Majma al-Zawaid — Hadith 9737

وَعَنِ الْمِقْدَامِ بْنِ مَعْدِ يَكْرِبَ الْكِنْدِيِّ : أَنَّهُ جَلَسَ مَعَ عُبَادَةَ بْنِ الصَّامِتِ ، رَحِمَهُ اللَّهُ ، وَأَبِي الدَّرْدَاءِ أَوِ الْحَارِثِ بْنِ مُعَاوِيَةَ الْكِنْدِيِّ فَتَذَاكَرُوا حَدِيثَ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَقَالَ أَبُو الدَّرْدَاءِ رَحِمَهُ اللَّهُ لِعُبَادَةَ : يَا عُبَادَةُ كَلِمَاتُ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فِي غَزْوَةٍ فِي شَأْنِ الْأَخْمَاسِ فَقَالَ عُبَادَةُ : إِنَّ رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - صَلَّى بِهِمْ فِي غَزْوَةٍ إِلَى بَعِيرٍ مِنَ الْمَقْسِمِ ، فَلَمَّا سَلَّمَ قَامَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَتَنَاوَلَ وَبَرَةً بَيْنَ أُنْمُلَتَيْهِ فَقَالَ : " إِنَّ هَذِهِ مِنْ غَنَائِمِكُمْ وَإِنَّهُ لَيْسَ لِي فِيهَا إِلَّا نَصِيبِي مَعَكُمْ إِلَّا الْخُمُسَ ، وَالْخُمُسُ مَرْدُودٌ عَلَيْكُمْ فَأَدُّوا الْخَيْطَ وَالْمِخْيَطَ ، وَأَكْبَرَ مِنْ ذَلِكَ وَأَصْغَرَ وَلَا تَغُلُّوا فَإِنَّ الْغُلُولَ نَارٌ وَعَارٌ عَلَى أَصْحَابِهِ فِي الدُّنْيَا وَالْآخِرَةِ " .
رَوَاهُ أَحْمَدُ ، وَفِيهِ أَبُو بَكْرِ بْنُ أَبِي مَرْيَمَ ، وَهُوَ ضَعِيفٌ .
It is reported about Sayyiduna al-Miqdam bin Ma'dikarib al-Kindi (may Allah be pleased with him) that he was sitting with Sayyiduna Ubadah bin al-Samit (may Allah be pleased with him) and Sayyiduna Abu al-Darda' (may Allah be pleased with him), or perhaps Sayyiduna al-Harith bin Mu'awiyah al-Kindi (may Allah be pleased with him). They were discussing the hadith of the Prophet (peace and blessings be upon him). Sayyiduna Abu al-Darda' (may Allah be pleased with him) said to Sayyiduna Ubadah (may Allah be pleased with him): "O Ubadah, the words of the Messenger of Allah that he spoke during a campaign regarding the status of the khumus (one-fifth), (what are they?)" Sayyiduna Ubadah (may Allah be pleased with him) said: The Prophet (peace and blessings be upon him) led them in prayer during a campaign, facing a camel from the spoils of war. When he had said the salam, the Prophet (peace and blessings be upon him) stood up, stepped forward, took a hair between his two fingertips and said: "This too is from your spoils of war, and my share in it is only one share along with you, except for the khumus, and the khumus too will be returned to you. So hand over the thread and the needle, and whatever is bigger and smaller than that, and do not embezzle, for embezzlement will be fire and disgrace for those who do it, in this world and the Hereafter."
Ahmad recorded it. Its chain contains a narrator, Abu Bakr bin Abi Maryam, who is da'if (weak).
