بَابُ الْوَصِيَّةِ بِأَكْثَرَ مِنَ الثُّلُثِ لِمَنْ لَا وَارِثَ لَهُ .

عَنْ أَبِي مَيْسَرَةَ عَمْرِو بْنِ شُرَحْبِيلَ الْهَمْدَانِيِّ قَالَ : قَالَ لِي عَبْدُ اللَّهِ بْنُ مَسْعُودٍ : إِنَّكُمْ مِنْ احُدَاحِي بِالْكُوفَةِ أَنْ يَمُوتَ أَحَدُكُمْ ، وَلَا يَدْعُ عَصَبَةً ، وَلَا رَحِمًا فَمَا يَمْنَعُهُ أَنْ يَضَعَ مَالَهُ فِي الْفُقَرَاءِ وَالْمَسَاكِينِ ؟ .
رَوَاهُ الطَّبَرَانِيُّ ، وَرِجَالُهُ رِجَالُ الصَّحِيحِ .

Abu Maysarah Amr bin Shurahbil al-Hamdani narrates: Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "O elders of Kufa! If one of you dies and leaves behind no agnatic heir ('asabah) and no relative, then what prevents him from spending his wealth on the poor and the needy?"
