Majma al-Zawaid — Hadith 7046

وَعَنْ عُمَارَةَ بْنِ حَزْمٍ أَنَّهُ شَهِدَ أَنَّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَضَى بِالْيَمِينِ وَالشَّاهِدِ .
قَالَ زَيْدُ بْنُ الْحُبَابِ : سَأَلْتُ مَالِكَ بْنَ أَنَسٍ عَنِ الْيَمِينِ وَالشَّاهِدِ هَلْ يَجُوزُ فِي الطَّلَاقِ وَالْعَتَاقِ ؟ فَقَالَ : لَا ؛ إِنَّمَا هَذَا فِي الشِّرَاءِ وَالْبَيْعِ وَأَشْبَاهِهِ .
رَوَاهُ أَحْمَدُ وِجَادَةً ، وَكَذَلِكَ الطَّبَرَانِيُّ فِي الْكَبِيرِ ، وَرِجَالُهُ ثِقَاتٌ .
Sayyiduna Umarah bin Hazm (may Allah be pleased with him) testifies and states: The Prophet (peace and blessings be upon him) gave judgment on the basis of an oath and one witness. Zayd bin al-Hubab says: I asked Imam Malik bin Anas about judging on the basis of an oath and one witness: is it valid in matters of divorce and freeing slaves? He said: No! It applies to buying and selling and similar matters.
Ahmad recorded it as wijadah, and al-Tabarani likewise recorded it in al-Mu'jam al-Kabir, and its narrators are thiqat (trustworthy).
