بَابُ مَا نُهِيَ عَنْ قَتْلِهِ مِنَ النِّسَاءِ وَغَيْرِ ذَلِكَ
Women and others whom it is forbidden to kill
Majma al-Zawaid 9614 — Women and others whom it is forbidden to kill
وَعَنْ أَبِي مُوسَى أَنَّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - كَانَ إِذَا بَعَثَ سَرِيَّةً قَالَ : " اغْزُوا بِسْمِ اللَّهِ وَقَاتِلُوا مَنْ كَفَرَ بِاللَّهِ وَلَا تُمَثِّلُوا وَلَا تَغُلُّوا [ وَلَا تَغْدِرُوا ] وَلَا تَقْتُلُوا وَلِيدًا [ وَلَا شَيْخًا كَبِيرًا ] " .
رَوَاهُ الْبَزَّارُ ، وَالطَّبَرَانِيُّ فِي الصَّغِيرِ وَالْكَبِيرِ ، وَرِجَالُ الْبَزَّارِ رِجَالُ الصَّحِيحِ غَيْرَ عُثْمَانَ بْنِ سَعِيدٍ الْمُرِّيِّ ، وَهُوَ ثِقَةٌ .

Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him) narrates: Whenever the Prophet (peace and blessings be upon him) dispatched a military expedition, he would say: "Seeking blessing with the name of Allah Almighty, take part in the battle, and fight those who disbelieve in Allah Almighty. Do not mutilate, do not embezzle, do not break covenants, and do not kill any child or aged old man."
Al-Bazzar recorded it, and al-Tabarani in al-Mu'jam al-Saghir and al-Mu'jam al-Kabir. The narrators of al-Bazzar are the narrators of the Sahih, except for Uthman bin Sa'id al-Murri; his case is different, and he is thiqah (trustworthy).
