Majma al-Zawaid 7760 — Taking back a divorced wife

Ayyub bin Sulayman al-Jawzi narrates: I asked Ata' bin Abi Rabah about a person who, mentioning a woman, says: "On the day I marry her, she is irrevocably divorced (talaq battah)." Ata' replied: "A man cannot divorce one whose marriage contract he does not own, and he cannot free one whose neck he does not own." This was mentioned from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both), and he attributed it to the Prophet (peace and blessings be upon him).
Tabarani recorded it. I do not know the narrator Ayyub; the remaining narrators of this report are thiqat (trustworthy).
