بَابٌ فِيمَنْ أَعْتَقَ نَصِيبًا فِي عَبْدٍ .

وَعَنْ عَائِشَةَ قَالَتْ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " إِذَا كَانَ الْعَبْدُ بَيْنَ شُرَكَاءَ فَأَعْتَقَ بَعْضُهُمْ قُوِّمَ عَلَيْهِ بِأَغْلَى الْقِيمَةِ فَيَغْرَمُ ثَمَنَهُ وَيُعْتَقُ الْعَبْدُ " .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ ، وَفِيهِ الْمُثَنَّى بْنُ الصَّبَّاحِ ، وَهُوَ ضَعِيفٌ ، وَقَدْ وُثِّقَ .

Sayyidah Aishah al-Siddiqah (may Allah be pleased with her) narrates: The Prophet (peace and blessings be upon him) said: "When a slave is jointly owned by several people and one of them frees him, the slave will be valued at the highest price; then he will pay his value as a liability (penalty), and the slave will be freed."
Imam al-Tabarani recorded this narration in al-Mu'jam al-Awsat; its chain contains a narrator, al-Muthanna bin al-Sabbah, who is da'if (weak), though he has also been declared trustworthy.
