from selling any share of the spoils of war before it is distributed, from having intercourse with pregnant women until they give birth, and from selling fruit until its ripeness becomes apparent and it is safe from blight. The narrator Duhaym added these words in his narration: The Prophet (peace and blessings be upon him) made lawful for them three things which he had previously forbidden them: he made lawful for them the meat of sacrificial animals, visiting graves, and (using) various kinds of vessels.
Al-Tabarani recorded it in al-Mu'jam al-Kabir; no one other than Humayd narrated it from the narrator Imran.

وَعَنِ الْقَاسِمِ بْنِ عَبْدِ الرَّحْمَنِ أَنْ عَلِيًّا ، وَابْنَ مَسْعُودٍ كَانَا يُجِيزَانِ بَيْعَ الصَّدَقَةِ ، وَلَمْ يُقْبَضْ ، وَكَانَ مُعَاذُ بْنُ جَبَلٍ ، وَشُرَيْحٌ لَا يُجِيزَانِهَا حَتَّى تُقْبَضَ ، وَقَوْلُ مُعَاذٍ ، وَشُرَيْحٍ أَحَبُّ إِلَى سُفْيَانَ .
رَوَاهُ الطَّبَرَانِيُّ فِي الْكَبِيرِ . وَالْقَاسِمُ لَمْ يُدْرِكْ مُعَاذًا . وَفِيهِ جَابِرٌ الْجُعْفِيُّ ، وَثَّقَهُ شُعْبَةُ ، وَغَيْرُهُ ، وَضَعَّفَهُ جُمْهُورُ الْأَئِمَّةِ .
Al-Qasim bin Abd al-Rahman narrates: Sayyiduna Ali (may Allah be pleased with him) and Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) used to regard selling sadaqah (charity) as permissible even if it had not been taken into possession, whereas Sayyiduna Mu'adh bin Jabal (may Allah be pleased with him) and Qadi Shurayh did not regard it as permissible until it had been taken into possession. And the view of Sayyiduna Mu'adh (may Allah be pleased with him) and Qadi Shurayh is preferred by Sufyan.
Al-Tabarani recorded it in al-Mu'jam al-Kabir; the narrator al-Qasim did not meet Sayyiduna Mu'adh (may Allah be pleased with him), and its chain contains a narrator Jabir al-Ju'fi, whom Shu'bah and others declared trustworthy, while the majority of the imams declared him da'if (weak).
